[ Roll Call  ]

MARCH 21ST. CLERK.

[Public Hearing and Consideration of the following Adoption and Amendments of the Neighborhood, Community and Perimeter Plans as Components of the Master Plan and Zoning Cases. Plan amendments and Zoning cases presented by Roderick Sanchez, Assistant City Manager; Michael Shannon, Director, Development Services unless otherwise noted.  ]

>> CLERK: MAYOR PRO TEM, WE HAVE A QUORUM. >> GARCIA: THANK YOU SO MUCH. WE WILL START OFF WITH REVIEWING THE CONSENT AGENDA ITEMS. THE CONSENT ZONING ITEMS ARE ITEMS 1, 3, 4, 6, 7, 8, 9, 10, 11, 13, 14, AND 17. DO ANY OF MY COLLEAGUES HAVE ANYTHING TO PULL FROM THE CONSENT? WONDERFUL. WITH NO -- WITH NO

ADDITIONS, I'LL ENTERTAIN A MOTION TO APPROVE. >> COURAGE: SECOND.

>> GARCIA: THERE'S A MOTION AND SECOND. WE'LL CONTINUE ON WITH PUBLIC COMMENT. THERE ARE FOUR -- WELL, TWO PEOPLE SIGNED UP TO SPEAK.

THE FIRST ONE IS JACK FINGER, SPEAKING ON 3, 9, 10:00, FOLLOWED BY

>> GOOD AFTERNOON, MAYOR MADAME PRO TEM AND OTHER MEMBERS OF OUR ILLUSTRIOUS CITY COUNCIL.

FOR THE RECORD, MY NAME IS JACK M. FINGER. IN THE WORDS OF ONE OF YOUR COUNCIL COUNCIL MEMBERS, YOUR RESIDENT HATER. TWO ITEMS I WISH TO BRING TO YOUR ATTENTION ON THIS PORTION OF THE AGENDA REGARDING THE ZONING CASE NO. -- THE ZONING CASE REFERENCE NO. 3. YES. THIS IS MS. VIAGRAN'S DISTRICT.

I DON'T SEE HER AT THIS TIME. NO, SHE'S NOT HERE. ANYWAY, IF ANYONE IS HERE, WOULD YOU PLEASE ASK HER TO -- [COUGHING] EXCUSE ME.

IF YOU WOULD, SOMEONE MIGHT WANT TO PULL ITEM NO. 3 FOR DELIBERATION BECAUSE IT HAS A NUMBER OF BAD MARKS AGAINST IT HERE. YES.

IT'S ABOUT, OH, CHANGING AN R-4 DESIGNATION TO R-4 CD WITH A CONDITIONAL USE FOR FOUR DWELLING UNITS IN A LOT OVER ON EAST DREXEL STREET ON THE SOUTHEAST SIDE.

YEAH. I THINK THE PROBLEM IS THAT OUT OF THE 23 NOTICES SENT OUT, THREE CAME OUT, IN OTHER WORDS ABOUT 12% OR SO OF THE PEOPLE IN THE SURROUNDING AREA DIDN'T WANT IT. WHEN YOU HAVE ANYTHING OVER 5% OR 10%, THAT'S WORTH NOTING.

I GUESS ALSO I NOTICED THAT THE HIGHLAND PARK NEIGHBORHOOD ASSOCIATION OPPOSED IT AS WELL.

PROBABLY BECAUSE THEY DIDN'T WANT THE EXTRA INTENSITY IN THAT AREA.

IF SOMEONE WOULD LIKE TO PULL ITEM 3 FOR SOME DELIBERATION THERE.

ITEM NO. 9 IS OVER IN MS. CASTILLO, YOUR DISTRICT THERE.

YES, IT'S OVER ON MONTEZUMA STREET SHOEHORNING TWO LOTS OVER ON MONTEZUMA STREET.

ABOUT 10% OF THOSE PEOPLE DIDN'T WANT IT EITHER. THAT'S A SIGNIFICANT NUMBER WHEN YOU HAVE THAT MANY PEOPLE SAYING NO WE DON'T WANT THE EXTRA INTENSITY IN OUR NEIGHBORHOOD.

YOU MAY WANT TO PULL IT FOR DELIBERATION, MADAME. YES.

AND WHILE WE'RE ON THE CONSENT AGENDA, JUST ONE LITTLE ASIDE, MR. COURAGE, YOUR DISTRICT.

ITEM NO. 14 IS ABOUT PLACING A VETERINARY HOSPITAL IN YOUR AREA OVER ON STONE OAK PARKWAY.

WE'RE TALKING ABOUT THE 65% -- >> GARCIA: THANK YOU, MR. FINGER.

VINCE HUBBINGER. >> MAYOR PRO TEM, I'M THE APPLICANT ON NO. 4.

[00:05:06]

I JUST SIGNED UP IN FAVOR JUST IN CASE IT WAS PULLED. >> GARCIA: THANK YOU.

IS ANYTHING IN THE QUEUE? WITH NOBODY IN THE QUEUE, WE'LL TAKE A VOTE.

PLEASE TAKE A VOTE. THIS IS FOR APPROVAL OF THE CONSENT AGENDA.

>> VIAGRAN: AYE. >> GARCIA: WE'LL CONTINUE ON TO THE CONTINUED ZONING ITEMS. THESE ARE THE ITEMS THAT ARE GOING TO BE MOVED TO THE ZONING MEETING FOR APRIL 4.

THOSE INCLUDE ITEM NO. 2 AND ITEM NO. 12. OH, MOTION CARRIES.

I'M SORRY. ITEMS TO BE CONTINUED TO APRIL 4 INCLUDE ITEM 2 AND 12.

IS THERE ANY DISCUSSION? ALL RIGHT. 2 AND 12.

LET'S GO AHEAD AND TAKE A VOTE. >> VIAGRAN: AYE. >> GARCIA: COUNCILWOMAN

VIAGRAN, CAN WE GET A VOTE? >> VIAGRAN: AYE. >> GARCIA: MOTION CARRIES.

MOVING ON TO THE INDIVIDUAL ZONING ITEMS. THERE'S TWO ITEMS ON THE AGENDA.

ONE IS ITEM NO. 5. THE OTHER IS ITEMS 15 AND 16. >> CLERK: AGENDA ITEM NO. 5.

SEVEN NOTICES MAILED, ONE IN FAVOR, ZERO OPPOSED. AND THERE'S NO REGISTERED

NEIGHBORHOOD ASSOCIATION IN THIS AREA. >> GARCIA: THANK YOU SO MUCH.

THIS ITEM HAS BEEN CONTINUED SEVERAL TIMES IN HOPE OF SOME COMPROMISE.

HOWEVER THE RESIDENTS AND OTHER ENTITIES IN THE AREA ARE NOT IN SUPPORT OF THIS ZONING AMENDMENT. AND LISTENING TO THE CONCERNS SHARED BY MEMBERS OF THE COMMUNITY, I DID NOT FEEL COMFORTABLE WITH MOVING FORWARD. THAT WAS IN DISTRICT 4.

BUT I AM CHAIRING SO MY COLLEAGUES WILL STEP IN. >> COURAGE: MADAME CHAIR, I

MAKE A MOTION TO DISAPPROVE THE ZONING. >> SECOND.

>> COURAGE: DENY ZONING. >> GARCIA: THERE'S A MOTION AND A SECOND.

ALL IN FAVOR. SORRY, COUNCILWOMAN, YOUR VOTE. >> VIAGRAN: AYE.

>> GARCIA: A YEA VOTE DENIES IT. MOTION CARRIES.

ITEM NO. 15 AND 16. INDIVIDUAL ZONING ITEM FOR -- >> CLERK: YES, MA'AM.

STAFF, PLANNING AND ZONING COMMISSION RECOMMEND APPROVAL WITH CONDITIONS.
