[1. Invocation]
THE TIME IS 9:11 A.M.WE WILL BEGIN THE MORNING WITH AN INVOCATION, GUEST OF COUNCILMAN PELAEZ.
BUT IT IS MY HONOR TO INTRODUCE MINISTER TRAVIS EADES OF OAK HILLS CHURCH.
TRAVIS SERVES THE PEOPLE OF OAK HILLS CHURCH AS THEIR LEAD PASTOR.
HE HAS JUST RECENTLY RECEIVED THIS CALL FOLLOWING HIS FRIEND, MENTOR, AND GREAT CITIZEN MAX LUCADO.
HE AND HIS WIFE MOVED HERE TO RAISE THEIR FOUR CHILDREN AND HIS PASSION IS TO SEE THE CHURCH BE THE HANDS AND FEET OF CHRIST IN THE CITY OF SAN ANTONIO.
PASTOR, THANK YOU SO MUCH FOR JOINING US.
OUR FATHER IN HEAVEN, WE ACKNOWLEDGE THAT THIS IS THE DAY THAT YOU HAVE MADE.
WE THANK YOU FOR YOUR MERCIES THAT ARE BRAND NEW THIS MORNING.

THE MEETING MINUTES OF THE CITY COUNCIL SPECIAL SESSION OF AUGUST 28 AND THE REGULAR MEETINGS OF AUGUST 29 AND 30.
>> MAYOR NIRENBERG: THERE'S A MOTION AND A SECOND FOR APPROVAL OF THE CITY COUNCIL MEETING MINUTES FROM AUGUST 28, 29, AND 30.
[Additional Item]
ALL RIGHT.I HAVE A POINT OF PERSONAL PRIVILEGE THAT I KNOW I, OUR COLLEAGUES AND OUR STAFF ARE ALL VERY EXCITED ABOUT.
[00:05:02]
AARP FOR A SPECIAL RECOGNITION.AND AS MANY OF YOU MAY KNOW, AS THE U.S. POPULATION AGES AND PEOPLE STAY HEALTHY AND ACTIVE LONGER, COMMUNITIES MUST ADAPT.
OUR CITY, SAN ANTONIO, IS NO DIFFERENT.
IN 2014 MAYOR CASTRO JOINED THE AARP NETWORK OF AGE FRIENDLY COMMUNITIES SOLIDIFYING THE COMMITMENT FOR HEALTHIER, HAPPIER RESIDENTS OF ALL AGENTS.
THE AARP IS AN AFFILIATE OF THE WORLD HEALTH ORGANIZATION'S PROGRAM.
INITIATIVES FOCUS ON AREAS SUCH AS HOUSING, CARE GIVING, COMMUNITY ENGAGEMENT, VOLUNTEERING, SOCIAL INCLUSION AND COMBATING ISOLATION AMONG OLDER CITIZENS.
AND THE IMPROVEMENTS THAT HELP OLDER SAN ANTONIANS HELP PEOPLE OF ALL AGES.
MORE LIVABLE AGE-FRIENDLY COMMUNITIES FROM THE GRANDMOTHER WITH A WALKER TO THE MOTHER WRANGLING CHILDREN IN A STROLLER.
RECENTLY MY STAFF AND I WERE PLEASED TO WORK WITH AARP ON SAN ANTONIO'S NEW HOUSING POLICY.
THE VAST MAJORITY OF PEOPLE AGE 50 AND OLDER WANT TO STAY IN THEIR HOMES AND COMMUNITIES FOR AS LONG AS POSSIBLE.
AND ONE OF THE BIGGEST PARTS OF THAT IS HOUSING.
I'M PROUD TO SAY WE'RE PROMOTING HOUSING THAT ENABLES RESIDENTS TO LIVE SAFELY, COMFORTABLY, AND INDEPENDENTLY FOR AS LONG AS POSSIBLE.
THIS IS JUST ONE WAY THAT WE'RE WORKING TO MAKE OUR CITY A MORE AGE-FRIENDLY COMMUNITY.
I LOOK FORWARD TO WORKING TOGETHER WITH AARP TO MAKE OUR CITY EVEN BETTER TOGETHER IN THE MONTHS AND YEARS TO COME.
I KNOW WE HAVE MEMBERS OF AARP PRESENT HERE WITH US IN THE COUNCIL CHAMBERS TODAY.
SO I WOULD LIKE TO ASK THEM TO COME FORWARD AND GIVE A FEW BRIEF REMARKS.
LISA RODRIGUEZ, JOHN VASQUEZ, JULIAN HOYT, BARBARA WIT HOWELL, LEILA AGUIRRE AND YOLANDA.
WE ALSO HAVE ALEX AS WELL AND ROSIE CASTRO SENDS HER BEST REGARDS .
>> THANK YOU, MAYOR AND COUNCIL.
FIRST OF ALL, AGAIN, ACKNOWLEDGING MAYOR NIRENBERG FOR REENROLLING AND RECOMMITTING THE CITY TO BE AN AGE-FRIENDLY CITY.
AS I SAID LAST TIME I WAS HERE AT THE HOUSING MEETING IS THAT WE DO HAVE OVER 100,000 MEMBERS.
BUT MORE IMPORTANTLY A THIRD OF SAN ANTONIO'S POPULATION IS 50 PLUS.
AND IT'S ONLY GOING TO CONTINUE TO GROW.
SO THIS CONFIRMATION, THIS ACKNOWLEDGMENT IS REALLY AN ATTESTMENT AND WE'RE VERY PROUD TO BE IN THIS CITY, THAT YOU DO CARE ABOUT 50-PLUSSERS.
CLOSER THAN MOST OF, SOME OF YOU.
WE ALSO WANT TO TAKE THE OPPORTUNITY TO SAY WE STARTED THIS SINCE 2014 GATHERING PUBLIC INPUT FROM ALL SECTORS OF SAN ANTONIO AND WE WANT TO TAKE THIS OPPORTUNITY TO THANK COUNCILWOMAN GONZALES, COUNCILMAN REY SALDANA AND COUNCILMAN TREVINO, BECAUSE THEY HAVE BEEN WITH US THROUGH ALL THESE YEARS ENSURING CONSTANT SUPPORT.
I KNOW ALL THE OTHERS ON THE COUNCIL ARE, I'M SURE, SUPPORTIVE AS WELL.
WE DON'T HAVE A RELATIONSHIP WITH YOU BUT WE WANT TO CONTINUE TO WORK WITHIN YOUR DISTRICTS.
AS WE DID WITH HOUSING, IT'S FOR ALL, AND WE'RE FOCUSING ON 50 PLUS.
AGAIN, THANK YOU FOR TAKING THE TIME.
MAYOR, FOR RECOGNIZING THIS AWESOME PRIVILEGE AND THIS AWESOME CERTIFICATION.
SO PROUD TO BE A SAN ANTONIAN TODAY.
AND THESE GREAT VOLUNTEERS, WE COULDN'T DO THE WORK WITHOUT THEM.
THEY ARE 50 PLUS AND THEY HAVE GREAT BACKGROUNDS, AND WE'RE JUST VERY PROUD OF THEM.
>> MAYOR NIRENBERG: THANK YOU, LISA.
WE DO HAVE COUNCIL MEMBERS WHO WOULD LIKE TO MAKE COMMENTS BEFORE WE COME DOWN.
>> MAYOR NIRENBERG: COUNCILMAN TREVINO.
I WANT TO THANK ALL OF YOU FOR BEING HERE TODAY.
OF COURSE, THIS IS SENIOR CENTER MONTH AND I WANT TO ESPECIALLY THANK BARBARA WIT HOWELL FOR REPRESENTING DISTRICT 1 IN THE CITY-COUNTY JOINT COMMISSION ON ELDERLY AFFAIRS.
I WANT TO SAY ALSO WE MET RECENTLY ABOUT THE NEW PEDESTRIAN MOBILITY OFFICER AND WANT TO GET YOUR SUPPORT TO MAKE SURE THIS PEDESTRIAN MOBILITY OFFICER HAS A GREAT RELATIONSHIP WITH YOUR ORGANIZATION, BECAUSE IT IS YOUR ORGANIZATION THAT HAS LED ON THESE ISSUES OF MOBILITY AND ACCESSIBILITY FOR OUR CITY.
WE LOOK FORWARD TO MORE OF YOUR GREAT WORK.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN TREVINO.
MUCH DESERVED RECOGNITION FOR YOU ALL.
AARP HAS THEIR HEADQUARTERS ON GUADALUPE IN DISTRICT 5.
AND THEY HAVE AN INCREDIBLE ORGANIZATION.
AND SO A COUPLE OF YEARS AGO I WAS INVITED TO SPEAK TO AN AARP GROUP IN CHICAGO TO TALK ABOUT VISION ZERO.
[00:10:01]
IT WASN'T MEMBERSHIP.I WAS SO IMPRESSED WITH THE ORGANIZATION, HOW INNOVATIVE AARP IS, HOW INCLUSIVE IT IS.
I KNOW AS YOU SAID, 50 IS NOT SO FAR.
AND WE DO ALL HOPE TO GET THERE.
BUT IT REALLY WAS A VERY YOUNG AT HEART ORGANIZATION.
IN FACT, I FELT VERY MUCH AT HOME WITH ALL THE AARP STAFF OVER THERE IN CHICAGO.
AND THAT WAS A NATIONWIDE ORGANIZATION.
AND I HAD A LOT OF MISCONCEPTIONS MYSELF ABOUT WHAT IT MEANT TO BE AN AARP MEMBER OR IN FACT WHAT THE ORGANIZATION DOES.
BECAUSE IT WAS, OF COURSE, WHILE YOUR ATTENTION IS FOR OLDER AMERICANS, THE REALITY IS WE ARE DESIGNING CITIES NOW FOR YOUNG PEOPLE.
IN FACT, SOMETIMES THE WAY THAT WE DESIGN CITIES FOR CHILDREN WILL ACTUALLY BE IMPACTFUL FOR PEOPLE OF ALL AGES.
BECAUSE WE KNOW JUST LIKE WE TALK ABOUT SENIORS AGING IN PLACE AND PEOPLE AGING IN PLACE, THE NEIGHBORHOODS THAT WE DESIGN, IF WE DESIGN THEM FOR SENIORS OR WE DESIGN THEM FOR CHILDREN, IT MEANS THEY'RE SAFE FOR EVERYONE.
SO AARP IS SO IMPORTANT IN GETTING THAT WORD OUT AND ALSO IN THEIR DATA COLLECTION.
IT'S ALSO, PERHAPS, SOMETHING PEOPLE DON'T KNOW IS THEY HAVE INCREDIBLE DATA TO SHARE WITH ALL OF US AND THEY'VE ALWAYS BEEN WILLING TO SHARE THAT INFORMATION.
SO I'M VERY PROUD OF AARP AND THE WORK THEY'RE DOING HERE IN SAN ANTONIO, BUT ALSO ALL OVER THE COUNTRY.
SO THANK YOU, LISA, FOR YOUR LEADERSHIP.
I KNOW IT'S BEEN A PLEASURE WORKING WITH YOU ALL IN SOME OF OUR INITIATIVES.
>> MAYOR NIRENBERG: THANK YOU, COUNCILWOMAN GONZALES.
I WANT TO COMMEND AARP FOR ALL THE WORK THAT YOU'VE DONE FOR PEOPLE IN OUR COMMUNITY AND PEOPLE AROUND THE COUNTRY.
I KNOW THE ORGANIZATION NATIONALLY HAS REALLY STOOD UP FOR SENIOR CITIZENS, HAS WANTED TO MAKE SURE WE PROTECT THINGS LIKE SOCIAL SECURITY THAT WE WANT TO MAKE SURE THE SENIOR CITIZENS AREN'T RIPPED OFF BY CRIMINALS.
YOU HAVE DONE SO MUCH IN OUR COMMUNITY HERE.
AS MAYBE THE ONLY MEMBER ON THE COUNCIL WHO'S OLD ENOUGH -- EXCEPT FOR COUNCILMAN PERRY, WHO DOESN'T WANT TO ADMIT IT, I WANT TO SAY THANK YOU FOR THE SERVICES THAT YOU PROVIDE FOR THE PEOPLE HERE IN SAN ANTONIO.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN COURAGE.
AND I KNOW THAT WE'VE HEAPED A LOT OF PRAISE ON YOU AND YOU DESERVE IT.
I WANT TO THANK LISA AS THE LEADER AND THE MEMBERS HERE PRESENT IN THE CHAMBER.
WE ARE PROUD THAT YOU ARE DIGGING DEEP INTO THE COMMUNITY AND FIGURING OUT WAYS TO HELP YOUR MEMBERS, YOUR CONSTITUENTS.
IT WASN'T TOO LONG AGO, MAYBE TWO YEARS, LISA, WE SAT DOWN IN YOUR OFFICE THINKING ABOUT DISTRICT 4 OR SOUTH SIDE-SPECIFIC INITIATIVES THAT WE COULD WORK ON.
OUT OF THAT IDEA CAME THE CONCEPT OF THE SICLOVIA THAT WE'RE HAVING OCTOBER 27TH.
YOU ALL ARE THE MAIN SPONSORS, THE DRIVING FORCE BEHIND IT.
I WANTED TO LET YOU KNOW HOW GRATEFUL I AM AND OF COURSE JUST TO PITCH AGAIN OCTOBER 27TH EVENT.
WE'LL CLOSE DOWN THE STREETS NEAR PEARSALL PARK AND IT'S GOING TO BE AN EVENT THAT REALLY AARP IS THE FUEL BEHIND THE MACHINE.
SO THANK YOU TO THE MEMBERS AND THANK YOU TO LISA FOR BEING HERE.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN SALDANA.
>> PERRY: WELL, I'VE GOT TO COME BACK ON COUNCILMAN COURAGE, OF COURSE.
DO I REALLY LOOK THAT OLD, JOHN? DANG.
>> COURAGE: IT'S THE GRAY HAIR.
>> PERRY: THANK Y'ALL VERY MUCH FOR WHAT YOU DO.
Y'ALL PLAY A VERY IMPORTANT PART WITH SENIORS ACROSS NOT ONLY SAN ANTONIO BUT ACROSS THE COUNTY HERE.
I'M INVOLVED WITH AACOG AND WE HAVE A VERY STRONG ADVISORY BOARD ON AACOG AS WELL.
AND VERY GOOD TO SEE THAT ACTIVITY AND STANDING UP FOR THE SENIORS WHO DO NEED HELP IN A LOT OF DIFFERENT AREAS.
BUT THANK YOU VERY MUCH FOR WHAT YOU DO.
YOU KNOW, WHEN I FIRST START GETTING THOSE CARDS IN THE MAIL SO LONG, LONG AGO I SAID, MAN, I'M NOT OLD ENOUGH FOR THAT YET.
BUT IT IS A GOOD ORGANIZATION TO BE INVOLVED WITH AND A LOT OF GOOD INFORMATION AND HELP IN DIFFERENT WAYS WITH INSURANCE AND A LOT OF DIFFERENT THINGS THAT AARP PROVIDES.
SO THANK YOU VERY MUCH FOR WHAT YOU DO.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN PERRY.
>> SANDOVAL: THANK YOU, MAYOR.
GREAT TO SEE YOU AND GREAT TO SEE ALL OF YOU.
I ALSO WANT TO ECHO MY FELLOW COUNCIL MEMBERS' COMMENTS AND THANK YOU FOR ALL THE WORK THAT YOU DO.
I HOPE OUR RELATIONSHIP WILL BE AS STRONG AS THE ONE YOU HAVE WITH THE OTHER COUNCIL MEMBERS IN THE NEAR FUTURE, AND I'M LOOKING FORWARD TO OUR -- WHAT ARE WE GOING TO CALL IT? OUR NOT SICLOVIA EVENT? A SENIOR VIA?
>> SANDOVAL: SENIOR VETERANS EVENT.
THAT'S COMINGUP AND THE ONE IN THE SPRING AS WELL.
THANK YOU SO MUCH FOR BEING SO
[00:15:03]
HELPFUL TO ME AND THE DISTRICT 7 RESIDENTS AND REACHING OUT TO US AND OPENING YOUR DOORS AND YOUR ARMS FOR THE RELATIONSHIP THAT WE HAVE.>> MAYOR NIRENBERG: THANK YOU, COUNCILWOMAN SANDOVAL.
THANK YOU ALL FOR YOUR HARD WORK.
AND I WOULD LIKE TO ASK -- INVITE MY COLLEAGUES DOWN.
[Consent Agenda]
THANK YOU ALL VERY MUCH.AT THIS TIME I WOULD LIKE TO ASK MY COLLEAGUES IF THERE ARE ANY ITEMS WHICH THEY WOULD LIKE TO PULL FROM THE CONSENT AGENDA.
HEARING NONE, I'LL ENTERTAIN A MOTION FOR THE BALANCE OF THE CONSENT AGENDA.
>> MAYOR NIRENBERG: THERE'S A MOTION AND A SECOND SAVE FOR ALL ITEMS SAVE 27.
THERE ARE SOME CITIZENS WHO HAVE SIGNED UP TO SPEAK ON ITEMS REMAINING ON CONSENT.
>> WELL, GOOD MORNING, MAYOR NIRENBERG AND OTHER MEMBERS OF THE BEST CITY COUNCIL MONEY CAN BUY, BY GOLLY.
AND I, JACK FINGER, I DON'T SAY THOSE WORDS LIGHTLY.
I'LL ILLUSTRATE THEM IN JUST A MOMENT HERE.
BUT FIRST OF ALL, A LITTLE BIT OF HOUSEKEEPING.
I'M THANKFUL FOR ONE GOOD THING Y'ALL ACTUALLY DID THIS MORNING.
YOU DIDN'T HAVE AN ATHEIST COME BY AND OFFER A NON-INVOCATION INVOCATION, MS. SANDOVAL.
LAST WEEK I KEPT LISTENING FOR HIS PRAYER BUT WHEN NONE CAME IT FINALLY STRUCK ME ATHEISTS DON'T HAVE A PRAYER.
ALSO ANOTHER THING THE LITTLE CEREMONY YOU HAD THIS MORNING WITH AARP.
YES, ALL THE GOOD THINGS Y'ALL MENTIONED ABOUT AARP.
IT'S HARD TO BELIEVE THAT AARP WAS ACTUALLY A PROMOTOR OF THAT TRAVESTY CALLED OBAMACARE.
YEARS AGO AND IT'S ABORTION CONTINGENT.
I'LL BE LOOKING AT A COMPETITOR LATER ON.
A FEW ITEMS I WISH TO BRING TO
[00:20:01]
YOUR ATTENTION.ESPECIALLY ONE DEALING RIGHT HERE.
THE BRACKENRIDGE CONSERVANCY IS A GROUP THAT WANTS TO PRESERVE BRACKENRIDGE PARK.
IT WANTS TO DO ALL KINDS OF CONSERVATION PROJECTS WITH OUR TAX DOLLARS, OF COURSE.
AND THAT MAY OR MAY NOT BE A GOOD THING.
BUT I NOTICED THAT IN THE BACKUP DOCUMENTS, SOME OF THE BIG PROJECTS IT HAS IN LINE FOR BRACKENRIDGE PARK MAY INCLUDE PROJECTS WHERE ENGINEERING AND CONSTRUCTION ARE REQUIRED.
AND ONE OF ITS BIG SUBCONTRACTORS OR ONE OF ITS BIG COMPANIES THAT REALLY IT'S A PART OF HAS SUBSTANTIAL RELATIONSHIPS WITH IS THE MARTIN DROUGHT ENGINEERING COMPANY.
BY GOLLY, I NOTICED IN THE BACK UP DOCUMENTS MARTIN DROUGHT ENGINEERING COMPANY GAVE ALMOST EACH AND EVERY ONE OF YOU A CAMPAIGN CONTRIBUTION.
MAYOR, YOU GOT $1,000 RIGHT HERE.
MR. TREVINO EVEN GOT MORE THAN YOU, MR. MAYOR.
THE ONLY GUY THAT DIDN'T GET A SINGLE DARN THING WAS MR. BROCKHOUSE.
I GUESS THE LOW MAN ON THE TOTEM POLE THERE.
THEY CONSIDER HIM AN OUTSIDER.
DON'T WORRY, MR. BROCKHOUSE, YOUR DAY WILL COME THERE.
I DON'T KNOW WHY THE BRACKENRIDGE CONSERVANCY WOULD DO SUCH A THING KNOWING IF YOU DID THE RIGHT THING AND ABSTAIN FROM SUCH A THING, THIS THING WOULDN'T PASS AT ALL.
I GUESS THE CONSERVANCY KNOWS SOMETHING I DON'T ON THESE THINGS.
WHAT OTHER SCANDALS DO WE HAVE ON THIS PORTION OF THE AGENDA? YES, WELFARE HOUSING.
>> MAYOR NIRENBERG: THANK YOU, MR. FINGER.
THERE'S A MOTION AND A SECOND FOR THE BALANCE OF THE CONSENT.
COUNCILMAN TREVINO HAS SOME COMMENTS.
YOU KNOW, I WANT TO TAKE THIS PERSONAL POINT OF PRIVILEGE TO TALK ABOUT BRACKENRIDGE PARK AND BRACKENRIDGE PARK HAS REALLY COME A LONG WAY SINCE THE MASTER PLAN DISCUSSION SEVERAL YEARS AGO.
AND THIS IS THE TIME FOR THIS PARK.
I'M REALLY PROUD TO BE A PART OF THIS AND I THINK ALL SAN ANTONIO SHOULD BE PROUD OF THIS INCREDIBLE HISTORIC PARK THAT HAS SEEN SUCH GREAT INVESTMENT.
IT IS SOMETHING THAT WE RECEIVED THROUGH OUR BOND FUNDS AND APPROVED BY THE VOTERS LAST YEAR.
IT WILL SEE A NEW LEVEL OF CONNECTEDNESS AS THE BROADWAY CORRIDOR CONTINUES TO EVOLVE.
THANK YOU TO THE BRACKENRIDGE CONSERVANCY.
PRESIDENT JOE CALVERT AND TREASURER LUKEN GILLIAN, WHOSE BIRTHDAY IS TODAY.
I WANT TO ALSO THANK THE ENTIRE BOARD AND ASK MS. LYNN BOBBIT TO COME UP AND SAY A FEW WORDS ABOUT THE PROGRESS OF BRACKENRIDGE PARK.
THANK YOU SO MUCH FOR THIS OPPORTUNITY.
I'D LIKE TO THANK THE CITY MANAGER AND XAVIER URRUTIA AND THE STAFF FOR BRINGING US TO THIS POINT.
THIS IS AN EXCITING TIME TO EXPAND OUR RELATIONSHIP WITH THE CITY.
IT IS THE YEAR AND MULTI-YEAR OF BRACKENRIDGE PARK TO MOVE IT FORWARD WITH THIS EXPANDED MANAGEMENT AGREEMENT WE'LL BE ABLE TO DELVE INTO THE MASTER PLAN STRATEGIES THAT WERE ADOPTED BY CITY COUNCIL.
ONE OF WHICH IS THE RESTORATION OF THE HISTORIC STRUCTURES IN THE PARK.
AND THIS EXPANDED AGREEMENT DOES GIVE US THAT OPPORTUNITY TO DO THAT.
IT IS SUCH AN EXCITING PERIOD RIGHT NOW AND IT'S NOT FRIVOLOUS ACTIVITY THAT IS GOING ON.
THE COMMUNITY VOTED, AS YOU KNOW, ON THE BOND WORK.
NORTHNEXT WEEK WE WILL BEGIN SOF THE RESTORATIONS TO INVESTIGATE WHAT REALLY NEEDS TO BE DONE TO PRESERVE THEM CORRECTLY.
SO WE AS THE CONSERVANCY STAND HERE TO BE YOUR PARTNER, TO WORK WITH YOU GOING FORWARD, AND TO REVITALIZE OUR BRACKENRIDGE PARK, WHICH IS FOR EVERYBODY AND FOR EVERYBODY IN EACH ONE OF YOUR DISTRICTS.
THANK YOU FOR YOUR GUIDANCE AND FOR THIS OPPORTUNITY TO WORK WITH YOU.
>> TREVINO: THANK YOU, MS. BOBBIT.
WE APPRECIATE ALL YOUR HARD WORK AND THE BOARD.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN TREVINO.
I ECHO THOSE SENTIMENTS ABOUT THE PARK AND ITS POTENTIAL.
THERE'S A MOTION AND A SECOND FOR THE BALANCE OF THE CONSENT AGENDA, WHICH IS ALL ITEMS SAVE FOR NO. 27.
[27A. Public hearing and consideration of an Ordinance approving the levy of a Special Assessment for the Downtown Public Improvement District; levying an assessment rate for the Fiscal Year 2019 at $0.15 per $100 value of real property in the Downtown Public Improvement District and $0.09 per $100 value of residential condominiums; and approving the Fiscal Year 2019 Service & Assessment Plan for the Downtown Public Improvement District. 27B. Ordinance authorizing the negotiation and execution of the Second Amended and Restated Contract for Improvements and/or Services in the San Antonio Public Improvement District with Centro Public Improvement District to provide specified services and develop Annual Service and Assessment Plans for the Downtown Public Improvement District for the period ending September 30, 2023.]
MOTION CARRIES.>> ITEM NO. 27 IS APPROVING THE
[00:25:01]
FOLLOWING TWO ORDINANCES RELATED TO THE DOWNTOWN IMPROVEMENT DISTRICT.ITEM A IS THE PUBLIC HEARING AND CONSIDERING OF AN ORDINANCE APPROVING THE LEVY OF A SPECIAL ASSESSMENT FOR THE DOWNTOWN PUBLIC IMPROVEMENT DISTRICT LEVYING AN ASSESSMENT RATE FOR THE FISCAL YEAR 2019 AT 0.15 PER $100 VALUE OF REAL PROPERTY IN THE DOWNTOWN PUBLIC IMPROVEMENT DISTRICT AND 0.09 PER 100-DOLLAR VALUATION OF RESIDENTIAL CONDOMINIUMS, AND APPROVING THE FISCAL YEAR 23019 SERVICE AND ASSESSMENT PLAN FOR THE DOWNTOWN PUBLIC IMPROVEMENT DISTRICT.
ITEM NO. B IS THE ORDINANCE AUTHORIZING THE NEGOTIATION AND EXECUTION OF THE SECOND AMENDED AND RESTARTED CONTRACT FOR IMPROVEMENTS AND/OR SERVICES IN THE SAN ANTONIO PUBLIC IMPROVEMENT DISTRICT WITH CENTRO PUBLIC IMPROVEMENT DISTRICT TO PROVIDE SPECIFIED SERVICES AND DEVELOP ANNUAL SERVICE AND ASSESSMENT PLANS FOR THE DOWNTOWN PUBLIC IMPROVEMENT DISTRICT FOR THE PERIOD ENDING SEPTEMBER 30, 2023.
>> MAYOR NIRENBERG: COUNCILMAN TREVINO.
YOU KNOW, I PULLED THIS TO HIGHLIGHT AND ACKNOWLEDGE THE GREAT WORK OF CENTRO.
THIS IS REALLY ABOUT THE BASICS OF EXECUTING THEIR CORE MISSION, WHICH IS TO PROVIDE A CLEAN AND SAFE DOWNTOWN.
AND JOHN, DO YOU HAVE A PRESENTATION?
>> AGAIN, THIS ITEM IS APPROVAL OF THE DOWNTOWN PUBLIC IMPROVEMENT DISTRICT.
BEFORE I GET STARTED, I WOULD LIKE TO INTRODUCE A COUPLE OF MEMBERS THAT ARE HERE IN THE AUDIENCE TODAY REPRESENTING THE PUBLIC IMPROVEMENT DISTRICT AND CENTRO.
FIRST IS DAVID ADELMAN, CHAIR OF THE PUBLIC IMPROVEMENT DISTRICT.
TRISH DEBERRY, THE CHAIR FOR CENTRO, AND WARREN WILKERSON, EXECUTIVE DIRECTOR FOR CENTRO.
THEY ARE ALL HERE TO SUPPORT THIS ITEM AND AVAILABLE TO ANSWER ANY QUESTIONS OR SPEAK ON BEHALF OF THOSE ORGANIZATIONS.
AGAIN, THE PUBLIC IMPROVEMENT DISTRICT IS THE ITEM BEFORE US TODAY.
THE PUBLIC IMPROVEMENT DISTRICT IS AUTHORIZED THROUGH SEPTEMBER 30, 2023.
IT IS MANAGED BY THE CENTRO PUBLIC IMPROVEMENT DISTRICT OR THE PID.
THIS IS APPROVING THE 2019 ASSESSMENT RATE.
ALSO THE ASSESSMENT RATE IS 15 AND 9 CENTS PER $100 VALUATION FOR COMMERCIAL AND RESIDENTIAL.
AND THEN FINALLY APPROVING THE FISCAL 2019 SERVICE AND ASSESSMENT PLAN, WHICH IS THEIR BUDGET.
THIS IS JUST A MAP SHOWING YOU THE BOUNDARIES OF THE PUBLIC IMPROVEMENT DISTRICT IN WHICH THEY OPERATE, WHICH PRIMARILY ENCOMPASSES THE CORE OF DOWNTOWN SAN ANTONIO.
WE DO GO THROUGH A PROCESS FOR NOTIFICATION OF THOSE INDIVIDUALS THAT ARE WITHIN THE PUBLIC IMPROVEMENT DISTRICT.
ON SEPTEMBER 7 WE MAILED NOTICES TO 746 PROPERTY OWNERS WITHIN THE PUBLIC IMPROVEMENT DISTRICT.
THE PID BOARD APPROVED THE ASSESSMENT PLAN.
ON SEPTEMBER 9 WE PLACED AN ADVERTISEMENT IN THE "SAN ANTONIO EXPRESS NEWS" TO NOTIFY ANY INDIVIDUALS THAT PERHAPS P D NOT RECEIVE A NOTIFICATION.
FOR 2018 ACCOMPLISHMENTS, THIS IS JUST TO HIGHLIGHT SOME OF THE THINGS THAT CENTRO HAS DONE IN THE PAST YEAR.
ONE OF THE BIGGEST IS ALMOST 1.4 MILLION DOWNTOWN VISITORS WERE ASSISTED.
THIS IS THROUGH THE AMBASSADORS THAT YOU SEE DOWNTOWN.
48 MILLION SQUARE FEET OF PRESSURE WASHING, THAT'S PRIMARILY SIDEWALKS IN THE DNA.
AND 990 HOMELESS MANAGEMENT ENTRIES.
SO THEY'RE HAVING A SIGNIFICANT IMPACT ON THE DOWNTOWN AREA, MAKING THAT EXPERIENCE BETTER FOR VISITORS AND PEOPLE THAT WORK AND LIVE IN THE DOWNTOWN AREA.
FOR 2019, THEIR CORE SERVICES INCLUDE CONTINUATION OF CLEAN AND SAFE PLUS LANDSCAPING AND MAINTENANCE.
FOCUSING ON ACTIVATION, PARTICULARLY AROUND HOUSTON STREET AND TRAVIS PARK AND MILAM PARK.
CONTINUING WITH THE AMBASSADOR PROGRAM IN TERMS OF HOSPITALITY.
AND THEN ALSO FOCUSING ON A SPECIAL PROJECT, IS ZONA CULTURAL AREA, AND CONTINUATION OF THAT.
THERE ARE SOME CHANGES THIS YEAR TO THE CONTRACT WITH THE CITY.
REALLY THIS JUST HIGHLIGHTS SOME OF THE BIGGER CONTRACTUAL CHANGES.
WE'RE STRENGTHENING THE REPORTING AND MONITORING FOR THAT CONTRACT.
STREAMLINING REQUESTS FOR PAYMENT.
MOVING TO AN ELECTRONIC PROCESS.
[00:30:03]
BETTER DEFINING THE SCOPE OF SERVICES SO THEY CAN CONCENTRATE ON THOSE CORE SERVICES.IT INCLUDES THE REQUIREMENT FOR BACKGROUND CHECKS FOR EMPLOYEES WHO ARE WORKING WITH THE PUBLIC IMPROVEMENT DOLLARS.
AND THEN, FINALLY, A CHANGE TO THE INSURANCE COVERAGE.
INSTEAD OF A FIDELITY BOND WE'RE REQUIRING A $5 MILLION THIRD PARTY CRIME COVERAGE WAS PART OF THIS CONTRACT.
OWN FACILITIES WITHIN THE DOWNTOWN AREA, WE VOLUNTARILY CONTRIBUTE TO THE PID IN THE AMOUNT OF $272,949.
SO THAT'S INCLUDED IN THEIR BUDGET AS WELL.
FACILITIES SUCH AS THE ONE WE'RE IN.
>> I GET STARTED AT 7:00 AND I END AT 4:00.
HAVE THE SAME ATTITUDE, SAME LOVE IN MY HEART ALL DAY.
I WORK AT THE MUSEUM RIGHT DOWN THE ROAD.
WE APPRECIATE ALL THAT YOU DO.
>> SO THAT CONCLUDES MY PRESENTATION.
AGAIN, I'M AVAILABLE FOR QUESTIONS.
TRISH, DAVID, AND WARREN ARE HERE TODAY.
I APPRECIATE ALL YOUR HARD WORK ON THIS.
I FIRST WANT TO START OFF BY THANKING THE AMBASSADORS.
THAT VIDEO REALLY EXEMPLIFIES THEIR EFFORTS DOWNTOWN.
AS SOMEONE WHO WALKS DOWNTOWN QUITE A BIT THEY REALLY PROVIDE A FRIENDLY FACE FOR ALL OF OUR VISITORS AND FOR THOSE WHO ARE WORKING AND LIVING DOWNTOWN.
THANK YOU FOR ALL THAT YOU DO.
AND I LOOK FORWARD TO JOINING YOU HERE VERY SOON AS A GUEST AMBASSADOR.
I ALSO WANT TO SAY I'M VERY APPRECIATIVE OF THE PARTNERSHIP AND CENTRO'S PARTNERSHIP WITH THE CITY AND DOWNTOWN STAKEHOLDERS IS A STRONG ONE.
IT REMAINS A VERY MEANINGFUL CONNECTION TO OUR CITY.
AND I ESPECIALLY WOULD LIKE TO ACKNOWLEDGE THAT IT'S BEEN A GREAT PLEASURE TO WORK WITH WARREN WILKINSON ON SOME GREAT INITIATIVES AND LOOK FORWARD TO SOME INNOVATIVE THINGS THAT ARE TO COME.
THANK YOU SO MUCH FOR ALL YOUR HARD WORK, WARREN.
I ALSO WANT TO ACKNOWLEDGE TRISH DEBERRY AND DAVID ADELMAN.
FOR ALL THEIR HARD WORK TO REALLY, REALLY HIGHLIGHT THE IMPORTANCE OF CENTRO MEANS NOT JUST TO DOWNTOWN, BUT EVERYBODY HERE IN THE CITY WHO VISITS DOWNTOWN.
THANK YOU TO ALL THE EMPLOYEES OF CENTRO.
IT IS AT THIS MOMENT THAT I WOULD LIKE TO PROUDLY MOTION TO APPROVE THIS ITEM.
THERE IS A MOTION AND A SECOND FOR APPROVAL OF ITEM NO. 27.
ITEM 27A IS THE PUBLIC HEARING.
SO I WILL NOW -- IT'S 9:45 A.M.
THE PUBLIC HEARING ON THE CENTRO PID 27A IS HEREBY OPEN.
I'LL BEGIN BY CALLING THOSE MEMBERS OF THE PUBLIC WHO WISH TO SPEAK ON THIS ITEM.
PLEASE CONTAIN YOUR COMMENTS TO THAT ITEM ALONE.
THEN WE'LL MOVE ON TO ACTION FROM THE COUNCIL.
WE'LL START WITH LEE TALMANTEZ.
[00:35:05]
>> GOOD MORNING, MAYOR NIRENBERG, COUNCIL MEMBERS, CITY MANAGER, AND STAFF.
MY NAME IS LEE TALMANTEZ, I'M THE GENERAL MANAGER FOR GO RIO.
ON BEHALF OF HOPE ANDRADE, LISA WONG AND THE ENTIRE GO RIO TEAM I WOULD LIKE TO SHARE WITH YOU HOW PROUD AND GRATEFUL WE ARE FOR THE GREAT WORKING RELATIONSHIP WE HAVE WITH CENTRO SAN ANTONIO.
CENTRO PROVIDES SERVICES WHICH ENHANCE OUR VISITORS' EXPERIENCE AND PROVIDES THEM REASON TO RECOMMEND OUR BEAUTIFUL CITY TO THEIR FAMILY AND FRIENDS.
THE BEAUTIFICATION SERVICES PROVIDED BY CENTRO STAFF FOR OUR RIVER WALK ARE EXCEPTIONAL.
OUR VISITORS OFTEN COMMENT ON THE BEAUTY OF THE RIVER WALK AND AT TIMES SURPRISED ON HOW CLEAN AND WELL MAINTAINED IT IS WITH MANY VISITORS IN ATTENDANCE.
THEY ALSO MADE COMMENTS OF CENTRO'S AMBASSADORS IN REGARDS TO THE ASSISTANCE THEY PROVIDE.
NO DOUBT THEIR SERVICES MAKE OUR VISITORS FEEL TRULY WELCOME TO OUR CITY.
GO RIO APPRECIATES THE WORKING RELATIONSHIP WE HAVE WITH CENTRO AND ARE IMPRESSED WITH THEIR QUICK RESPONSE WE RECEIVE WHEN WE CALL UPON THEM.
ONE EXAMPLE WAS DURING THE FINAL FOUR AND SPRING BREAK.
WE EXPERIENCED RECORD-BREAKING VISITORS, NUMBER OF VISITORS.
WE WERE ALSO EXCITED AND WORKING HARD TO SHOWCASE OUR RIVER WALK.
IN THE MIDDLE OF THIS WE FOUND OURSELVES NEEDING MORE OF CENTRO'S ASSISTANCE.
WE DESPERATELY PLACED ONE CALL TO A MICHAEL PACHECKO AND HE ASSURED US HELP WAS ON THE WAY.
ADDITIONAL TRASH CONTAINERS WERE BROUGHT IN, CREW MEMBERS WERE SENT OVER TO SWEEP AREAS THAT NEEDED IT.
IT WAS OBVIOUS THAT WE HAD A PARTNER WITH US WHOM SHARED OUR COMMITMENT TO PROVIDE THE MOST POSITIVE IMAGE OF ALL THOSE VISITING OUR CITY, ESPECIALLY OUR RIVER WALK.
THANK YOU FOR YOUR CONTINUED SUPPORT FOR CENTRO SAN ANTONIO.
CENTRO'S CREW MEMBERS, JENNIFER, MIGUEL VILLAREAL, AND GREGORY VALDEZ.
GO RIO APPRECIATES ALL YOU DO FOR OUR BEAUTIFUL RIVER WALK.
LISA AND HOPE WOULD ALSO LIKE TO ACKNOWLEDGE TRISH DEBERRY'S LEADERSHIP AND THANK HER FOR HER SUPPORT.
>> MAYOR NIRENBERG: THANK YOU.
MR. MCCANN WILL BE FOLLOWED BY SUE [INDISCERNIBLE].
>> GOOD MORNING, MAYOR AND COUNCIL.
THANK YOU FOR THIS OPPORTUNITY.
I AM AN OFFICER WITH THE SAN ANTONIO POLICE DEPARTMENT AND I AM A MEMBER OF THE HOPE TEAM.
WE ARE THE POLICE DEPARTMENT'S OUTREACH TO THE HOMELESS AND SPECIFICALLY DOWNTOWN.
I HAVE BEEN DOWNTOWN ON BICYCLE PATROL FOR 15 YEARS AND WE HAVE BEEN DOING THE HOPE TEAM FOR THREE YEARS NOW.
AND JUST WANTED TO SHARE THAT THE POLICE DEPARTMENT AND THE OFFICERS DOWNTOWN WORK HAND IN HAND WITH CENTRO ALL THIS TIME.
IT'S BEEN A VERY STRONG PARTNERSHIP AND IT'S WORKED OUT VERY WELL ON BOTH SIDES.
WHEN THEY HAVE ISSUES, THEY'RE ABLE TO CALL US.
AND WHEN WE FIND ISSUES WE'RE ABLE TO CALL THEM.
AND JUST THAT RELATIONSHIP HAS WORKED VERY WELL FOR THE SAN ANTONIO COMMUNITY AS A WHOLE, BUT SPECIFICALLY FOR THE DOWNTOWN AREA.
>> MAYOR NIRENBERG: THANK YOU, MR. MCCANN.
>> GOOD MORNING, MAYOR, CITY COUNCIL, CITY MANAGER, AND STAFF.
I SERVE IN INSTITUTIONAL ADVANCEMENT FOR A 20-YEAR-OLD NONPROFIT PERFORMING ARTS COMPANY CALLED MUSICAL BRIDGES AROUND THE WORLD.
OUR MISSION IS TO UNITE, EDUCATE, AND INSPIRE THROUGH CULTURALLY DIVERSE PERFORMING ARTS PROGRAMMING OF THE HIGHEST CALIBER.
IN 1997 A RUSSIAN PIANIST EMIGRATED TO THE UNITED STATES AND WAS HAVING A CONCERT.
FATHER DAVID GARCIA ATTENDED THIS CONCERT AND SAID CAN WE DO SOMETHING LIKE WE HAVE IN MEXICO CITY, PRAGUE, PARIS WHERE PEOPLE CAN WALK IN OFF THE STREET INTO A GREAT HISTORIC SPACE AND EXPERIENCE THE BEST OF THE BEST AND BE INSPIRED AND TRANSFORMED IN A SACRED SPACE? THE NEXT YEAR, 1998 BEGAN THE CORNERSTONE OF OUR PROGRAMMING, MUSICAL EVENINGS AT SAN FERNANDO CATHEDRAL.
I ALSO SERVE AS THE ARTS AND CULTURAL CHAIR WE BEGAN CELEBRATING THE DEWALLI
[00:40:02]
FESTIVAL.PEOPLE FROM ALL OVER THE COUNTRY, 17,000 STRONG, TRAVEL TO OUR CITY CENTER TO CELEBRATE THE INDIAN FESTIVAL OF LIGHTS.
PEOPLE WHO DON'T KNOW ABOUT INDIAN CULTURE GET TO EXPERIENCE THE DANCE, CULTURE, AND CUISINE.
ALL THESE THINGS ARE MADE POSSIBLE BECAUSE WE HAVE A VIBRANT URBAN CORE.
THE PUSH THAT HAS BEEN MADE TO REALIZE THIS FOR DOWNTOWN RESIDENCY, FOR DOWNTOWN BUSINESSES, FOR DOWNTOWN CULTURE ARE NOW VISIBLE.
I WAS AWAY FOR A DECADE AND NOW I SEE IT REALLY COMING TO LIFE.
IT'S THANKS TO ORGANIZATIONS LIKE CENTRO THAT DO MOVE DOWNTOWN.
AND IT'S NOT JUST THE FOOT SOLDIERS, THE AMBASSADORS IN YELLOW THAT WE SEE ON THE STREET THAT ARE POLISHING, CLEANING, GUIDING VISITORS, BUT IT'S THE BEHIND THE SCENES AUDIO] THAT ARE BRINGING BUSINESS OWNERS AND LEADERS OF NONPROFITS AS COLLABORATORS TOGETHER TO MAKE SAN ANTONIO THE VIBRANT CITY THAT IT DESERVES TO BE.
WE'RE NOT LIMITED BY GEOGRAPHY.
WE CONTINUE TO HAVE AN URBAN SPRAWL.
AND THAT HAS A DANGER OF DILUTION.
SO IT'S SO IMPORTANT THAT WE MAINTAIN THE ENERGY AND MOMENTUM OF KEEPING THE ACTIVITY DOWNTOWN, THE ENERGY, AND THE LIVING SPACE.
SO I SUPPORT, WE AS AN ORGANIZATION SUPPORT, AND WE THANK YOU FOR CONTINUING TO SUPPORT THE WORK OF CENTRO.
>> MAYOR NIRENBERG: CENTRO AMBASSADORS.
YOU WILL BE FOLLOWED BY KENNY WILSON.
>> MORNING, MAYOR, COUNCIL MEMBERS.
I GRADUATED WITH AN ASSOCIATES IN BUSINESS ADMINISTRATION.
I HOPE TO HAVE ENTREPRENEURSHIP OR BE A BUSINESS OWNER HERE.
CURRENTLY I'M WORKING ON AN INSTRUMENT.
SO KEEP AN EYE OUT IN THE FUTURE FOR THAT.
JUST A FEW YEARS AGO I WOULDN'T HAVE BEEN COMFORTABLE SHARING SO MUCH ABOUT MY LIFE WITH OTHERS.
WORKING AT CENTRO HELPED ME COME OUT OF MY SHELL AFTER I MOVED FROM THE VALLEY IN MCALLEN TO HEAR.
I FEEL CLOSER TO THE AMBASSADOR TEAM MEMBERS AS I SEE THEM AS ANOTHER FAMILY.
I MET LIKE A LOT OF PEOPLE FROM EVERYWHERE AND THAT KIND OF HELPED ME.
THE WORK OUR TEAM MAKES DOWNTOWN CLEAN, SAFE, AND FRIENDLY.
AND THAT'S WHAT SETS OUR DOWNTOWN FROM OTHERS.
WE HOPE EVERYBODY COMES VISITS US FROM EVERYWHERE.
I BELIEVE THAT HAVING THOSE FRIENDLY FACES AND THOSE CLEAN STREETS MAKES A DIFFERENCE IN OUR DOWNTOWN EXPERIENCE.
I APPRECIATE THE OPPORTUNITY TO COME UP HERE AND SHARE A LITTLE BIT ABOUT MYSELF AND FOR CONSIDERATION AT OF THE CENTRO SERVICE.
>> GOOD MORNING, MR. MAYOR, MEMBERS OF CITY COUNCIL.
I AM A CENTRO SAN ANTONIO PUBLIC SERVICE REPRESENTATIVE AMBASSADOR.
I WAS BORN AT THE NIX HOSPITAL AND ADOPTED FROM ST. PETERS ST. GEORGE ORPHANAGE.
SOME PEOPLE KNOW ME FOR MY WORK INTERPRETING THE WHITE SHAMAN MURAL, A PIECE OF ROCK ART NEAR DEL RIO, TEXAS.
IF YOU VISITED THE WITTE MUSEUM IN RECENT YEARS, CHANCES ARE YOU HEARD MY NARRATION IN THE PEOPLE OF THE PECOS EXHIBIT.
I BRING THIS UP TO DEMONSTRATE A CONNECTION.
WHEN A NATIVE SAN ANTONIO OR VISITOR ASKS ME FOR DIRECTION TO THE NATURAL HISTORY MUSEUM, THEY COULD BE HAVING A CONVERSATION WITH MYSELF ONE MOMENT AND IN THE NEXT LISTEN TO MY VOICE SHOWCASING MY PEOPLE IN THIS REGION.
THAT KIND OF CONNECTION IS PURO SAN ANTONIO AND IT'S IMPORTANT TO ME.
I CONFESS I BECAME AN AMBASSADOR TO PUT MY EAR TO THE GROUND AND HEAR WHAT PEOPLE THOUGHT OF THE CITY AND SHARE THE UNWRITTEN HISTORY OF SAN ANTONIO.
IT'S BEEN REWARDING IN WAYS YOU CANNOT MEASURE.
I'VE COME TO REALIZE THAT THE AMBASSADOR TEAM IS THE INFRASTRUCTURE ON TOP OF THE INFRASTRUCTURE.
THAT'S HOW VITAL THESE SERVICES
[00:45:02]
ARE TO THIS CITY.IT IS NOT JUST OUR MAINTENANCE WORK, WHICH IS IMPORTANT.
IT'S ALSO THAT WE SERVE THE CONNECTION FOR THE HOMELESS POPULATION AND THE RESOURCES THAT THEY NEED.
THAT WE SERVE AS A CONNECTION TO THE VISITORS OF SAN ANTONIO AND THE SERVICES THEY NEED.
THAT WE SERVE AS A CONNECTION FOR NATIVE SAN ANTONIANS TO DISCOVER THEIR OWN CITY.
THIS CITY IS ALL ABOUT CONNECTIONS.
AS A SAN ANTONIO NATIVE WITH MANY TIES TO THE CITY I WANT TO EXPRESS MY APPRECIATION FOR YOUR CONSIDERATION OF THE SERVICE AND ASSESSMENT PLAN.
AND I ENCOURAGE YOU TO APPROVE IT.
THIS ALLOWS US TO CONTINUE TO BE A VITAL CONNECTION IN THE HEART OF OUR CITY.
>> MAYOR NIRENBERG: THANK YOU ALL VERY MUCH.
KENNY WILSON FOLLOWED BY DAVID ADELMAN.
>> MORNING, MAYOR AND COUNCIL MEMBERS, MANAGER SCULLEY.
AND I WANT TO SHARE WITH YOU THAT WE HAVE A VERY UNIQUE RELATIONSHIP WITH CENTRO.
ALL OF YOU KNOW WHAT GOES ON IN SAN ANTONIO IS GOOD.
IT'S A RESULT OF THE COLLABORATION AND WORKING TOGETHER.
THAT'S THE CASE FOR HAVEN FOR HOPE AND CENTRO.
I'M THE PRESIDENT AND C.E.O. FOR HAVEN FOR HOPE AND HAVE WATCHED THIS RELATIONSHIP WITH CENTRO GROW.
WE HAVE A TEAM OF PROFESSIONAL PEOPLE THAT KNOW HOW TO ENGAGE THE HOMELESS UNDER BRIDGES IN THE WOODS.
WE WORK CLOSELY WITH THE CITY ON THOSE PROGRAMS. OUR RELATIONSHIP WITH CENTRO DEVELOPED TO WHERE WE HAVE TWO AND A HALF FULL-TIME PEOPLE THAT THESE ARE PROFESSIONAL, CAPABILITY, GIFTED OUTREACH WORKERS THAT WORK EVERY DAY IN DOWNTOWN RECRUITING PEOPLE TO COME TO HAVEN FOR HOPE, GIVING THEM HELP, WORK CLOSELY WITH OFFICER MCCANN.
AND IT HELPS PROTECT THE BEAUTY AND ENJOYMENT OF DOWNTOWN.
AS YOU KNOW, IT HELPS PEOPLE TOO.
ANOTHER BENEFIT OF OUR RELATIONSHIP WITH CENTRO IS THAT SINCE I THINK ABOUT 2011, CENTRO HAS HIRED OVER 100 -- ABOUT 130 INDIVIDUALS FROM THE HAVEN CAMPUS.
IT'S THAT FIRST TIME TO GET A JOB AFTER THE CAMPUS.
AND RIGHT NOW CENTRO HAS 32 FULL-TIME EMPLOYEES THAT CAME FROM HAVEN FOR HOPE.
LAST WEEK I WAS STANDING ON THE CAMPUS.
A MAN WAS GIDDY ABOUT THE JOB HE RECEIVED.
HE WAS GOING TO WORK FOR CENTRO.
WE'RE PROUD TO PARTNER WITH THEM.
IT'S AN EXCELLENT RELATIONSHIP.
WE THINK THE WORK IS IMPORTANT.
OUR OUTREACH WORK IS FOCUSED ON DOWNTOWN THROUGH CENTRO SAN ANTONIO.
>> MAYOR NIRENBERG: THANK YOU, MR. WILSON.
DAVID ADELMAN FOLLOWED BY CHRIS KELLER.
>> THANK YOU, CITY COUNCIL AND STAFF, TEAM.
I JUST WANT TO SAY THAT AS THE CHAIR OF THE PID BOARD, I HAVE THE OPPORTUNITY TO TALK TO A LOT OF PROPERTY OWNERS FROM TIME TO TIME.
AND AS YOU ALL KNOW, AND I HOPE THE CITY KNOWS, IT'S A VOLUNTARY ASSESSMENT THAT THE PROPERTY OWNERS MANY YEARS AGO OR MULTIPLE YEARS AGO HAD AGREED TO SELF-ASSESS.
SO THE MONEY COMES FROM THE PROPERTY OWNERS AS AN ADDITIONAL ASSESSMENT TO THEIR BASE PROPERTY TAXES.
AND IN MY TIME SERVING ON THE PID BOARD AND NOW AS THE CHAIR OF THE BOARD I HAVEN'T HAD A SINGLE NEGATIVE COMPLAINT OVER THE ENTIRE TERM OF SERVICE FROM ANY OTHER PROPERTY OWNER.
IN FACT, EVERY PROPERTY OWNER IS SATISFIED AND HAPPY, ALL THE PROPERTY OWNERS I'VE TALKED TO.
YOU HEARD SOME OF THE GREAT WORK WE'RE DOING.
THERE'S MORE WORK EVEN THAN THAT.
BUT I APPRECIATE THE OPPORTUNITY TO HELP MY FELLOW PROPERTY OWNERS AND CONTRIBUTE TO THE VITALITY AND THE BENEFIT OF THIS CITY AS A WHOLE.
>> MAYOR NIRENBERG: THANK YOU, MR. ADELMAN.
MY NAME IS CHRIS KELLER AND I CAME DOWN TO, I GUESS, VENT ABOUT THAT PID TAX THAT I PAY DOWNTOWN.
TWICE NOW I'VE HEARD SOMEBODY SAY THAT IT'S A VOLUNTARY PAYMENT.
WEL, I WAS TOLD THAT IT'S NOT VOLUNTARY.
BUT MY BIGGEST COMPLAINT IS LAST TIME I CAME DOWN AND I COMPLAINED ABOUT IT -- AND IT'S THE SAME COMPLAINT THAT I'M RIGHT ON THE EDGE OF SOUTH ST.
MARY'S AND CESAR CHAVEZ STREET.
THERE'S A PARKING LOT ON EACH SIDE OF ME.
TO THE BEST OF MY KNOWLEDGE AND
[00:50:03]
EVERY TIME I'VE ASKED A TENANT, MY SIDEWALK DOESN'T GET CLEANED.NOBODY COMES AND POWER WASHES THE SIDEWALK IN FRONT OF MY BUILDING.
WHAT REALLY GOT ME, THOUGH, ABOUT THREE MONTHS AGO SOMEBODY WENT TO THE BATHROOM RIGHT IN THE DOORWAY OF MY BUILDING THAT LEADS TO THE UPSTAIRS FOUR APARTMENTS THAT ARE THERE.
FOR TWO DAYS MY WIFE AND I FIELDED COMPLAINT AFTER COMPLAINT AFTER COMPLAINT.
WHO IS GOING TO CLEAN THIS UP? COME CLEAN THIS UP? FINALLY, I WENT AND CLEANED IT UP MYSELF.
THEY DO NOT GO IN FRONT OF MY BUILDING.
WHAT I WANT TO GO ON RECORD TODAY TOO TO SAY I BELIEVE THAT THERE'S A 12-STORY APARTMENT COMPLEX GOING UP RIGHT NEXT TO ME IN THE PARKING LOT THAT'S THERE.
IT'S ALSO MY BELIEF THAT THAT APARTMENT COMPLEX WILL NOT PAY THIS TAX.
I'M GOING ON RECORD SAYING THAT'S WHAT I'VE HEARD.
IF THIS PROJECT COMES TO FRUITION AND THE APARTMENT BUILDING DOES NOT PAY THE TAX, I FEEL LIKE I SHOULD BE EXEMPT FROM IT TOO.
REDRAW THE LINES TO WHERE MY PROPERTY IS NOT INSIDE THE LINE, WHICH CONVENIENTLY THE PROPERTY RIGHT ACROSS THE STREET FROM ME, THEY'RE NOT IN THE LINE.
WHO DREW THE LINE? HOW COME I'M IN AND THEY'RE NOT? I'M GOING TO SPEAK TO THE GENTLEMAN THAT JUST SPOKE HERE THOUGH, BECAUSE WE GET ZERO BENEFIT FROM THEM.
I'M POSITIVE THEY DO GOOD WORK BUT I THINK IT'S CONCENTRATED MORE TOWARD THE RIVER AREA OF DOWNTOWN.
>> MAYOR NIRENBERG: THANK YOU, MR. KELLER.
THE PUBLIC HEARING REGARDING THE CENTRO PID IS HEREBY CLOSED.
THAT'S EVERYONE WHO SIGNED UP.
WE DO HAVE COUNCIL MEMBERS NOW WHO WOULD LIKE TO MAKE COMMENT.
WE'LL START WITH COUNCILWOMAN VIAGRAN.
THANK YOU FOR THE PRESENTATION, JOHN.
I DO HAVE A COUPLE OF QUESTIONS.
I THINK IT'S -- THANK YOU, COUNCILMAN TREVINO FOR PULLING THIS.
BECAUSE I THINK IT'S IMPORTANT TO HIGHLIGHT THE WORK THAT'S BEING DONE.
BUT I THINK IT'S ALSO IMPORTANT TO HIGHLIGHT THE ACCOUNTABILITY AND THE RESPONSIBILITY, THE STEPS THAT HAVE BEEN TAKEN SINCE THE INCIDENT HAPPENED OVER A YEAR AGO.
SO YOU MENTIONED IN YOUR COMMENTS, JOHN, THAT THERE'S NOW GOING TO BE BACKGROUND CHECKS.
BUT YOU SAID THAT BACKGROUND CHECKS FOR EMPLOYEES.
BUT IN YOUR COMMENTS YOU MENTIONED FOR THE CITY'S PORTION OF THE PID.
BUT YOU MEAN FOR THE ENTIRE THING NOW?
>> THE CENTRO PARTNERSHIP RECEIVES FUNDING FROM SEVERAL SOURCES.
ONE OF THEM IS THE PUBLIC IMPROVEMENT DISTRICT.
CONTRACTUALLY OUR CONTRACT IS REGARDING THOSE PID DOLLARS THAT ARE ASSESSED.
WE CANNOT CONTRACTUALLY REQUIRE THEM TO DO THINGS OUTSIDE OF THE FUNDING THAT COMES FROM THE PID.
SO CONTRACTUALLY ANYBODY THAT IS ESSENTIALLY HANDLING PUBLIC IMPROVEMENT DISTRICT DOLLARS HAS TO HAVE THAT BACKGROUND CHECK.
>> VIAGRAN: IF WARREN OR TRISH CAN ANSWER THE QUESTION.
IS THAT NOW A STANDARD OPERATING PRACTICE YOU ARE NOW DOING ADMINISTRATIVELY AT CENTRO, NOT JUST WITH THE CITY DOLLARS BUT ALL OF THEM.
ALL THE EMPLOYEES, INCLUDING MYSELF, HAVE BACKGROUND CHECKS.
>> VIAGRAN: GOOD TO HEAR THAT.
SOME OTHER QUESTIONS I DID HAVE WAS ABOUT THE DOLLARS WITH THE ACTIVATION.
AND I WANT TO THANK SO MUCH GARY AND MIGUEL FOR COMING UP AND FOR SHARING.
AND I THINK THAT'S EXTREMELY IMPORTANT TO SHARE YOUR STORIES.
AND THANK YOU FOR BEING GREAT AMBASSADORS TO EVERYONE IN THE CITY OF SAN ANTONIO.
AND I KNOW I'VE GONE TO SOME AMBASSADORS MYSELF WITH HELP ABOUT FINDING OUT WHAT'S GOING ON DOWN HERE.
BECAUSE I MAY NOT KNOW AN EVENT IS TAKING PLACE.
ON THE ACTIVATION, WHAT ARE THE DOLLAR AMOUNTS FOR THE ACTIVATION AND THE HOSPITALITY AND ZONA CULTURAL, THE BREAKDOWN OF MONEYS THERE?
>> SPECIFICALLY TO ZONA CULTURAL, THERE IS $100,000 IN THE BUDGET.
IT'S THE BUDGET WE PROVIDED TO YOU.
FOR THE ACTIVATION, IN ORDER TO STREAMLINE THE PROCESSING OF INVOICES, WHICH WAS A BIT CUMBERSOME, TO SAY THE LEAST, WE
[00:55:03]
HAVE STREAMLINED THE NUMBER OF ELEMENTS THAT WE ASKED FOR REIMBURSEMENT.ONE OF THEM INCLUDES MARKETING, THE ACTIVATIONS, THE PROMOTIONS.
ALL OF THAT IS INTO ONE AREA, WHICH IS SEPARATE FROM THE AREA OF THE CORE SERVICES, THE AMBASSADORS, HAVEN FOR HOPE, THE POLICE DEPARTMENT THAT WE ENGAGE.
AND I DON'T HAVE THE SPECIFICS OF EACH ITEM.
WE DO THE POP-UPS ON HOUSTON STREET.
THIS FISCAL YEAR WE DID EIGHT.
THEY COST ABOUT $5,000, $6,000 PER POP-UP.
SO WE HAVE A BUNCH OF LINE ITEMS THAT I DON'T KNOW THE DETAILS OF EACH ONE AT THIS POINT.
I DON'T HAVE THEM IN FRONT OF ME.
THAT ALSO INCLUDES THE MANAGEMENT, WHICH IS OUR RENT AND SALARIES.
WHILE I'M UP HERE, I WOULD LIKE TO RECOGNIZE MICHAEL, WHO IS STANDING UP WITH THE CAMERA.
AND HE'S THE ONE THAT PRODUCED THAT VIDEO BY HIMSELF.
HE'S ALSO THE AUTHOR OF THE HUMANS OF SAN ANTONIO BOOK, IF YOU HAVEN'T SEEN THAT.
SO, JOHN, IF YOU COULD PLEASE, HOW MUCH IS THE PORTION OF THE CITY'S DOLLARS FOR THE 1.5?
>> SO THE CITY CONTRIBUTES ABOUT $250,000 CONTRACTUALLY, BASED ON THE BUILDINGS WE OWN DOWNTOWN.
>> VIAGRAN: THAT'S FOR ALL OF THIS?
>> VIAGRAN: WE'RE TALKING ABOUT OUR PORTION, WHICH IS $279,000.
>> THAT'S THROUGH THE CONTRACT WE CONTRIBUTE THAT MUCH.
>> VIAGRAN: THE CPS DOLLARS -- WELL, THE CPS CONTRIBUTES INTO THE SAME PID?
IT TOTALS ABOUT $500,000 BETWEEN THE THREE ENTITIES.
>> VIAGRAN: THAT HELPS WITH CLARIFICATION.
I WANT TO THANK YOU FOR THE IMPACT FOR THE AMBASSADORS AND THE ACTIVATION.
SUE, YOU PUT IT VERY, VERY WELL THAT WE HAVE TO COME BACK INTO THE CENTRO.
THAT'S WHAT I LOVE ABOUT THE WORD CENTRO.
IF YOU TRAVEL INTERNATIONALLY, ESPECIALLY IN DIFFERENT MAJOR CITIES, THEY CALL IT CENTRO.
AND SO THAT'S WHY I REALLY APPRECIATE HAVING THAT CROSSES ANY KIND OF CULTURAL OR MAJOR CITY LINES.
ONE OF THE THINGS I WANTED TO ALSO -- I DON'T KNOW IF LORI IS HERE.
MAYBE JOHN OR MAYBE SHERYL YOU CAN TALK ABOUT THIS A LITTLE BIT AS WE HAD THE EXCITING ANNOUNCEMENT ABOUT UTSA AND WHAT'S HAPPENING WITH UTSA DOWNTOWN AND HOW IT'S GOING TO BE TRANSFORMATIONAL, LONG OVERDUE, I THINK.
AND THE PART THAT CENTRO WOULD BE PLAYING OR WITH OUR PID OR NOT WITH THIS WHOLE CONNECTION, OR THE WHOLE REVITALIZATION THAT'S HAPPENING.
>> SCULLEY: COUNCILWOMAN, YOU'RE RIGHT.
EVERYONE IS VERY EXCITED ABOUT THE UTSA ANNOUNCEMENT WITH EXPANSION OF 10,000 STUDENTS TO THE DOWNTOWN AREA AS THEY EXPAND THEIR CAMPUS.
THIS IS SOMETHING THAT WE ARE TALKING ABOUT IN PARTNERSHIP WITH CENTRO AND ALL OF THE DOWNTOWN COMMUNITY.
BECAUSE WE WANT TO CREATE CONNECTIVITY AND LINKAGES ON BOTH SIDES OF THE FREEWAY AND TO THE ENTIRE DOWNTOWN.
AS YOU KNOW, ABOUT $80 MILLION WAS INCLUDED IN THE VOTER-APPROVED 2017 BOND PROGRAM FOR INFRASTRUCTURE IMPROVEMENTS IN THE ZONA CULTURAL AREA.
SO WE'LL BE WORKING ON THOSE DESIGN ISSUES.
IN FACT, THE URBAN LAND INSTITUTE IS WORKING WITH DR. AMY AND WITH THE CITY ON THOSE DESIGN COMPONENTS SO THAT WE CAN PRESERVE THE HISTORY AND CULTURE IN THE WEST PART OF DOWNTOWN AND CREATE THAT CONNECTIVITY OF THE CAMPUS AS IT EXPANDS TO THE EAST AND THE WEST.
SO WE'RE VERY EXCITED THAT CENTRO WAS A PART OF THIS ENDEAVOR TO HELP UTSA EXPAND IN OUR DOWNTOWN AREA.
IT ALSO DEMONSTRATES IS HOW NOT ONLY HOW THE DOWNTOWN PID AND ALL THE OWNERS IN THE AREA ARE PART OF IT AND THE COLLABORATION THAT IT TAKES, BUT ALSO THE COLLABORATION THAT IT TAKES -- IT'S TAKING EVEN WITH THE UTSA REVITALIZATION IN THE DOWNTOWN CAMPUS.
AND TALKING ABOUT ZONA CULTURAL AND HOW HAPPY I AM THAT CENTRO WAS ONE OF THE LEAD ROLES ON THAT, IF NOT THE LEAD ROLE IN MAKING SURE WE HAD THAT DESIGNATION.
I WANT TO MAKE SURE THAT WHEN WE USE THESE DOLLARS FOR ZONA CULTURAL THAT WE NEED TO ENSURE
[01:00:01]
THAT THE FABRIC AND THE CULTURAL IDENTITY OF MARKET SQUARE REMAINS IN THAT AREA.AND THAT SOCIAL REGEARING DOES NOT TAKE PLACE AND THE NEIGHBORHOOD AND THE NEIGHBORS THAT MAKE THAT AREA AND OUR ENTIRE AREA UNIQUE AND AUTHENTIC REMAINS.
THAT'S SOMETHING VERY, VERY IMPORTANT FOR ME.
BECAUSE MR. KELLER WHO CAME UP AND SPOKE.
AND JUST FOR ME TO UNDERSTAND.
IF SOMEBODY HAS AN ISSUE WITH SOMETHING THAT NEEDS TO HAPPEN AND THEY ARE PART OF THE CENTRO PID, WHO DO THEY CALL? DO THEY CALL YOUR OFFICE IF SOMETHING GOES ON OR THEY NEED HELP WITH THEIR BUSINESS? WHO ARE THEY -- WHO DO THEY CALL?
>> THEY CALL OUR OPERATIONS ON 219 TRAVIS.
THEY GET A LOT OF CALLS ON A REGULAR BASIS.
AS YOU HEARD EARLIER, SOMETIMES THE POLICE DEPARTMENT, IF THEY SEE SOMETHING THAT'S NOT REALLY A LAW ENFORCEMENT, THEY KNOW HOW TO CONTACT CENTRO OFFICE.
THANK YOU FOR THAT CLARIFICATION.
>> MAYOR NIRENBERG: THANK YOU, COUNCILWOMAN VIAGRAN.
I HAD THE GREAT HONOR AND PRIVILEGE TO SPEND A MORNING OUT WORKING DOWNTOWN WITH CENTRO.
AND I REALLY APPRECIATED MY EXPERIENCE.
AND I'M A MAN OF MY WORD BECAUSE THERE WAS AN INDIVIDUAL THAT I WORKED WITH WHO I ADMIRE SO MUCH.
AND SHE'S CHEESING RIGHT NOW BECAUSE I TOLD HER I WAS GOING TO CALL HER OUT.
[LAUGHTER] NOT ONLY DOES SHE HAVE A GREAT HEART, SHE MAINTAINED A PROFESSIONAL DEMEANOR, A WELCOMING DEMEANOR.
WHEN I WAS CLEANING ONE OF THE LIGHT POLES SHE MADE A COUPLE OF COMMENTS WHILE I CLEANED THAT POLE.
BUT IT WAS ALL IN FUN AND WE HAD A GREAT TIME.
AND SO I JUST WANT TO ACKNOWLEDGE ONE OF THE AMBASSADOR.
MARIA, IF YOU DON'T MIND STANDING UP, PLEASE? [APPLAUSE]
>> SHAW: WHEN I WENT DOWN TO CENTRO TO WORK THAT MORNING WE WERE STRANGERS.
BUT NOW WHEN WE SEE EACH OTHER I FEEL LIKE WE'RE BEST FRIENDS.
BECAUSE WE HAD A GREAT CONVERSATION.
SHE TAUGHT ME SO MUCH ABOUT SAN ANTONIO AND ABOUT MYSELF.
I JUST WANTED TO ACKNOWLEDGE YOU.
THANK YOU FOR ALL YOU DO AND CONTINUE THE GREAT WORK.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN SHAW.
AND, YES, IT'S GREAT TO SEE THE ACTIVITIES DOWNTOWN AND WHAT'S GOING ON WITH CENTRO.
A LOT OF -- AND IT'S NOT JUST ABOUT KEEPING THE DOWNTOWN CLEAN.
IT'S A LOT OF OTHER ACTIVITIES THAT ARE BEING PUT ON BY CENTRO.
GREAT THINGS THAT Y'ALL ARE DOING FOR SAN ANTONIO.
BUT I DO HAVE A COUPLE OF QUESTIONS.
JOHN, IF YOU HAVE JUST A MINUTE HERE.
>> I'M HERE ALL DAY IF YOU NEED ME.
>> PERRY: WITH THIS TAX RATE IS THIS THE SAME OR IS THERE AN INCREASE?
>> THE ASSESSMENT RATE IS THE SAME.
WHEN IS THE LAST TIME IT WAS INCREASED?
>> I BELIEVE -- I HAVE TO LOOK BACK, BUT I WANT TO SAY TWO YEARS AGO.
WE HAD A SLIGHT INCREASE IN THE ASSESSMENT RATE BY, I THINK IT WAS A CENT OR TWO.
I CAN'T RECALL EXACTLY HOW MUCH THAT WAS.
>> PERRY: BUT THIS RATE IS THE SAME AS LAST YEAR.
THERE SEEMS TO BE A LITTLE CONFUSION WHETHER THIS IS VOLUNTARY OR NOT.
SO THIS IS ACTUALLY GOVERNED BY STATE STATUTE.
THE STATE ALLOWS PROPERTY OWNERS TO BASICALLY PETITION THE CITY REQUESTING TO CREATE A PUBLIC IMPROVEMENT DISTRICT.
IT REQUIRES 51%, SO A MAJORITY OF THE PROPERTY OWNERS HAVE TO SIGN THAT PETITION AND THEN PRESENT THAT TO THE CITY.
SO IT'S THROUGH THAT LEGISLATIVE PROCESS THAT THE STATE ALLOWS THE CREATION OF A PUBLIC IMPROVEMENT DISTRICT TO BE CREATED.
WE, THE CITY, CANNOT CREATE A PUBLIC IMPROVEMENT DISTRICT.
IT MUST COME THROUGH PETITION FROM THE PROPERTY OWNERS.
>> PERRY: AND WHAT WAS THE PERCENTAGE? I MEAN, YOU SAID IT TAKES 51% TO APPROVE IT.
WHAT WAS THE PERCENTAGE THAT APPROVED THIS PID?
>> I DON'T HAVE THAT FIGURE WITH ME BUT I CAN GET THAT FOR YOU.
IT'S BEEN SINCE 2000 -- LORI, DON'T KNOW IF YOU RECALL.
2013 HAS BEEN SINCE THE LAST BOUNDARY CHANGE OR THE LAST PID WAS RENEWED.
SO THE NEXT ONE WILL BE IN 2023.
SO IN 2023 IT WILL GO THROUGH THE SAME PROCESS TO PETITION PROPERTY OWNERS TO BE INCLUDED OR NOT INCLUDED IN THAT PID.
I CAN GET THAT FIGURE FOR YOU.
[01:05:01]
REALLY DON'T HAVE AN OPTION THERE OF SAYING I DON'T WANT TO PARTICIPATE.SO THAT WILL BE IN 2023 WHEN THERE WILL BE A NEW -- REALLY A NEW PROCESS TO RE-ESTABLISH THE PUBLIC IMPROVEMENT DISTRICT.
EVERY YEAR WE'RE BASICALLY JUST BRINGING YOU THEIR BUDGET AND SERVICE AND ASSESSMENT PLAN.
>> PERRY: BUT ONCE IT IS APPROVED, IF YOU'RE WITHIN THAT LINE YOU DON'T GET A CHOICE OF SAYING I DON'T WANT TO BE IN IT OR --
>> PERRY: JUST WANTED TO CLARIFY THAT.
SO THE NEXT TIME THIS IS COMING UP IS IN 2023?
>> PERRY: ONCE THE BOUNDARY IS SET, IT'S SET UNTIL THE NEXT TIME.
YOU CAN'T GO BACK AND ADJUST THAT BOUNDARY DURING THAT INTERIM PERIOD?
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN PERRY.
>> BROCKHOUSE: THANK YOU, MAYOR.
JOHN, I'VE GOT A COUPLE OF QUESTIONS FOR YOU.
JUST CONCERNED ABOUT THE GENTLEMAN THAT CAME UP AND THE RESIDENT THAT SPOKE.
ARE THERE CURRENTLY PROPERTY OWNERS THAT ARE EXEMPT FROM THE PID?
>> ONLY IF YOU'RE EXEMPT FROM TAXES.
SO AN EXEMPT PROPERTY SUCH AS A PUBLIC PROPERTY WOULD BE EXEMPT FROM THE TAXES.
SO IF YOU'RE PAYING PROPERTY TAXES YOU'RE ALSO REQUIRED TO PAY INTO PUBLIC IMPROVEMENT DISTRICT AS WELL.
>> BROCKHOUSE: WE HAVEN'T DONE ANY INCENTIVES ON OUR END THAT WOULD BE ABLE TO AUDIO] THAT WOULD REMOVE THE PID PAYMENT PORTION? LIKE THIS APARTMENT COMPLEX IS BEING BUILT NEXT TO THE PROPERTY OWNER THAT CAME UP AND SPOKE.
ARE THEY EXEMPT? HOW CAN WE FIND THAT?
>> I'LL LOOK INTO WHERE THAT PROPERTY IS.
BUT I'M NOT FAMILIAR WITH ANY -- WE HAVE NOT GIVEN ANY EXCEPTIONS TO THE PUBLIC IMPROVEMENT DISTRICT, BUT MAYBE RAY HAS AN ANSWER.
>> MAYOR NIRENBERG: SHERYL, YOU WANT TO ADD?
>> SCULLEY: LEGALLY, NO, WE CANNOT EXEMPT PRIVATE PROPERTY.
>> BROCKHOUSE: THERE'S NO WAY FOR US TO OFFER THAT.
IF IT IS ON THE PROPERTY, IT MUST BE PAID.
THERE ARE PENALTIES WHICH COULD INCLUDE HAVING A LIEN ON THE PROPERTY.
>> BROCKHOUSE: I WOULD LIKE A LIST OF THE PROPERTIES THAT ARE EXEMPT.
BECAUSE HE ASKED THE QUESTION.
THEY WOULD HAVE HAD TO HAVE BEEN EXEMPTED THROUGH THE STATE.
WE VOLUNTARILY PAY INTO THE PID PER CONTRACT.
THAT'S THE ONLY EXCEPTION I CAN THINK OF THAT WOULD NOT APPLY, THAT WOULD NOT HAVE ANY --
I WOULD LIKE TO KNOW IF THERE ARE ANY EXEMPT PROPERTIES IN THE PID AND THEIR NAMES AND THE AMOUNT OF MONEY THEY'RE EXEMPTED FROM.
>> OTHER THAN GOVERNMENTAL ENTITIES.
OTHER THAN GOVERNMENTAL ENTITIES.
JOHN, SO THE BOUNDARIES, HOW DO WE ENSURE THAT MR. KELLER GETS SERVICES FOR WHAT HE'S PAYING FOR?
I'M SURE WARREN AND HIS TEAM WILL ENGAGE WITH HIM AND DETERMINE EXACTLY WHAT'S GOING ON TO MAKE SURE THAT HE'S GETTING THE SERVICES EQUALLY LIKE EVERYBODY ELSE WILL.
I REALLY HAVE TO LET WARREN ANSWER THAT.
>> BROCKHOUSE: WHAT I WOULD LIKE TO SEE IS A MAP THAT SHOWS THE SERVICE, THE AREAS THAT ARE BEING SERVICED NOW.
SO I WOULD LIKE TO SEE WHO IS OUT OF THE SERVICE AREA.
SO I WOULD IMAGINE THAT THERE ARE BOUNDARIES OF SERVICE OCCURRING SOMEHOW SOMEWHERE.
BECAUSE MR. KELLER NEVER GETS ANYTHING POWER WASHED OR HE NEVER GETS ANYTHING.
>> BROCKHOUSE: I WOULD WANT TO MAKE SURE THAT EVERY EDGE OF THAT PID THAT'S PAYING RECEIVES THE SERVICES, PERIOD, THAT THEY'RE PAYING FOR.
SO THE FIRST LIST WOULD BE WHO IN THE CURRENT SERVICE PLAN OF CENTRO IS NOT GETTING SERVICES.
THE OUTREACH AND HOW FAR THAT LOOKS.
THE HEAT MAP, WHERE THEY GO ON THEIR ROUTES TO CLEAN.
>> BROCKHOUSE: IF THERE IS ANYBODY LEFT OUT, I WOULD LIKE TO EXAMINE A PLAN SO THAT THEY ARE INCLUDED AS PART OF THE PID THAT THEY RECEIVE THE SERVICES THEY PAID FOR.
I THINK IT WOULD BE OF BENEFIT TO FIND THAT OUT.
IF THEY ARE NOT BEING COVERED THEY NEED TO BE EXTENDED TO REGULAR ROUTINE MAINTENANCE SO MR. KELLER AND HIS BUILDING ARE TAKEN CARE OF AND WHOEVER ELSE FALLS OUTSIDE THAT LINE.
>> WARREN MAY BE ABLE TO ADDRESS THAT.
>> TO ADDRESS YOUR CONCERN, THEY ARE MAPS WITHIN THE OPERATION CENTER AND THEY TAKE THE PID AREA AND THEY BREAK IT UP INTO AREAS.
IT'S ALSO PART OF THE SERVICE AND ASSESSMENT PLAN.
AND PEOPLE ARE ASSIGNED TO THOSE AREAS.
IF WE DON'T HEAR OF ANY SPECIFIC EXAMPLES, AS WE HEARD TODAY, WE'RE UNAWARE BECAUSE THE AMBASSADORS THAT ARE ASSIGNED TO THOSE AREAS FOR THE CLEANING AND
[01:10:02]
THE SAFETY IS REALLY PART OF SAPD.THEY'RE ASSIGNED TO CLEAN EVERY SIDEWALK WE DO HAVE SPECIAL-MADE TRICYCLES THAT HAVE POWER WASHERS ON THEM.
IF OUR CENTER GETS A CALL, THEY PEDAL OUT THERE AND THEY POWER WASH.
>> BROCKHOUSE: MY QUESTION WOULD BE THAT'S HOW YOU TREAT ALL AREAS OF THE PID IF YOU HEAR FROM IT YOU GO CLEAN IT?
I MEAN, ANYBODY WITHIN THE PID.
AND SOMETIMES WE GET REQUESTS BY THE CITY.
IT MAY BE JUST OUTSIDE THE PID.
BUT IF SOMEBODY CALLS THE OPERATION CENTER, THEY'LL DO IT RIGHT THEN.
>> BROCKHOUSE: TAKING IT ONE STEP FURTHER, DO YOU HAVE AREAS PEOPLE DON'T HAVE TO CALL, THAT IT'S ON A ROUTINE CLEAN?
>> THE WHOLE AREA IS ON A ROUTINE.
>> BROCKHOUSE: I WOULD LIKE TO SEE THE PROOF OF THAT THAT THIS GENTLEMAN'S AREA IS GETTING ROUTINELY CLEANED.
>> BROCKHOUSE: HE SAID HE'S NEVER SEEN A POWER WASH.
I COULD BE WRONG, BUT THAT WAS HIS PUBLIC STATEMENT THAT HE'S NEVER HAD ANY SERVICES FOR THE MONEY HE'S PAID.
IF HE IS INCORRECT, I WOULD LIKE TO SHOW HIM THE SERVICES HE'S RECEIVED.
WE KNOW WHERE OUR AMBASSADOR ARE EACH DAY.
WE KNOW WHAT THEY'RE ASSIGNED TO DO.
IT SHOULD BE PRETTY EASY TO PUT TOGETHER.
>> HOW FAR BACK WOULD YOU LIKE TO GO?
>> BROCKHOUSE: NO, I WOULD LIKE TO SEE FOR THIS YEAR.
WE DON'T NEED TO OVERWORK IT BUT WHAT I'M TRYING TO GET TO IS YOU HAVE A RESIDENT THAT IS SAYING HE'S NEVER SEEN A SERVICE.
I WOULD IMAGINE IF HE'S NEVER SEEN IT THERE COULD BE OTHER PEOPLE.
AND HE SHOULDN'T HAVE TO CALL IN TO GET THE SERVICES HE'S PAYING FOR BECAUSE YOU ARE ROUTINELY CLEANING OTHER AREAS ON SCHEDULE EVERY DAY.
PEOPLE ON THE RIVER WALK DON'T HAVE TO CALL IN TO GET THE CLEANING SERVICE AND THE POWER WASHING.
BUT WE HAVE A CITIZEN HERE WHO IS NOT GETTING THE SERVICES, UNLESS HE CALLS IN.
YOU SAID HE WOULD HAVE TO CALL?
I SAID IF SOMEBODY CALLS IN THEY WILL GET IMMEDIATE SERVICE.
THE PID PLAN, THE BOUNDARIES, ARE SERVICED EVERY DAY.
WELL, I WOULD LIKE TO SEE THAT BECAUSE I HAVE A CONCERN FOR A RESIDENT WHO PAYS FOR IT.
THAT WOULD BE PART OF THE SERVICE AREA.
I WOULD LIKE MY OFFICE TO SEE THE ROUTINE SCHEDULE SO THAT EVERYBODY IS RECEIVING RECURRING POWER WASHING AND WHAT THEY'RE PAYING FOR THAT YOU'RE OFFERING OTHER AREAS OF DOWNTOWN.
>> WE'LL BE HAPPY TO PROVIDE THAT.
DID YOU HAVE A COMMENT, MR. ADELMAN?
>> I WANTED TO MAKE THE ADDITIONAL POINT TO HIS POINT EXACTLY.
WHEN YOU GO ON TO YOUR OWN PROPERTY, SO WE HAVE PROPERTIES THAT THERE ARE THOSE TYPES OF INCIDENTS WITH PUBLIC URINATION, ET CETERA, WITH THE THE CONFINES OF THE BUILDING, AS HE DESCRIBED IT, UP INTO THE VESTIBULE BY THE FRONT DOOR.
AND WE DON'T RELY -- PROPERTY OWNERS DO NOT RELY ON CENTRO TO CLEAN THOSE AREAS.
ALL THE HOTELS AND OTHER BUSINESSES DOWNTOWN, THIS IS A CONTINUED ISSUE THAT WE ALL FACE.
I WOULD DISTINGUISH BETWEEN WHAT IS PUBLIC RIGHT OF WAY WHERE THE PID IS WORKING, WHERE THE CLEANING SERVICES ARE WORKING, AND I ALSO WOULD DIRECT HIM AS WELL AS YOU NOT TO PUT 100% OF THE BENEFIT OF THE PID AS POWER WASHING.
THAT IS ONE ELEMENT OF THE BENEFIT OF THE ASSESSMENT.
SO I THINK THAT WHETHER IT BE THE RENT THAT HE RECEIVES FROM THE TENANTS HE REFERRED TO, ET CETERA, THERE IS A BENEFIT TO HAVING A CLEAN AND SAFE OVERALL DOWNTOWN.
A DOWNTOWN WITH OTHER BENEFITS, LIKE WITH WHAT KENNY WILSON TALKED ABOUT.
SO NOT TO GET CAUGHT UP -- IT'S NOT JUST POWER WASHING OF THE SIDEWALK IN FRONT OF YOUR BUILDING, BUT HAPPY TO GO TAKE A LOOK AT THAT SIDEWALK.
WE'RE HAPPY TO SEE HOW IT IS PERFORMING.
AND IF IT'S CONSISTENT WITH OTHER SIDEWALKS IN THE NEIGHBORHOOD.
AND THEN WITH REGARD TO THE APARTMENT BUILDING THAT'S BEING BUILT, WE HAVE DONE MULTIPLE PROJECTS, NONE OF THE INCENTIVES WE'VE EVER RECEIVED THAT I'M AWARE OF ON THE BOARD, THEY DON'T APPLY TO THE ASSESSMENT FOR THE PID.
I ALSO WANT TO REMIND PEOPLE IT'S A LITTLE BIT LIKE A HOMEOWNERS ASSOCIATION.
WHEN HOMEOWNERS GET TOGETHER -- THAT'S TO MR. PERRY'S POINT -- AND VOLUNTARILY HAVE AN ASSOCIATION, THEY HAVE A MEETING, THEY HAVE A BOARD.
THEY CAN TAKE A VOTE AND THE MAJORITY OF THE BENEFICIARIES MAKE THOSE DECISIONS AND SOMETIMES YOU CAN GO TO ANY HOMEOWNERS ASSOCIATION MEETING IN SAN ANTONIO AND YOU'LL PROBABLY FIND PEOPLE THAT DON'T FEEL EITHER THE LANDSCAPING IS UP TO THE PAR THAT THEY WANT OR WHATEVER.
BUT AT SOME LEVEL THEY ARE RELYING ON THEIR NEIGHBORS TO BE A PART OF IT, AND THAT'S WHAT WE'RE DOING.
>> BROCKHOUSE: I DID DISTINGUISH WHAT OCCURRED, BECAUSE WHAT HE DESCRIBED HAPPENED INSIDE HIS PROPERTY LINE, I DIDN'T MENTION THAT.
I WAS REFERRING TO THE SERVICES IN THE PUBLIC RIGHT OF WAY, POWER WASHING AND THE THINGS THAT ARE AVAILABLE.
I UNDERSTAND IT'S PRIVATE PROPERTY AND IT'S A DIFFICULT
[01:15:01]
POSITION TO BE IN.WHEN SOMEBODY DOES SOMETHING, I GET THAT.
I WAS CONCERNED ABOUT ANY SERVICES THAT WERE AVAILABLE TO THE RESIDENT, THE BUILDING OWNER, IF HE IS NOT RECEIVING THEM.
EVERYBODY IN THE PID SHOULD BE RECEIVING THEM.
MUCH LIKE A HOMEOWNERS ASSOCIATION RECEIVES THE BENEFIT.
IT'S A TANGIBLE BENEFIT AND PERHAPS ITS LONGER-TERM GOAL WOULD BE TO MAKE SURE ALL THE HOMEOWNERS RECEIVE NOTIFICATIONS OF THE BENEFITS THEY ARE RECEIVING.
IF YOU HAVE PEOPLE OUT THERE PAYING IT, THEY MAY NOT KNOW.
IT WOULD BE A GOOD THING TO EDUCATE YOUR PID PAYERS THAT THESE ARE THE SERVICES THEY ARE RECEIVING.
IT MAY GIVE YOU AN OPPORTUNITY TO SEE SOME GAPS IN SERVICE YOU ARE MISSING THAT PEOPLE ARE NOT RECEIVING RECURRING SERVICES.
I WANT TO MAKE SURE MR. KELLER AND ANY OTHER PROPERTY OWNERS HAS THE OPPORTUNITY.
I LOOK FORWARD TO RECEIVING THE INFORMATION.
>> COUNCILMAN PERRY, I HAVE THE ANSWER TO YOUR QUESTION.
56% OF THE PROPERTY OWNERS AND 68% OF THE VALUATION WITHIN THE PID APPROVED THE PID.
>> MAYOR NIRENBERG: THANK YOU, COUNCILMAN BROCKHOUSE.
>> SANDOVAL: THANK YOU, MAYOR.
THANK YOU VERY MUCH FOR YOUR PRESENTATION AND FOR PROVIDING THE INFORMATION THAT WE'VE BEEN REQUESTING.
IT'S KIND OF FUNNY -- IT'S NOT FUNNY BUT IT'S PECULIAR WHEN YOU HEAR SOMEONE BRING A CONCERN ABOUT THE PID OR THE TAXING ENTITY, I CAN'T HELP BUT THINK OF OUR SITUATION AS COUNCIL PEOPLE TOO.
LIKE, OH, WELL, MY SIDEWALK DIDN'T GET DONE.
WHETHER IT WAS PRESSURE WASHED OR REDONE OR REBUILT.
SO WE COMPLETELY CAN RELATE TO THAT TYPE OF CONCERN.
SO WE TRY OUR BEST TO PROVIDE THAT INFORMATION TO OUR CONSTITUENTS ABOUT, YOU KNOW, WHAT OUR INFRASTRUCTURE MAINTENANCE PLAN IS GOING TO BE OR WHAT SERVICES THEY CAN EXPECT.
SO IF I'M A MEMBER OF THE PID, HOW WOULD I HAVE ACCESS TO THAT INFORMATION? IS IT EASILY AVAILABLE TO YOUR MEMBERS?
WE'RE HAPPY TO PROVIDE ANY INFORMATION.
I DON'T THINK THAT'S ONLINE ON OUR WEBSITE.
THE MAP OF THE AREAS OF WHERE THE HOSPITALITY AMBASSADORS OR THE CLEAN AMBASSADORS, THE MAINTENANCE AMBASSADORS, THAT REALLY DOESN'T CHANGE.
THE PEOPLE MAY BE REASSIGNED, BUT THOSE -- WE DON'T GET ASKED THAT MUCH.
THE SERVICE AND ASSESSMENT PLAN HAS SEVERAL PID MAPS.
SOME THAT HAVE NUMBERS ON IT, AND THEY RELATE TO THE SERVICE AND ASSESSMENT PLAN AND ADDRESS THE MAINTENANCE AND THE LANDSCAPING, WHICH IS ALSO PART OF OUR -- ALL THE HANGING POTS AND POTS ON THE SIDEWALK.
THOSE ARE ALSO OUR RESPONSIBILITY.
AND JUST ANOTHER QUESTION FOR JOHN.
JUST FOR CLARIFICATION REGARDING THE EXEMPTIONS.
>> IF YOU'RE TAX EXEMPT, SO IF YOU'RE NOT PAYING PROPERTY TAXES.
A PUBLIC PROPERTY WOULD NOT PAY PROPERTY TAXES.
YOU WOULD BE EXEMPT FROM PROPERTY TAXES.
YOU WOULD ALSO BE EXEMPT FROM THE PID ASSESSMENT AS WELL.
THAT CLARIFIES YOU HAVE TO BE A TAX EXEMPT ENTITY.
AND I'M GLAD TO SEE THAT THERE ARE SOME VOLUNTARY CONTRIBUTIONS INTO THE PID FROM CHRISTUS SANTA ROSA.
YOU MENTIONED THE COUNTY, I BELIEVE, AND --
THE COUNTY WILL CONTRIBUTE $30,000 THIS YEAR.
IS THERE ANY WAY WE CAN ENCOURAGE SOME OF THOSE OTHER NONPROFIT ENTITIES TO ALSO MAKE SOME LEVEL OF CONTRIBUTION?
I DO KNOW THAT WARREN AND TRISH AND DAVID ARE ACTIVELY TALKING TO VARIOUS ORGANIZATIONS, YOU KNOW, TRYING TO GET THAT.
AGAIN, IT WOULD BE VOLUNTARY FOR THEM TO DO IT.
>> SANDOVAL: THERE'S A LOT OF BENEFITS PROVIDED BY CENTRO AND THE SERVICES THAT ARE OUT THERE.
SO LET US KNOW IF THERE'S ANYTHING WE CAN DO TO ENCOURAGE SOME OF THAT AS WELL.
BUT THANK YOU VERY MUCH FOR ALL THE WORK YOU DO DOWNTOWN.
IT IS, LIKE ONE OF THE SPEAKERS MENTIONED, JUST BEING REVITALIZED, AND THANKS TO WORK LIKE THAT.
>> MAYOR NIRENBERG: THANK YOU, COUNCILWOMAN SANDOVAL.
THANK YOU, WARREN, JOHN, AND OUR AMBASSADORS FOR COMING OUT THIS
[01:20:01]
MORNING.THE CENTRAL CORE OF SAN ANTONIO HAS BEEN TRANSFORMED OVER THE LAST 20 YEARS OR SO, MUCH OF IT DUE TO DEVELOPMENT, BUT ALSO VERY HARD WORK BY FOLKS LIKE YOU.
THANK YOU SO MUCH FOR WHAT YOU DO AND THANK YOU TO THE BOARD OF CENTRO ALSO FOR COMING OUT.
THERE IS A MOTION AND A SECOND FOR APPROVAL OF ITEM NO. 27.
[28. City Manager's Report]
PLEASE VOTE.THAT'S EVERYTHING ON OUR MORNING AGENDA.
IS THERE A CITY MANAGER'S REPORT?
>> SCULLEY: YES, MAYOR, JUST BRIEFLY.
A FEW GOOD NEWS ITEMS. FIRST, I'M EXCITED TO SHARE THAT OF COURSE THE CITY OF SAN ANTONIO IS A WINNER OF THE 2018 CULTURE OF HEALTH PRIZE AWARDED BY THE ROBERT WOOD JOHNSON FOUNDATION.
THIS IS A NATIONAL PRIZE WHICH HONORS COMMUNITIES FOR THEIR EFFORTS TO ENSURE ALL RESIDENTS HAVE OPPORTUNITIES TO LIVE HEALTHIER LIVES AND TO EARN THIS DISTINGUISHED PRIZE WE HAD TO DEMONSTRATE HOW OUR EFFORTS REFLECT THE SIX CULTURES OF THE HEALTH PRIZE CRITERIA.
THIS YEAR'S SAN ANTONIO'S APPLICATION WAS SPEARHEADED BY OUR METROPOLITAN HEALTH DEPARTMENT AND IT SHOWCASES EXAMPLES SUCH AS OUR PRE-K 4 SA, HAVEN FOR HOPE, SAN ANTONIO POLICE DEPARTMENT'S MENTAL HEALTH UNIT AND RESTORATION CENTER.
OUR APPLICATION HIGHLIGHTED HOW A COMMUNITY CAN USE DATA-DRIVEN APPROACHES TO PROMOTE CHILDREN'S ABILITY TO LEARN AND THRIVE, INCREASE GREEN SPACES, PHYSICAL ACTIVITY, HELP MENTALLY ILL PEOPLE IN CRISIS AND UNITE THE HOMELESS.
SAN ANTONIO WILL RECEIVE A $25,000 CASH PRIZE AND A NATIONAL PLATFORM TO SHARE OUR STORY AND LESSONS LEARNED WITH OTHER CITIES IN THE COUNTRY.
THE MONEY WILL BE PRESENTED TO COUNCIL FOR ACCEPTANCE.
AND THEN OUR COMMUNITY PARTNERS WILL WORK TOGETHER ON A PLAN FOR HOW TO USE THOSE DOLLARS.
OUR THANKS TO DR. BRIDGER AND HER TEAM FOR LEADING THE EFFORT AND COORDINATING THIS AMONG OUR COMMUNITY PARTNERS.
SECONDLY, NATIONAL NIGHT OUT IS OBSERVED ANNUALLY ON THE FIRST TUESDAY IN OCTOBER.
EACH YEAR SAN ANTONIO HAS ONE OF THE LARGEST EVENTS IN THE NATION WITH TENS OF THOUSANDS OF OUR RESIDENTS THROUGHOUT THE CITY MEETING ON PORCHES, BLOCK PARTIES, COMMUNITY CENTERS, AND PARKS TO REDUCE CRIME AND STRENGTHEN OUR NEIGHBORHOOD BONDS.
IN 2017 OVER 1200 COMMUNITY ORGANIZATIONS REGISTERED THEIR EVENT WITH OUR POLICE DEPARTMENT, AND AS OF TODAY WE HAVE OVER 400 ORGANIZATIONS THAT HAVE REGISTERED.
SO WE KNOW MORE ARE REGISTERING EACH DAY.
WE ARE ACCEPTING REGISTRATIONS THROUGH SEPTEMBER 28, THAT'S NEXT FRIDAY.
AND WE ENCOURAGE ANY ORGANIZATION HOSTING AN EVENT TO REGISTER BY CALLING 207-8927.
THE NATIONAL NIGHT OUT EMBODIES THE SPIRIT AND COMMITMENT OF OUR RESIDENTS WHO DEDICATE THOUSANDS OF HOURS EACH YEAR VOLUNTEERING WITH THE CITY OF SAN ANTONIO AND VARIOUS NEIGHBORHOOD ORGANIZATIONS TO ENHANCE OUR QUALITY OF LIFE AND ENSURE THAT SAN ANTONIO REMAINS ONE OF THE SAFEST BIG CITIES IN THE COUNTRY.
EACH YEAR I PERSONALLY LOOK FORWARD TO VISITING WITH OUR RESIDENTS THROUGHOUT THE CITY, AS I KNOW MANY OF YOU DO AS YOU TRY TO ATTEND AS MANY EVENTS AS POSSIBLE.
BUT WITH HUNDREDS OF THEM THROUGHOUT ALL THE DISTRICTS, IT'S CERTAINLY IMPOSSIBLE TO GET TO ALL OF THEM.
BUT WE THANK OUR RESIDENTS FOR HOSTING THESE EVENTS AND PARTNERING WITH SAPD.
NEXT, SICLOVIA, THE NEXT EVENT IS SCHEDULED FOR SUNDAY, SEPTEMBER 30TH, 11:00 A.M. TO 3:00 P.M.
AND THE ROUTE WILL RUN ALONG BROADWAY FROM MENKEY PARK TO MADISON SQUARE PARK ON LEXINGTON AVENUE.
THIS WILL MARK THE 15TH SICLOVIA EVENT FOR SAN ANTONIO.
IT'S FREE, BIANNUAL, FAMILY-FRIENDLY, AND THAT TURNS OUR STREETS INTO A SAFE PLACE TO EXERCISE AND PLAY.
WE ALWAYS HAVE RUNNERS, WALKERS, CYCLISTS, STROLLERS.
WE MIGHT EVEN HAVE A FEW SCOOTERS THIS YEAR.
SO WE WANT EVERYONE TO BE SAFE AND PARTICIPATE IN SICLOVIA.
IT DATES BACK TO 2011 WHEN WE HOSTED PARTNERING WITH THE YMCA FOR THE VERY FIRST EVENT.
AND SINCE THEN THE YMCA AND PARTNERS HAVE SUCCESSFULLY HELD TWO SICLOVIA EVENTS PER YEAR, AND WE'VE TRIED TO MOVE THOSE AROUND THE CITY SO THAT ALL OF OUR RESIDENTS CAN PARTICIPATE.
AND OF COURSE IT'S OPEN TO THE GENERAL PUBLIC FROM ALL OF OUR COUNCIL DISTRICTS.
THE ATTENDANCE HAS GROWN OVER THE YEARS FROM 15,000, THE VERY FIRST SICLOVIA WE DID, TO 70,000 THAT ARE EXPECTED ON SEPTEMBER 30TH.
AND THEN LASTLY, MAYOR AND COUNCIL, THE SAN ANTONIO PARKS FOUNDATION HAS ANNOUNCED THE DETAILS FOR THE MUCH-ANTICIPATED THIS WEEKEND.
THIS IS THE 35TH JAZZ ALIVE FESTIVAL IN THE DOWNTOWN AREA.
THIS IS A FREE OUTDOOR MUSIC AND
[01:25:01]
CULTURE FESTIVAL THAT WILL TAKE PLACE TOMORROW, SEPTEMBER 21ST FROM 5:00 P.M. TO 12:00 A.M.AND SATURDAY, SEPTEMBER 22 FROM 10:00 A.M. TO 11:00 P.M. IN THE HISTORIC TRAVIS PARK.
STELLAR HEADLINERS WILL INCLUDE THE 2018-GRAMNY NOMINEE JAZZ VOCAL ALBUM OF THE YEAR, GRAMNY AWARD WINNER AND 19 TIMES GRAMMY NOMINEE LEE WRITNOUR, SAMMY MILLER, AND THE CONGREGATION.
AND THE SPECIAL ENGAGEMENT WITH US, AIR FORCE DIMENSIONS IN THE BLUE JAZZ ENSEMBLE.
WE HAVE LOTS OF MUSIC ACTIVITIES THIS WEEKEND DOWNTOWN.
I KNOW TOMORROW EVENING THE SYMPHONY KICKS OFF ITS NEW SEASON.
AND SO WE'RE EXCITED TO HAVE THESE OPPORTUNITIES FOR THE COMMUNITY.
JAZZ ALIVE WILL ALSO INCLUDE TONS OF FREE FAMILY FUN FOR ALL AGES, INCLUDING A CREATIVE YOUTH VILLAGE, BUDDING ARTIST JAZZ SESSIONS, AND YOGA IN THE PARK.
IT IS A FAMILY-FRIENDLY EVENT AND ALL THE MONEYS RAISED SUPPORT PLAYGROUNDS TO LIGHTING TO BEAUTIFICATION.
WE INVITE THE FAMILIES IN SAN ANTONIO TO PARTICIPATE IN JAZZ ALIVE THIS WEEKEND IN DOWNTOWN SAN ANTONIO AT TRAVIS PARK.
WE DO HAVE A ZONING AGENDA WHICH WILL BEGIN AT 2:00 P.M.
IN THE MEANTIME, COUNCIL, WE WILL BE RECESSED.
[Zoning Consent Agenda]
ZONING AGENDA.WE HAVE A FAIRLY SIZEABLE AGENDA TODAY.
AND A NUMBER OF ITEMS THAT ARE ALREADY ON INDIVIDUAL CONSIDERATION AT THIS TIME.
I'LL ASK MY COLLEAGUES IF THERE'S ANYTHING ELSE THEY WOULD LIKE TO PULL FOR INDIVIDUAL CONSIDERATION.
CURRENTLY WE HAVE P-1 AND Z-2, Z-7, P 2 AND Z 9, Z 11, Z 12, Z 16, Z 17, P 5 AND Z 19, P 6 AND Z 21.
ARE THERE ANY OTHER ITEMS WE WOULD LIKE TO PULL OFF THE CONSENT AGENDA? OKAY.
>> I'M SORRY, [INDISCERNIBLE].
>> MAYOR NIRENBERG: NO, I DID NOT.
ITEM Z 6 HAS BEEN WITHDRAWN BY THE APPLICANT AND WILL NOT BE ADDRESSED TODAY.
I'LL ENTERTAIN A MOTION FOR THE BALANCE OF THE CONSENT.
THERE'S A MOTION AND A SECOND FOR THE BALANCE OF THE CONSENT AGENDA.
AND THAT'S ITEMS FOR Z 2, Z 5, P 2 Z 9, Z 16, Z 17, P 5, P 6 AND Z 21.
WE HAVE A SPEAKER SIGNED UP TO SPEAK ON ITEMS REMAINING ON CONSENT.
>> GOOD AFTERNOON, MAYOR NURENBERG, MY NAME IS JACK M.
YES, EXCESSIVE DENSITY, AND COMMERCIAL ENCROACHMENT.
THAT'S THE BIGGEST PROBLEMS YOU HAVE ON TODAY'S ZONING AGENDA HERE.
I APPRECIATE IF PEOPLE WOULD JUST SAY NO TO THAT STUFF.
YES, MR. TREVINO, YOUR DISTRICT, OVER ON NORTH ST. MARY STREET
[01:30:03]
AND EAST EUCLID, YOU'VE GOT A PROPOSAL FOR, YES, VERY DENSE HOUSING.I'M SORRY, SIR, THE TOBIN HILL NEIGHBORHOOD ASSOCIATION OPPOSES THAT.
TWO PEOPLE ACTUALLY SPOKE AGAINST IT AT THE COMMISSION HEARINGS.
AND THE STAFF SAID PROPOSED DENSITY IS WAY TOO HIGH FOR THE SURROUNDING AREA.
WHY DON'T WE JUST SAY NO TO THAT ONE, MR. TREVINO.
AND LIKEWISE, IN DISTRICT 10, MR. PERRY, MY GOD, YOU'VE GOT A BIG CONTROVERSY THERE WITH THE ONE ON BROADWAY.
IT'S SO BAD THAT WITH THE 65 UNITS, THEY COMPROMISED DOWN TO 50, BUT SIR, 50 IS STILL PRETTY DARN DENSE THERE, SIR.
I REALLY WISH YOU WOULD SAY NO TO IT.
YOU HAVE AT LEAST THREE PETITION DRIVES OF HUNDREDS OF PEOPLE SAYING NO TO THAT THING.
AND YEAH, I MEAN, SIGNATURES GALORE THERE.
ELSEWHERE ON THIS AGENDA, YEAH, THE -- IN MR. BROCKHOUSE, YOUR DISTRICT, SIR, Z-16.
YEAH, THIS IS ABOUT, WELL, WHAT DOES IT SAY HERE.
THE COMMERCIAL ENCROACHMENT, THAT'S WHAT THIS ONE IS.
PEOPLE DON'T LIKE THE IDEA OF ENCROACHMENT INTO THEIR NEIGHBORHOODS.
THEY SAID IT'S NOT CONSISTENT WITH THE SURROUNDING AREA.
AND FURTHER ENCROACHMENT OF COMMERCIAL USES COULD MOVE AN ADVERSE IMPACT UPON THE EXISTING NEIGHBORHOOD.
IT WILL DRAW MORE NOISE, MORE TRAFFIC, AND BUSINESS ACTIVITY TO THE AREA.
IN FACT, AT LEAST A FIFTH OF THEM SAID NO TO IT.
AND THE CABLE ASSOCIATION OPPOSES THIS ONE.
IT HAS SO MANY RED FLAGS, WHY DON'T YOU SAY NO TO Z-16 AS WELL.
AND I'M GOING TO SKIP OVER TO ANOTHER ONE HERE.
Z-12, YES, AND THIS IS -- ALMOST ALL OF THEM, AT LEAST A QUARTER OF THE PEOPLE SURROUNDING THAT AREA SAID NO TO THE CAR WASH THERE, BECAUSE OF THE TRAFFIC AND THE NOISE AND EVERYTHING ELSE.
>> MAYOR NIRENBERG: THANK YOU, MR. FINGER.
CORRECTION ON THE MOTION, Z-5 WILL REMAIN ON CONSENT.
AND SO WE HAVE A MOTION AND A SECOND FOR THE BALANCE OF THE CONSENT AGENDA WHICH IS ALL ITEMS, SAY, FOR P 1, Z 2, Z 7 AND Z 11, 12, 16, 17, P-5 AND Z-19, P 6 AND Z 21.

28 NOTICES MAILED, SIX IN FAVOR, AND THE NEIGHBORHOOD PARK ASSOCIATION IS OPPOSED.
>> MAYOR NIRENBERG: WE HAVE A FEW CITIZENS SIGNED UP TO SPEAK ON THIS ITEM.
WE'LL BEGIN WITH JAMES DICKERSON.
MR. DICKERSON, YOU'LL BE FOLLOWED BY JAMES BURNETT.
I LIVE IN THE NEIGHBORHOOD IN QUESTION.
I'M OLD, I'M TIRED, AND MY ASSOCIATES FUNDAMENTALLY SAY, LEAVE THIS THING ALONE, BECAUSE YOU CAN'T BEAT CITY HALL.
FIRST AND FOREMOST, I'D LIKE TO CITE TO YOU A PORTION OF SECTION 1015 OF THE CODE.
IF THE NOTICE OF VIOLATION IS NOT COMPLIED WITH PROMPTLY, THE BUILDING OFFICIAL IS AUTHORIZED TO IN EFFECT RESTRAIN, CORRECT, ABATE SUCH VIOLATION OR REQUIRE THE REMOVAL OR TERMINATION OF SUCH UNLAWFUL OCCUPANCY.
I HAVE IDENTIFIED BETTER THAN SIX CITATIONS IN THE CODE THAT DOES NOT ALLOW FOR THIS PROCESS TO CIRCUMVENT, WHAT WOULD BE THE PURPOSE OF HAVING A CODE.
FUNDAMENTALLY, IT SEEMS THE CITY IS WILLING TO BYPASS THE CODE IN ORDER TO AFFORD THIS PARTICULAR BUS BUSINESS, A HOME IN AN EAST SIDE NEIGHBORHOOD.
SHOULD NOT BE THE CASE, BUT AS MY ASSOCIATES WOULD OTHERWISE SUGGEST, WHY HAVE THE LAW.
AND MY BOTTOM LINE IS, IF WE'RE NOT GOING TO FOLLOW IT, SO BE IT.
CITY HALL IN EFFECT DOES WHAT IT'S OTHERWISE PREPARED TO DO, DESPITE A CODE THAT EXISTS FOR THE PURPOSES OF FOLLOWING THE CODE.
THERE'S NO CITATION IN THE CODE THAT ALLOWS FOR THIS PROCESS TO CIRCUMVENT THE CODE.
>> MAYOR NIRENBERG: THANK YOU, MR. DICKERSON.
JAMES BURNETT? MR. BURNETT, YOU'LL BE FOLLOWED BY ELIZABETH NASIAS.
I WAS RAISED IN THAT NEIGHBORHOOD, MY FAMILY'S BEEN THERE ABOUT 56 YEARS.
I'VE KNOWN THE NASIAS FAMILY, THE BUSINESS THAT'S ACTUALLY BEEN IN THE NEIGHBORHOOD AND HAS BROUGHT A POSITIVE CHANGE TO THAT AREA.
A LOT OF BUSINESSES THAT USED TO BE OVER THERE ARE NOW GONE.
THEY CAME IN THE AREA, AND GOT A VACANT BUILDING AND TURNED IT INTO A HIGH-END AND HIGH CLIENTELE BUSINESS.
IT'S A FAMILY BUSINESS, A REPUTABLE BUSINESS.
BUT I'VE NOTICED SINCE THEY'VE BEEN OVER THERE, THEY'VE WORKED WITH THE COMMUNITY.
WE WERE ABLE TO GET RID OF SOME OF THE BAD ELEMENT THAT'S THRIVED FOR YEARS.
IT PROVIDED SOME JOBS OVER THERE.
THEY USED TO WORK OVER ON THE NORTH SIDE, WHERE THEIR BUSINESS WAS, AND THEY DECIDED TO COME OVER HERE.
SO I JUST NOTICED THAT IT IS SOMETHING THAT THEY HAVE DONE AS FAR AS AFFECTING A LOT OF CHANGE, POSITIVE CHANGE.
AND I'VE KNOWN THEM FOR 15-PLUS YEARS.
I JUST WANTED TO SPEAK ON THEIR BEHALF.
>> MAYOR NIRENBERG: THANK YOU, MR. BURNETT.
ELIZABETH MASIAS? FOLLOWED BY ANTHONY MASIAS.
[01:40:10]
>> THERE'S SOME HANDOUTS AND ATTACHMENTS THAT ARE BEING SENT, HANDED OUT TO YOU.
ANTHONY MASIAS IS GIVING ME HIS THREE MINUTES, SO I WANTED TO GO AHEAD AND PUT THAT ON RECORD.
>> MAYOR NIRENBERG: ANTHONY -- OKAY, GREAT.
DOES EVERYONE HAVE THE ATTACHMENTS? YOU'RE GOING TO HAVE A COPY OF THE SLIDE SHOW SO THAT YOU CAN SEE IT.
THEN YOU'RE ALSO GOING TO HAVE A COPY OF ALL THE OTHER ATTACHMENTS, A, B, C, D, THROUGH F.
THEY ARE GOING TO INCLUDE EVER EVERYTHING -- THEY'RE NOT GOING TO BE BULLET POINTS.
THEY'RE GOING TO HAVE EVERYTHING ON THERE.
WE'RE PRETTY MUCH TRANSPARENT.
HERE IS THE AERIAL VIEW ON THE CORRIDOR OF IH-10, AND BELLINGER AND FARRIS STREET, YOU CAN SEE WE HAVE THE FOOD MART TO ONE SIDE.
WE HAVE SKINNY'S ON THE OPPOSITE SIDE.
THEN WE ALSO HAVE THE BAIL BONDSMEN.
EVERYBODY KNOWS WHAT THAT AREA HAS BEEN IN THE NEWS QUITE A LOT.
WE TOOK THIS BUILDING -- LET ME GO TO THE NEXT, I'M SORRY.
YOU CAN SEE IT AT THE CORNER WITH THE STAR, THAT IS THE BUILDING WE ARE TALKING ABOUT, 302 BELLINGER.
YOU CAN SEE OUR BUILDING FROM BOTH THE OTHER BUSINESSES THERE.
IF YOU WERE STANDING RIGHT IN FRONT OF FARRIS, YOU CAN SEE OUR BUILDING, THERE IS THE MLK GAS STATION AND FOOD MART AND ACROSS THE STREET IS THE SKINNY'S.
IN 2014, WE WERE LOOKING FOR A PERMANENT HOME.
THIS IS WHAT THE BUILDING LOOKED LIKE IN 2014.
IN 2014, WE SIGNED IN THE DECEMBER OF 2014, WE WENT AHEAD AND WE SIGNED THE LEASE WITH THE LANDLORD.
THE OWNER OF THE PROPERTY DID NOT WANT TO SELL TO US AT THAT POINT IN TIME.
IT HAD BEEN VACANT FOR FIVE YEARS, IT USED TO BE HOME STAKE.
HE LITERALLY SHUT THE DOORS AND DID NOT COME BACK.
AND THAT'S WHAT WAS LEFT ON THE INTERIOR OF THE BUILDING.
IT WAS LEFT WITH THINGS IN THE FREEZER.
IT WAS BECOMING A HANGOUT FOR THINGS THAT SHOULDN'T BE DONE.
AND THAT'S ALL I'M GOING TO SAY ON THAT.
SO M 4 ENTITIES, AND THE STRAUSSBERG AND PRICE WHO ARE OUR ATTORNEYS WENT AHEAD AND STRUCK A DEAL WITH THE OWNER SO WE COULD DO A TWO-YEAR LEASE WITH A PURCHASE CONVENTIONAL LOAN WITHIN TWO YEARS.
AND HE WAS GOING TO ASSIST US WITH THE DEED SO THAT WE COULD DO THIS THEN.
SO WE COULD GET THIS AMENDMENT DONE THEN.
WHAT HAPPENED WAS, AS YOU CAN SEE, AND YOU CAN SEE THE FULL DISCLOSURE ON ATTACHMENT "A" OF ALL THE HISTORY AS WE GO THROUGH IT, IN DECEMBER THAT'S WHAT HAPPENED.
JANUARY, HERE'S THE CLEANUP THAT WE WERE GOING THROUGH.
WE HAD TO PUT IN MONEY BECAUSE WE COULDN'T EVEN GET CPS OUT THERE FOR A METER TO DO ANYTHING.
SINCE IT WAS VACANT, WE HAD TO HAVE AN ELECTRICAL ENGINEER GO OUT AND DO DIAGRAMMING, AND WE HAD TO SPEND MORE MONEY.
AND THERE'S THE LISTING, YOU CAN SEE, AS WE'RE GOING THROUGH ATTACHMENT "A," ATTACHMENT "B," IN FEBRUARY OF '13, CPS CAME OUT, WE PASSED EVERYTHING, CODE CAME OUT, THEY PUT THE METER UP, LIGHTS ARE ON.
WE HAD A BARBECUE IN THE NEIGHBORHOOD ON THAT FRIDAY.
FEBRUARY 14TH, MY SON DIED TRAGICALLY BY AN ALLEGED DRUNK DRIVER.
WE'RE ACTUALLY GOING TO COURT NEXT WEEK FINALLY.
SO WITH THAT BEING SAID, THE MASIAS, WE ARE A FAMILY OWNED AND OPERATED BUSINESS.
WE HAD TO WHEEL BACK SIX TO SEVEN MONTHS, EVEN OUR CLIENTS HAD TO TAKE BACK FOR SIX AND SEVEN MONTHS.
WE LIVE IN DISTRICT 2 -- I MEAN, DISTRICT 3, AND OUR OTHER HOME IS DISTRICT 2.
WE SPENT MOST OF OUR TIME THERE.
MY SON WAS A GRADUATE FROM MCCULLUM HIGH SCHOOL.
I WAS A BAND BOOSTER PRESIDENT THERE FOR SIX YEARS.
SO I WAS WELL KNOWN IN THE COMMUNITY AND SO WAS HE.
IT WAS TRAGIC ALL THE WAY AROUND.
YOU CAN SEE THAT IN ATTACHMENT "B." HIS DEATH HAPPENED LITERALLY THAT MONTH.
MARCH, APRIL, NOTHING HAPPENED.
JUNE WE COME BACK TO WORK AND SAY, HEY, MAN, WE'VE GOT TO GET EVERYTHING GOING.
WE GET SERVED BY THE TAX ASSESSOR'S OFFICE FOR FORECLOSURE ON THE BUILDING BECAUSE THE LANDLORD HAD NOT PAID HIS PROPERTY TAXES FOR FIVE
[01:45:01]
YEARS.SO AT THAT POINT WE HIRED STRAUSSBURG LAW FIRM, AND THEY LOOK INTO IT, OUR REALTOR LOOKS INTO IT, AND THEY SAY, HEY -- AND WE CAN'T STRIKE A DEAL WITH THE SECOND LIEN HOLDER.
NO MATTER HOW MANY PROPERTY TAXES WE OWN, YOU'LL BE PUTTING MONEY OUT THE DOOR.
WE WERE TOLD IN DECEMBER, SAVE OUR MONEY, GET YOUR MONEY, DO WHAT YOU NEED TO DO.
AND YOU'RE GOING TO PUBLIC AUCTION ON JANUARY 2017.
IN JANUARY OF 2017, TO AUCTION, WE STRUCK A DEAL WITH MY BROTHER-IN-LAW, WHO HAS AN INVESTMENT FIRM, AND HE DECIDED TO DO EVERYTHING FOR US.
AND WE STARTED THIS PROCESS AS SOON AS WE COULD.
I WANT TO GO FORWARD AND SHOW YOU THE RENDERINGS OF WHAT WE WANTED TO DO.
WE HAVE PERMISSION TO PAINT THE BUILDING FROM THE OTHER TWO OWNERS NOW.
WE WANT TO DO A BEAUTIFICATION PLAN.
THAT SEEMS TO BE THE PROBLEM WITH EVERYTHING.
AND I WANT TO THANK T.C. CALVERT FOR MEETING WITH ME FOR THREE HOURS THIS WEEK AND EVERYONE ELSE THAT HAS HELPED US.
THAT'S THE SIGN WE WANT TO PUT UP.
AND I'M RUNNING OUT OF TIME, SO I'M SORRY.
>> MAYOR NIRENBERG: THANK YOU, MISS MASIAS.
CAN I HAVE THE STAFF TO THE PODIUM, PLEASE, FOR JUST A COUPLE OF QUESTIONS? THE CURRENT ZONING ON THIS PROPERTY NOW IS C-2?
>> SHAW: SO WITH THE ADDITIONAL CONDITION ON THIS PROPERTY, DOES THAT LIMIT THE USE OF THE PROPERTY?
>> WITH THE CD, IT'S GOING TO LIMIT THE USE FOR THE PROPERTY TO THE AUTO AND LIGHT TRUCK REPAIR.
>> SHAW: IT RUNS WITH THE PROPERTY, CORRECT?
>> SHAW: BRIEFLY SPEAKING TO MR. DICKERSON'S POINT REGARDING THE CODE, DOES THE UDC SPEAK TO WHETHER OR NOT AN APPLICANT CAN APPLY FOR A ZONING CHANGE IN ORDER TO BECOME COMPLIANT WITH CODE?
THEY CAN APPLY FOR THE ZONING CHANGE IN ORDER TO BE COMPLIANT.
BUT AT THIS POINT THEY'RE NOT IN COMPLIANCE WITH OUR ZONING REGULATIONS.
>> SHAW: SO IT'S TO DPETD INTO COMPLIANCE?
IP THINK SINCE IT PASSED THE ZONING, AND PASSED THROUGH PLANNING, I SPOKE TO MR. DICKERSON AND THE NEIGHBORHOOD AT GREAT LENGTH.
OUR STAFF DID GREAT WORK IN COMMUNICATING THE EFFORTS OF THE APPLICANT AS WELL AS THE NEIGHBORHOOD ASSOCIATION.
SO AT THIS TIME IT EARNED THE STAFF RECOMMENDATION.
I MOVE TO APPROVE P-2, Z-9, THAT'S WITH THE FOLLOWING CONDITIONS, THAT THE PROPERTY MUST HAVE A SIX-FOOT SOLID SCREEN FENCE ALONG WITH THE EXISTING FOOT PRINT.
>> MAYOR NIRENBERG: THERE'S A MOTION AND A SECOND FOR APPROVAL OF ITEMS P-2, AND Z-9, WITH CONDITIONS AS READ.
[Z-11. I WILL MAKE THE MOTION TO APPROVE.
JUST FOR THE RECORD, I WANT TO THANK THE APPLICANT WHO HAS BEEN WORKING WITH MY OFFICE AND THE NEIGHBORS.
WE DO HAVE SOME RESTRICTIVE COVENANTS THAT WE'RE GOING TO ENTER INTO THE RECORD AS WELL.
SO THIS IS THE FIRST MAJOR DEVELOPMENT ALONG 1604 IN THAT AREA SINCE OUR RECENT ANNEXATION ABOUT FIVE YEARS AGO.
SO WE'RE VERY PROUD OF THAT FACT AND WE'RE EXPECTING A GREAT GOLD STANDARD DEVELOPMENT OUT THERE.
WE HAVE A MOTION, AND A SECOND.
[Z-12. ZONING CASE # Z2018258 S (Council District 3): Ordinance amending the Zoning District Boundary from "C-2 AHOD" Commercial Airport Hazard Overlay District to "C-2 S AHOD" Commercial Airport Hazard Overlay District with Specific Use Authorization for a Carwash on 0.71 acres out of NCB 10939, located at 1003 Avondale Avenue. 17 NOTICED MAIL, ZERO IN FAVOR, THREE OPPOSED.
HIGHLAND NEIGHBORHOOD HILLS ASSOCIATION IS IN FAVOR.
>> CITIZENS SIGNED UP TO SPEAK.
MY NAME IS BILLIE ZIMMERMAN, AND -- OH, SORRY, THANK YOU.
YOUR PEOPLE HAVE BEEN VERY HELPFUL TO ME.
I AM HERE REGARDING THE ZONING OF A VACANT PIECE OF LAND IN BEHIND THE DUPLEX THAT I OWN ON AVONDALE STREET.
SO YOU SHOULD HAVE, YOU KNOW, THE DIAGRAM.
OKAY? THE SHADED PART, WHERE THE DIAGONAL LINES ARE, IS ALL VACANT.
THERE'S A FEW CLUMPS OF TREES, BUT MOSTLY OPEN.
AND YOU WILL SEE THAT THIS -- AT THE TOP OF THE DIAGRAM IS ALSO UNDEVELOPED.
AND THEN ON THE EAST SIDE IS GULLY ED ROAD.
AND OVER THE OTHER SIDE OF THE SUBJECT PROPERTY FROM THERE, IS A SUBDIVISION PART OF HOLLAND HILLS SUBDIVISION.
SO THEN COMING UP AND DOWN GULLEY ED ROAD, THE NEXT STREET IS AVONDALE AVENUE, WHICH IS NAMED, AND THEN IT GOES DOWN TO CLARK.
SO THE PROPERTY THAT I OWN -- NO, WE'RE NOT READY YET.
THE ONE THAT'S MINE IS NUMBER 3.
SO THOSE NUMBERS THERE REFER TO PICTURES THAT I'M GOING TO SHOW YOU, SO YOU GET AN IDEA OF WHAT THIS IS LIKE.
NOW, DOWN AT THE END, ON THE LEFT, THERE'S A BIG EQUIPMENT YARD AND A FIREFIGHTERS UNION.
AND THEY HAVE A FENCE THERE AT THAT DOTTED LINE, THAT CLOSES OFF THAT END.
THE FENCE CONTINUES UP ACROSS THE VACANT STREET TO THE SOUTHERN BOUNDARY OF ACADEMY.
AND IT HAS STUDENTS THERE THAT THE PLAYGROUND COMES UP TO THAT VACANT AREA.
SO NOW, I WOULD LIKE TO TAKE YOU ON A LITTLE TOUR, AND YOU BEGIN TO REALIZE WHY I OPPOSE THIS.
IT'S BECAUSE WHEN THE SUBJECT PROPERTY IS -- IF IT IS DEVELOPED INTO A CAR WASH, WITH AN ENTRANCE ON THIS RESIDENTIAL STREET, THERE'S GOING TO BE A LOT MORE TRAFFIC COMING AND GOING.
THE RESIDENTS' RIGHTS ON BOTH SIDES OF AVONDALE ARE GOING TO BE INTERFERED WITH, THE PEACEFUL ENJOYMENT OF THEIR HOMES BECAUSE THERE'S MORE ACTIVITY, MORE TRAFFIC AND MORE NOISE AT ALL TIMES OF THE DAY AND NIGHT.
THEY'LL ALSO BE AT GREATER RISK, SECURITY RISK TO THE BACKYARDS OF THEIR HOUSES.
AND THEIR PROPERTY VALUES WILL BE DIMINISHED.
AT THIS TIME I MOVE FOR CONTINUANCE TO MARCH -- I'M SORRY, TO OCTOBER 4TH.
>> THANK YOU FOR THE MOTION FOR CONTINUANCE UNTIL OCTOBER 4TH.
THAT'S BECAUSE LIKE MISS ZIMMERMAN AND OTHERS, INCLUDING JUBILEE, THEY HAVE VOICED SOME OPPOSITION TO THIS.
AND SOME OF THE CONCERNS THAT WE ARE STILL WORKING THROUGH, TO HAVE -- IT'S A 24/7 OPERATION WITH VACUUMS THAT ARE GOING TO BE PLACED RIGHT NEXT TO A RESIDENTIAL AREA.
SO THERE ARE STILL THINGS THAT NEED TO BE WORKED OUT.
SO WE HAVE A MOTION AND A SECOND FOR CONTINUANCE UNTIL OCTOBER 4TH.

JAMES HARNISH? PRESIDENT OF THE NEIGHBORHOOD ASSOCIATION.
YOU HAVE THREE MINUTES, MR. HARNISH.
>> GOOD AFTERNOON, COUNCIL MEMBERS.
I AM THE PRESIDENT OF THE NEIGHBORHOOD ASSOCIATION, AND WE DO SUPPORT THIS ZONE CHANGE, THIS ALTERATION.
IT HAS LOOKED LIKE THIS FOR MANY YEARS.
THAT IS A PICTURE FROM 2014 -- OR 2004.
MR. MARTINEZ, WHO OWNS THE RESTAURANT NEXT DOOR, HAS USED THIS AS A LOT, AS WELL AS OTHERS, AND IT'S BEEN UGLY AND DUSTY, MUDDY NOW, DUSTY WHEN IT DOESN'T RAIN, AND ALWAYS AN EYESORE.
WE WERE HAPPY TO LEARN THAT MR. MARTINEZ HAS APPLIED FOR THIS ZONE CHANGE SO THAT HE CAN CONSTRUCT A GOOD LOOKING, PAVED, WELL-LANDSCAPED PARKING LOT THAT WOULD BE JUST FINE WITH US.
THERE IS, THOUGH, THE QUESTION IN MY MIND OF THE -- OF HOW FAST THAT MIGHT HAPPEN.
SO MR. MARTINEZ DID SIGN A LETTER OF AGREEMENT, OR WHAT'S THIS CALLED, LETTER OF INTENT, WHICH I'D LIKE TO BE FILED WITH THE CASE, THAT HE WILL, OF COURSE, FOLLOW ALL THE -- NOT THE ZONING, BUT THE BUILDING CODES AND ALL THE OTHER THINGS THAT HE MUST.
BUT HE ALSO MUST REPORT TO ME EVERY 60 DAYS ABOUT HIS PROGRESS TOWARD FUNDING TOWARD GETTING PERMITS AND THE ACTUAL CONSTRUCTION.
AND WE WILL FOLLOW THAT CLOSELY.
WE DON'T WANT IT LOOKING LIKE THIS PICTURE, JUST WITH THIS ZONE CHANGE, IT'S A NECESSARY STEP, BUT IT MIGHT NOT BE QUITE SUFFICIENT TO GET THIS TO HAPPEN.
SO WE SUPPORT THIS ZONE AMENDMENT.
AND WITH WHOM DO I LEAVE THIS?
>> VIAGRAN: WE'LL HAVE THE CITY CLERK --
>> VIAGRAN: THANK YOU, MR. HARNISH.
>> BROCKHOUSE: THANK YOU, MA'AM.
I MOVE FOR APPROVAL OF P-5, Z-19, WITH 75% IMPERVIOUS COVER AS THE STATED CONDITION WAS READ.
>> VIAGRAN: WE HAVE A MOTION AND A SECOND FOR P-5, Z-19, WITH THE

HEIGHT RESTRICTION OF THREE STORIES FOR THE OFFICE, 106 NOTICES MAILED, 44 IN FAVOR AND 19 OPPOSED.
OAK PARK NORTHWOOD NEIGHBORHOOD ASSOCIATION IS IN FAVOR.
>> VIAGRAN: COUNCIL MEMBER PERRY? OH, I'M SORRY.
WE HAVE ONE SPEAKER, ASHLEY FAIRMONT.
I'M HERE ON BEHALF OF THE APPLICANT IN THIS CASE.
WE'VE BEEN WORKING ON THIS CASE FOR QUITE SOME TIME, WORKED EXTENSIVELY WITH SURROUNDING NEIGHBORS IN THE NEIGHBORHOOD ASSOCIATION.
AS PART OF THOSE EFFORTS WE CAME TO SOME CONDITIONS THAT EVERYONE IS AGREEABLE TO FOR THE FUTURE DEVELOPMENT OF THE PROPERTY.
THEY INCLUDE THAT BUILDINGS FRONTING ON BROADWAY CANNOT EXCEED SIX STORIES, OR 75 FEET IN HEIGHT.
MULTI-FAMILY UNITS FACING NOTTINGHAM OR NACOGDOCHES NOT OVER 30 FEET IN HEIGHT.
AND EVERYBODY AGREES NOT TO PURSUE ZONING CHANGES THAT WOULD INCREASE THE OVERALL MULTIFAMILY UNITS TO MORE THAN 223 UNITS.
AS PART OF THAT, WE DO HAVE RESTRICTIVE COVENANTS THAT I'LL ENTER INTO THE RECORD.
WE WOULD JUST REQUEST YOUR SUPPORT OF THE ZONING CHANGE.
>> VIAGRAN: THANK YOU, MISS FAIRMONT.
ASHLEY, COULD YOU COME BACK UP HERE FOR A MOMENT? SO, YES, THIS HAS BEEN GOING ON FOR AWHILE.
AND IT DID CREATE A STIR UP IN THAT AREA.
BUT AS YOU SAID, Y'ALL HAVE WORKED WITH THE NEIGHBORHOOD ASSOCIATION.
THERE WAS A PETITION DRIVE THAT WAS ORGANIZED BY SEVERAL PEOPLE.
WHAT HAPPENED TO THAT PETITION DRIVE, AND THE INDIVIDUALS THAT ORGANIZED THAT?
SO, WITH OAK PARK NORTHWOOD NEIGHBORHOOD ASSOCIATION, THEY HAVE VOTED IN SUPPORT OF THIS ZONING CHANGE.
THERE WERE SOME PROPERTY OWNERS WHO OWNED, YOU KNOW, WITHIN THE 200 FEET AND NEARBY, AND THEY DID HAVE A PETITION DRIVE.
WE'VE HAD MULTIPLE MEETINGS, AND THAT'S HOW WE CAME TO THESE COVENANTS, CERTAIN AGREEMENTS ON THE UNIT COUNT, BUILDING HEIGHT.
YOU KNOW, THERE WERE REQUESTS THAT BUILDINGS FRONTING TOWARDS THE SINGLE-FAMILY HOMES BE LESSER IN HEIGHT.
THAT'S WHERE THE THREE STORIES CAME FROM.
AND THEN THERE WERE CONCERNS ABOUT OVERALL HEIGHT ON THE PROPERTY, SO THAT'S WHERE THE SIX STORIES CAME FROM.
SO I THINK, YOU KNOW, WE'VE WORKED HARD WITH THOSE NEIGHBORS, AND I THINK THAT THEY'RE AT LEAST CONTENT WITH THIS, AND THEY'RE OKAY WITH THE ZONING CHANGE.
>> PERRY: ARE THEY STILL ACTIVE WITH THIS PETITION DRIVE? OR DID THEY DROP IT?
>> THERE'S NO MORE PETITION DRIVE.
I KNOW JOHN KIRK IS HERE TODAY.
HE DID MEET WITH A COUPLE OF THE NEIGHBORS YESTERDAY JUST TO CONFIRM THAT THEY WERE OKAY WITH THE CONDITIONS AS AGREED TO.
TELL ME ABOUT THE TRAFFIC SITUATION.
I ACTUALLY HAVE A PRESENTATION.
I DON'T KNOW IF THEY CAN PULL THAT UP.
SO HERE'S AN EXHIBIT HERE SHOWING THE EXTENSIVE AMOUNT OF TRAFFIC IMPROVEMENTS THAT WOULD BE DONE FOR THIS PROPERTY, AS PART OF THE DEVELOPMENT.
AND SO THAT'S A LITTLE BIT DIFFICULT TO READ.
SIGNAL IMPROVEMENTS IN TERMS OF TIMING.
THERE WOULD ALSO BE LANE ADDITIONS.
BROADWAY IS CURRENTLY ONLY FOUR LANES, WE'RE ADDING AN ADDITIONAL FIFTH LANE.
AND A RIGHT TURN LANE TURNING ONTO NACOGDOCHES.
AND THE SIGNIFICANT CHANGES, THERE'S ALSO QUESTIONS ABOUT PEDESTRIAN IMPROVEMENTS.
NACOGDOCHES AND NOTTINGHAM, EXCUSE ME.
WE'RE WORKING ON HOW WE CAN IMPROVE THAT INTERSECTION FOR PEOPLE WALKING IN THE AREA.
ALSO, THERE WILL BE THE TEN-FOOT MULTI-USE PATH SURROUNDING THE PROPERTY.
AND THOSE ARE KIND OF THE MAJOR HIGHLIGHTS.
BUT WE'RE WORKING ON THE TRAFFIC.
AND THAT'S ALL THE QUESTIONS I HAVE.
I JUST WANT TO LET EVERYBODY KNOW, THIS WAS A DIFFICULT ONE,
[02:05:01]
BUT I REALLY THANK THE DEVELOPER FOR GOING OUT AND WORKING DIRECTLY WITH THE NEIGHBORHOOD.THOSE BEING AFFECTED AS WELL AS THE NEIGHBORHOOD ASSOCIATION.
LIKE I SAID, THIS WAS A DIFFICULT ONE.
BUT I REALLY WANT TO RECOGNIZE THE FACT THAT EXTRA CARE, EXTRA WORKING, A LOT OF EXTRA WORKING WITH THE NEIGHBORHOOD TO GET THIS THING THROUGH, AND GET APPROVAL FOR THIS, THROUGH THE ASSOCIATION, AND THE SURROUNDING NEIGHBORHOOD.
SO THANK YOU ALL VERY MUCH FOR WORKING AS HARD AS YOU HAVE, AND GETTING THIS TO WHERE THERE'S BEEN GREAT COMPROMISES, AND EVENTUAL APPROVAL ON THIS.
WITH THAT, MA'AM, I'D LIKE A MOTION TO APPROVE THIS, WITH CONDITIONS, YES.
>> VIAGRAN: WE HAVE A MOTION AND A SECOND FOR APPROVAL WITH CONDITIONS.
THAT'S ALL ON OUR ZONING AGENDA.
OUR ZONING AND COUNCIL MEETING HAS ADJOURNED.
HAVE A GREAT WEEKEND.
