WE HAVE A LOT OF COMMUNITY MEETINGS. WE HAVE PROBABLY ROUGHLY 7500 TO 10,000 INDIVIDUALS WHO PRACTICETAKE IN EVENTS -- PARTAKE IN EVENTS.
ONE OF THE CONCERNS WE HAVE RAISED TIME AND AGAIN WITH THE DEVELOPER IS THE ISSUE OF SMOKE COMING FROM THE RESTAURANT PLANNED FOR THE DEVELOPMENT THERE.
WE HAVE ASKED FOR A SCRUBBER TO BE INSTALLED. THEY HAVE USED THEM IN THE PAST. IN FACT, THEY USE IT IN THEIR AUSTIN LOCATION, AND WE HAVE NOT BEEN ABLE TO GET CONFIRMATION IN WRITING THEY WILL INSTALL THAT.
FOR US THIS IS A HEALTH ISSUE FOR NOT ONLY OUR STAFF BUT GUESTS.
IT'S A SAFETY ISSUE. WE EXPERIENCE WHAT WE KNOW IS PARKING ISSUES, BUT OUR PRIMARY CONCERN IS THE SMOKE THAT WILL BE COMING DIRECTLY ACROSS BECAUSE WE ARE GOING TO BE RIGHT ACROSS, IF YOU LOOK AT THAT MAP, RIGHT ACROSS THE STREET FROM THIS PARTICULAR ESTABLISHMENT. I WOULD LIKE TO CALL TO YOUR ATTENTION THE FACT THIS CAME UP AT THE SAME GROUP'S FACILITY IN AUSTIN, AND THEY ENDED UP BEING SUED BY INDIVIDUALS WHOSE HOUSES WERE RUINED BY THE SMOKE AND EVENTUALLY THEY INSTALLED THE VERY SCRUBBERS THAT WE'RE ASKING FOR.
SUBSEQUENTLY ONE OF THE BROTHERS WHO IS A PRINCIPAL IN THIS ORGANIZATION POSTED ONLINE A LAUDTORY DESCRIPTION OF HOW WONDERFUL THEIR SCRUBBERS WERE, HOW WONDERFUL AND SUCCESSFUL THEY WERE AND WEREN'T A PROBLEM.
BUT SOMEHOW WHAT WAS GOOD ENOUGH FOR AUSTIN ISN'T GOOD ENOUGH FOR SAN ANTONIO.

I'M HAPPY TO SEE DEVELOPERS WORKING ALONGSIDE DISTRICT 2 NEIGHBORS. THIS CASE REQUIRES SUPER MAJORITY FOR APPROVAL BECAUSE THE ALAMO COMMUNITY COLLEGE HAS REGISTERED OPPOSITION AND I AM SYMPATHETIC TO THEIR CONCERNS.
I LOVE A RACK OF RIBS, BUT I'M NOT SURE I WOULD WANT TO SMELL BARBECUE EIGHT HOURS A DAY AND I UNDERSTAND THE CONCERNS ABOUT AIR QUALITY. MY STAFF HAS TALKED WITH THEM AND THEY'VE MADE IT CLEAR THEIR OPPOSITION MAINLY RESTS TO A LACK OF COMMITMENT ON A SCRUBBER. ONE, THE APPLICANT HAS THE LEGAL ABILITY TO OPEN A RESTAURANT ON THE PROPERTY. THE ZONING REQUEST CHANGE IS ONLY TO ALLOW FOR THE USE OF

AND REGARDLESS OF WHETHER WE APPROVE OR DENY, TERI BLACK'S HAS THE RIGHT TO OPEN A RESTAURANT AT THAT LOCATION AND I WANT TO EMPHASIZE THEY CAN DO THAT WITHOUT ANY OF THE CONDITIONS THE NEIGHBORHOOD WORKED HARD TO SECURE S SUCH AS PARKING, LIGHTING AND ALL THE OTHERS.I DON'T SEE IT BEING PRODUCTIVE FOR US OR ALAMO TO DENY THE REQUEST.
CAN THE APPLICANT CONFIRM THIS FOR THE RECORD? >> GOOD AFTERNOON, COUNCIL.
ASHLEY, ON BEHALF OF THE APPLICANT. YES, THE INFRASTRUCTURE FOR SCRUBBERS WILL BE INSTALLED. IT'S A COMMITMENT WE MADE TO THE NEIGHBORHOOD AND ALAMO COMMUNITY COLLEGES THAT IF THERE IS A NUISANCE CONCERN IN THE FUTURE, THE UTILITIES AND OTHER CONSTRUCTION WILL BE DONE IN A WAY THOSE SMOKERS CAN BE INSTALLED.
THE PROPOSED HOTEL, WHICH IS THE PURPOSE OF THE ZONING, WILL SEPARATE THE RESTAURANT FROM ALAMO COMMUNITY COLLEGE. SO IF ANYONE IS IMPACTED THE
FIRST PEOPLE WILL BE THE HOTEL GUESTS. >> MCKEE-RODRIGUEZ: TO MAKE SURE THE RESTAURANT IS NOT TO INSTALL A SMOKE SCRUBBER. I'LL POINT OUT TERI BLACK'S WAS AN INCENTIVE BECAUSE IT WOULD LIKELY IMPACT HOTEL RESTAURANTS AND THE ABILITY TO ATTRACT HOTEL CLIENTS AND PATRONS. I DON'T THINK IT'S EXAGGERATION TO SAY THE VIABILITY OF THE HOTEL DEPENDS ON THEM MITIGATING SMOKE.

THE NEIGHBORS WERE COMPLAINING ABOUT NOT JUST SMELLS BUT GREASE ON CARS, CLOTHES, HOMES AND IT SMELLED RANCID AND NEARLY IMPOSSIBLE TO GET OFF THE BUILDINGS AND THE GLASS. I ANTICIPATE YOU GUYS ARE GOING TO HAVE TO INSTALL A SCRUBBER AND I DON'T UNDERSTAND WHY YOU ARE NOT DOING THAT NOW.
I UNDERSTAND YOU ARE PUTTING IN THE INFRASTRUCTURE, BUT A SMOKE SCRUBBER ADAPTER, THOSE ARE REALLY CHEAP, THAT'S NOT MUCH. AND I'M LOOKING AT THE WEBSITE WHERE TERI BLACK'S THEMSELVES SAY, YOU KNOW, THEY ANSWER A QUESTION DO SCRUBBERS WORK, YEAH, THE SMOKE GOES IN AND COMES OUT STEAM.

THE CESAR CHAVEZ ASSOCIATION HAS BEEN WORKING TO BRING DEEPLY AFFORDABLE SENIOR HOUSING INTO THE AREA. THE IDZ ENSURES WE CAN PUT THAT MONEY INTO UNITS RATHER THAN PARKING SPOTS FOR CARS. THIS IS ON THE PROPOSED SILVER LINE SO WE'RE EXCITED TO SUPPORT THIS ITEM AND WITH THAT I MOVE TO APPROVE ITEM 18.
