>> CLERK: WE HAVE NO MEMBERS OF THE PUBLIC SIGNED UP TO SPEAK AT THIS MEETING.
[CONSENT AGENDA ]
>> VIAGRAN: COUNCILMAN WHYTE HAS JOINED US. WE ARE MOVING ON TO CONSENT AGENDA. FOR THE RECORD, PLEASE SHOW THAT COUNCILMAN WHYTE IS

HERE VIRTUALLY. ALL RIGHT. ITEMS 2 THROUGH 5 ARE FINAL INTERNAL AUDITS. AND THIS IS PART OF THE CONSENT AGENDA.DOES ANYONE WISH TO PULL AN ITEM FROM CONSENT FOR INDIVIDUAL CONSIDERATION? OKAY. IF NOT, IF THERE'S NO DISCUSSION, CAN I GET A MOTION TO APPROVE THE FINAL SOUTHWESTERLY AUDIT REPORTS ON THE CONSENT AGENDA?
I HAVE A MOTION. DO I HAVE A SECOND? >> COURAGE: I'LL SECOND IT
>> VIAGRAN: WE HAVE A MOTION AND A SECOND. THERE BEING NO FURTHER
DISCUSSION. ALL IN FAVOR SAY AYE. >>
>> VIAGRAN: ALL OPPOSED SAY NO. MOTION CARRIES.
[Pre-Solicitation High Profile Briefings ]
NOW WE'RE GOING TO MOVE ON TO OUR INDIVIDUAL ITEMS. AND THE FIRST IS ITEM 6.WE HAVE PRE-SOLICITATION HIGH PROFILE BRIEFING FOR INDIVIDUAL CONSIDERATION.
MADAME CLERK, PLEASE READ THE CAPTION FOR ITEM 6. >> CLERK: ITEM 6 IS A BRIEFING ON THE RELEASE OF A SOLICITATION FOR UP TO SIX CONTRACTS TO PROVIDE THE NEIGHBORHOOD AND HOUSING SERVICES DEPARTMENT WITH TEXAS CERTIFIED LEAD ABATEMENT CONTRACTOR SERVICES IN THE ESTIMATED TOTAL VALUE OF $6,500,000
FOR THE TWO YEARS WITH 3, ONE-YEAR OPTIONS TO RENEW. >> VIAGRAN: AND WE HAVE A
PRESENTATION. FLOOR IS YOURS. >> GOOD MORNING.
I'M VERONICA GONZALEZ, ASSISTANT DIRECTOR WITH NEIGHBORHOOD AND HOUSING SERVICES DEPARTMENT. THIS MORNING WE HAVE A PRE-SOLICITATION BRIEFING FOR PARTNERING WITH TEXAS CERTIFIED LEAD ABATEMENT CONTRACTORS TO PROVIDE LEAD SAFE AFFORDABLE HOUSING IN OUR COMMUNITY. THESE CONTRACTORS WILL BE RESPONSIBLE FOR REMEDIATING LEAD-BASED PAINT FROM HOMES PARTICIPATING IN NHSD'S HEALTHY HOMES PROGRAM. THE PROGRAM AIMS TO ADDRESS LEAD HAZARDS IN HOME THROUGH THE LEAD HAZARD REDUCTION GRANT. THIS WILL INCLUDE TWO-YEAR TERMS WITH AN OPTION TO EXTEND THREE ONE-YEAR OPTIONS.
WE ANTICIPATE IT TO COST A TOTAL OF $6.5 MILLION FOR THE TOTAL LIFE OF THE AGREEMENT. LEAD ABATEMENT IS THE PRIMARY SERVICE OF GREEN AND HEALTHY HOMES PROGRAMS AS WELL AS A COMMON FUTURE OF OUR HOME REHAB PROGRAM FOR HOMES CONSTRUCTED PRIOR TO 1978. THESE CONTRACTORS WILL BE FUNDED TO INCLUDE HUD GRANTS AS WELL AS GENERAL AND BOND FUNDING.
CURRENT CONTRACTS WITH CERTIFIED LEAD ABATEMENT CONTRACTORS EXPIRE AT THE END OF THIS YEAR BUT WILL BE EXTENDED UNTIL MARCH 2025 TO MITIGATE ANY GAP IN THE SERVICES. THESE CONTRACTS WILL REQUIRE EXPERIENCE WITH ENVIRONMENTAL STANDARDS BOTH NATIONALLY AND AT THE STATE LEVEL.
CONTRACTORS WILL REQUIRE CERTIFICATION AT THE STATE LEVEL IN LEAD MITIGATION TO ENSURE PROPER COMPLIANCE WITH CONTRACTUAL DELIVERABLES AND THAT IN AUDIO] LEAD REMEDIATION. CONTRACTORS MUST BE VERSED IN ENVIRONMENTAL LEAD ABATEMENT AND BUILDING REPAIR EXPERIENCE TO BE QUALIFIED TO EXECUTE GREEN
[00:05:02]
AND HEALTHY HOME SMALL-SCALE REPAIRS AND LEAD MITIGATION SERVICES.IN ADDITION TO ADVERTISING LISTED ON THIS SLIDE, OVER 600 VENDORS WILL BE NOTIFIED ABOUT THE SOLICITATION OPPORTUNITY. AN EVALUATION PANEL COMPOSED OF MEMBERS FROM THE CITY MANAGER'S OFFICE, NHSD, PUBLIC WORKS, AND DEVELOPMENT SERVICES WILL REVIEW PROPOSALS. THE PANEL WILL ALSO BE SUPPORTED WITH ADVISORY ADVISORY MEMBERS.
THE SCORING PROCESS WILL BE EVALUATED OUT OF A POSSIBLE 100 POINTS AT 45 POSSIBLE POINTS, THE LARGEST CRITERIA FOR RESPONDENTS ARE EXPERIENCE, BACKGROUND, AND QUALIFICATIONS. THIS ENSURES LEAD CONTRACTORS HAVE PRIOR SUCCESS PROVIDING LEAD SAFE AFFORDABLE HOUSING IN OUR COMMUNITY.
ALSO WORTH A COLLECTIVE 35 POINTS ARE THE PLANS TO ENSURE SAFETY AT THE JOB SITE. NEXT, RESPONDENTS CAN EARN UP TO 15 POINTS UNDER THE PRICING EVALUATION CRITERIA. PROPOSALS WILL BE EVALUATED FOR VETERAN OWNED SMALL BUSINESS PREFERENCE POINTS. I'LL ALSO MENTION THAT FEDERAL REGULATIONS DO NOT ALLOW US TO APPLY LOCAL PREFERENCE TO OUR SOLICITATIONS.
THEREFORE SBEDA AND LOCAL PREFERENCE PROGRAMS DO NOT CURRENTLY APPLY TO THESE RFPS. AFTER TODAY'S PRE-SOLICITATION BRIEFING WE PLAN TO RELEASE THE RFP ON OCTOBER 23 WITH A SUBMISSION DEADLINE OF DECEMBER 9.
WE PLAN A RETURN TO THIS AUDIT COMMITTEE FOR A POST-SOLICITATION BRIEFING FEBRUARY 11 WITH CITY COUNCIL CONSIDERATION FORECASTED FOR MID-FEBRUARY.
THAT CONCLUDES MY PRESENTATION AND I'LL ANSWER ANY QUESTIONS YOU MIGHT
HAVE. >> VIAGRAN: THANK YOU, VERONICA.
SO MY QUESTION IS THE CURRENT CONTRACT STATUS EXPIRES THE 31ST OF THIS YEAR. SO DO WE HAVE PROJECTS LINED UP BETWEEN THIS TIME AND THE
NEW VENDORS THAT WE'RE PLANNING TO GET FOR THIS? >> YES.
TWO-PART ANSWER TO YOUR QUESTION. ONE, WE WANT TO KEEP MITIGATING ANY GAP IN SERVICES BECAUSE THERE ARE PROJECTS THAT ARE NOT JUST PART OF THE LEAD ABATEMENT BUT ALSO SMALL-SCALE REPAIRS ASSOCIATED WITH HOMES, HOUSING STOCK BEFORE 1978. THAT'S VERY COMMON, ESPECIALLY IN SAN ANTONIO AND BEXAR COUNTY. SO THAT WILL CONTINUE FOCUS ON THOSE HOMES THAT ARE PART OF OUR MINOR REPAIR, OUR MAJOR REPAIR, OR BOND PROJECTS SO THAT WORK CONTINUES IN OUR COMMUNITY TO KEEP, ESPECIALLY HOMES WITH CHILDREN, SAFE.
>> VIAGRAN: SO WE ARE LOOKING FOR SIX VENDORS? >> YES.
WE ARE FORECASTING SIX CONTRACTORS. >> VIAGRAN: SIX CONTRACTORS. IS THAT ENOUGH CONTRACTORS FOR THE PROGRAMS WE HAVE?
>> WE CAN TAKE MORE BUT WHAT WE HAVE REALIZED HISTORICALLY, IT'S VERY NUANCED EXPERIENCE AND QUALIFICATIONS TO QUALIFY TO BE THIS TYPE OF TEXAS CERTIFIED LEAD ABATEMENT CONTRACTOR. IT'S A VERY NICHE BACKGROUND AND WE'RE HAPPY TO BRING ON ANY CONTRACTORS OUTSIDE OF SAN ANTONIO BUT THAT'S
AROUND THE NUMBER WE HAVE SEEN RESPOND IN THE PAST. >> VIAGRAN: AND THEN ARE THESE -- I KNOW WE'RE NOT THE COUNTY BUT I KNOW THE COUNTY HAS PASSED THEIR BUDGET. DO THEY HAVE A SIMILAR PROGRAM AND ARE THEY GOING TO BE USING THE SAME CRITERIA WE ARE TO FIND VENDORS?
>> I'M NOT FAMILIAR WITH THE COUNTY PROGRAM BUT I COULD REITERATE THAT OUR PROGRAM FOCUSES ON 80% AMI OR BELOW. SO HELPING VULNERABLE FAMILIES THAT QUALIFY AND WHO HAVE CHILDREN IN THEIR HOME OR HOMES PRIOR TO 1978 THAT WERE CONSTRUCTED.
>> VIAGRAN: OKAY. >> BEFORE LEAD-BASED PAINT WAS MADE ILLEGAL.
>> VIAGRAN: ALL RIGHT. BECAUSE AND THEN I DON'T KNOW BEN OR TROY, IF WE COULD SEE HOW THE COUNTY IS DOING AND HOW THEY'RE MOVING FORWARD, ESPECIALLY FOR THOSE AREAS THAT WE SIT IN THE LINE BETWEEN THE COUNTY, MY DISTRICT, IN PARTICULAR, PARTS OF DISTRICT 6, DISTRICT 4, DISTRICT 2 IS IF THEY ARE PARTICIPATING IN A PROGRAM LIKE THIS OR IF WE CAN ENCOURAGE THEM FOR THE HOMES THAT THEY HAVE.
BUT THANK YOU. I LOOK FORWARD TO SEEING YOU BACK HERE IN FEBRUARY.
PLEASE JUST KEEP US UPDATED IF IT LOOKS LIKE IT IS GOING TO SLOW DOWN ANY.
BECAUSE WE DO WANT TO MAKE SURE THAT WE HAVE THE VENDORS AVAILABLE FOR THE PROJECTS THAT WE'LL NEED. DO I HAVE ANY DISCUSSION? COUNCILMEMBER COURAGE.
>> COURAGE: THANK YOU, CHAIR. ARE WE USING MULTIPLE WAYS OF IDENTIFYING PROPERTIES THAT WE CAN ASSIST? I KNOW WE'RE LOOKING AT
[00:10:03]
HOUSES THAT NEED SMALL REPAIR, MINOR REPAIRS AND OTHERS THAT NEED MAJOR REPAIRS. BUT ARE WE LOOKING AT JUST OTHER PEOPLE IN THE COMMUNITY WHO MIGHT COME TO US AND SAY WE THINK WE HAVE LEAD AND PAINT, OUR HOUSE IS85 YEARS OLD OR SOMETHING? >> YES. OUR GREEN AND HEALTHY HOME PROGRAM IS TWO PARTS . IT'S NOT JUST THE LEAD ABATEMENT OR EVEN THE MITIGATION, WHETHER IT'S SPECIALIZED CLEANING OR PAINTING OVER THE LEAD PAINT, DEPENDING ON THE HOME. THE SECOND PART IS ALSO OUTREACH. WE HAVE BEEN VERY SUCCESSFUL AT LEVERAGING THAT OUTREACH WITH DIFFERENT PARTNERS IN OUR COMMUNITY, INCLUDING METRO HEALTH OR PRE-K 4 SA.
WE TRY TO IDENTIFY WHERE ARE THOSE CHILDREN THAT MAY HAVE THE ELEVATED LEAD BLOOD LEVEL AND THAT DEFINITELY DOES NOT STOP US FROM MAKING SURE THAT THEY GET THE HELP THEY NEED. OF COURSE, THEY STILL GO THROUGH THE APPLICATION PROCESS BECAUSE OF THE 80% AMI REQUIREMENT BUT WE ARE NOT JUST SOLELY FOCUSED ON
THE REHAB OUTREACH. >> COURAGE: WHAT ABOUT LEAD PIPES DELIVERING WATER? ARE THOSE COVERED BY THIS GRANT OR WOULD THAT TAKE ANOTHER EFFORT TO MITIGATE
THAT? >> YEAH. I WOULD HAVE TO DOUBLE CHECK THE RFP SCOPE. THERE'S A LOT OF SPECIFIC LINE ITEMS AS PART OF OUR
PRICE SCHEDULE SO I CAN CONFIRM THAT WITH YOU. >> COURAGE: THERE'S A DIFFERENCE BETWEEN A PAINTER AND A PLUMBER AND I WANT TO MAKE SURE IF WE'RE GETTING SIX CANDIDATES TO DO THIS, WE CAN ADDRESS LEAD PIPES THAT STILL EXIST IN OLD HOMES THAT WE CAN MITIGATE THOSE AS WELL OR FIND ANOTHER SOURCE TO DO THAT.
>> OUR SENIOR ENVIRONMENTALIST IS BACK THERE AND HE SHARED WE DON'T
ADDRESS THAT. >> COURAGE: OKAY. I'D LIKE TO KNOW IF THERE'S A WAY FOR US TO EXPLORE THAT. IF WE'RE LOOKING AT LEAD PAINT, I WOULD LIKE TO SEE US LOOK AND MAKE SURE THERE AREN'T LEAD PIPES THAT EXIST IN THOSE SAME HOMES. THAT'S JUST AS CRITICAL, IF NOT MORE SO.
>> UNDERSTOOD. >> COURAGE: I WOULD LIKE TO HEAR MAYBE THIS COMMITTEE GET A LITTLE MORE INFORMATION ABOUT THAT OR, YOU KNOW, JUST SO WE UNDERSTAND WE'RE ADDRESSING AS MUCH OF THE PROBLEM AS WE CAN IN THAT AREA.
>> UNDERSTOOD. >> COURAGE: THANK YOU. THANK YOU, MADAME CHAIR.
>> VIAGRAN: THANK YOU, COUNCILMAN. MAYBE WE CAN ADDRESS IT WITH SAWS ALSO AND HAVE YOUR COMMITTEE HELP US WITH THAT. REPRESENTATIVE TREVINO, ANY QUESTIONS? COUNCILMEMBER WHYTE, ANY QUESTIONS? ALL RIGHT. AND THIS WAS FOR BRIEFING ONLY SO NOW WE'LL MOVE ON TO
[Post-Solicitation High Profile Briefings ]
ITEM 7. WE HAVE FOUR POST-SOLICITATION BRIEFINGS FOR INDIVIDUAL CONSIDERATION. MADAME CLERK, PLEASE READTHE CAPTION FOR ITEM 7. >> CLERK: ITEM 7 IS AN APPROVAL TO PROCEED WITH THE SCHEDULING OF TWO CONTRACTS FOR CITY COUNCIL CONSIDERATION TO PROVIDE THE AVIATION DEPARTMENT WITH JOB ORDER CONTRACT SERVICES FOR VARIOUS PROJECTS FOR THE CITY OF SAN ANTONIO AIRPORT. SERVICES INCLUDE INCIDENTAL DEMOLITION, CONSTRUCTION REPAIR, REHABILITATION, ALTERATION, AND DEFERRED MAINTENANCE ON SAN ANTONIO AIRPORT SYSTEM OWNED AND LEASED BUILDINGS OR OTHER FACILITIES OF INTEREST TO THE AIRPORT IN THE ESTIMATED TOTAL VALUE OF UP TO $30 MILLION FOR AN INITIAL
TWO-YEAR TERM WITH THREE ONE-YEAR OPTIONS TO RENEW. >> VIAGRAN: CAN WE GET THE
STAFF PRESENTATION? >> GOOD MORNING. SAM RODRIGUEZ HERE TO PRESENT ON BEHALF OF DIRECTOR JESUS SAENZ. THIS IS A POST-SOLICITATION BRIEFING ON JOB ORDER CONTRACT. THE JOB ORDER CONTRACTS ARE INTENDED TO BE IMPLEMENTED WITH PROJECTS THAT HAVE BEEN APPROVED WITH THE AIRPORT'S CAPITAL IMPROVEMENT PLAN FOR SPECIFIC PROJECTS WITHIN THE TERMINAL OR PARKING FACILITIES, STINSON AIRPORT AND OTHER BUILDINGS THROUGHOUT THE CAMPUS.
THE CONTRACT IS INTENDED TO BE FOR $30 MILLION CONTRACTS.
WE DO HAVE FUNDING SOURCES FOR THE CONRAC, POTENTIAL GRANTS ON THESE PROJECTS, AIRPORT FUNDING, AS WELL AS PFC FUNDING FOR THE AIRPORT WE ARE RECOMMENDING THE AWARD OF TWO VENDORS. THERE WAS NINE SOLICITATIONS THAT WERE SUBMITTED, FIVE DEEMED NON-RESPONSIVE FOR FAILURE TO SUBMIT REQUIRED DOCUMENTS FOR DBE GOALS, WHICH HAD BEEN ESTABLISHED AT 17%. WE ARE RECOMMENDING TWO BECAUSE OF THE BREAK OFF IN TERMS OF THE SCORING BEING SO FAR APART BETWEEN VENDORS TWO AND THREE. THE DUE DILIGENCE ON THE SOLICITATION, THERE WAS 1500 VENDORS SOLICITED, 18 ATTENDED A PRE-SOLICITATION CONFERENCE.
AS I STATED, NINE SUBMITTED, FIVE DEEMED NON-RESPONSIVE AND THERE WERE NO MATERIAL
[00:15:03]
FINDINGS FOR BOTH FINDINGS AND DUE DILIGENCE REVIEWS. I'LL BE HAPPY TO ANSWER ANYQUESTIONS. >> VIAGRAN: OKAY. SO I GUESS MY ONE QUESTION
IS WE WERE LOOKING FOR HOW MANY VENDORS? >> ORIGINALLY THE INTENT WAS FOR THREE VENDORS AT $10 MILLION EACH. WE ARE RECOMMENDING TWO AT
$15 MILLION EACH. >> VIAGRAN: I SEE THE DIFFERENCE IN SCORING BETWEEN VENDOR B AND VENDOR C. HOPEFULLY AFTER WE TAKE THIS TO COUNCIL WE CAN DIG DEEPER EITHER IN THIS COMMITTEE OR ECONOMIC WORKFORCE DEVELOPMENT AND SEE WHAT SOME OF THE CONCERNS WERE BETWEEN THE TWO VENDORS .
BUT THAT IS ALL I HAVE HERE. THIS WILL NOT -- THIS WILL KEEP US ON OUR TIMELINE FOR THE AIRPORT CONSTRUCTION WITH THESE CONTRACTS, CORRECT?
>> CORRECT. THESE ARE INTENDED FOR SOME OTHER REMODEL PROJECTS THAT WE HAVE. TERMINAL A HAD WORK THAT NEEDS TO BE COMPLETED.
THAT'S UNDER DESIGN. WE HAVE A LIGHTING PROJECT IN OUR PARKING FACILITIES, THAT WILL BE CONTRACTED THROUGH THIS CONTRACT AS WELL.
IT'S NOT THE BIG TERMINAL DEVELOPMENT PROGRAM. THESE ARE SOME OF THE
SMALLER PROJECTS WE HAVE ON OUR CAMPUS. >> VIAGRAN: THAT WE CAN'T
KIND OF IGNORE WHILE WE'RE DOING THE MAJOR PROJECTS. >> CORRECT.
>> VIAGRAN: THANK YOU. DO ANY OF MY COMMITTEE MEMBERS HAVE QUESTIONS?
COUNCILMAN COURAGE. >> COURAGE: THANK YOU. I'D LIKE TO TRY AND UNDERSTAND WHY FIVE WERE DEEMED NONRESPONSIVE. CAN YOU GIVE ME A LITTLE BIT
OF INFORMATION ABOUT THAT? THAT SEEMS MORE THAN HALF. >> CORRECT.
SO THE SOLICITATION WAS PRESENTED WITH A DBA GOAL OF 17%.
THE DB GOAL IS A REQUIREMENT OF THE CONTRACT AND YOU'RE EITHER REQUIRED TO PROVIDE THE DOCUMENTATION THAT YOU'LL MEET THAT GOAL OR THAT YOU'LL PROVIDE GOOD-FAITH EFFORT DOCUMENTATION TO MEET THE GOAL MOVING FORWARD AS PART OF THE CONTRACT. THE FIVE DEEMED NONRESPONSIVE FAILED TO
ADDRESS THE DBA GOAL OF THE CONTRACT ALL TOGETHER. >> COURAGE: THAT WAS EXPLAINED TO THEM WHEN THEY WENT TO THE SUBMITTAL CONFERENCE, RIGHT?
>> THAT IS CORRECT. >> COURAGE: THANK YOU. >> SO ALONG THOSE LINES WITH THE QUESTION, BUT HERE ON THE SCORING ON PAGE 3 YOU'VE GOT ZERO FOR VENDOR C.
DOES THAT MEAN THEY JUST DIDN'T MEET THE 17%? WHAT DOES THAT MEAN? AND THE OTHERS HAVE TEN. COULD YOU GIVE US AN EXPLANATION ON THAT?
>> CORRECT. THE VENDORS THAT RECEIVED THE TEN ARE INTENDED TO MEET THE DBA REQUIREMENT. THE VENDOR C SUBMITTED THE VERBIAGE OR THE GOOD-FAITH EFFORT TO MEET THE REQUIREMENT. THEY'RE NOT GOING TO BE ABLE
TO MEET THE GOAL. THAT'S HOW IT WAS GRADED. >> SO THEY'RE ABLE TO MEET THE GOAL OF 17 -- IS BARBARA HERE? I'M GOING TO ASK OUR DBA LIAISON TO COME UP.
>> TEN POINTS WERE FOR SUBMITTING A NARRATIVE STATEMENT DESCRIBING WHO'S ON THEIR TEAM AND HOW THEY'RE MEETING THE GOAL. THE PERCENTAGE. FOR MEETING THE 17% GOAL.
YOU GET TEN POINTS IF YOU MEET THE GOAL AND TEN POINTS IF YOU SUBMIT A NARRATIVE
STATEMENT. >> BUT THEN WHAT IF THE OTHERS COULD HAVE DONE THE SAME AND NOT MET THE GOAL? SO THE THREE THAT HAVE THE TEN POINTS DON'T EVEN MEET THE GOAL?
>> REGARDING THE GOAL, IT'S PASS OR FAIL ON MEETING THE GOAL.
SO YOU HAVE TO SUBMIT YOUR REQUIRED DOCUMENTATION SHOWING YOU'RE GOING TO MEET THE GOAL. IF YOU DON'T DO THAT, YOU DON'T PASS.
YOU DON'T MOVE FORWARD. THOSE FIVE DIDN'T MOVE FORWARD.
>> HENCE I WOULD THINK VENDOR C WOULD NOT HAVE MOVED FORWARD.
>> IF YOU PROVIDE GOOD-FAITH EFFORTS LIKE IF YOU SHOW THAT YOU TRIED TO MEET THE GOAL BY CONTACTING THEM, E-MAILING THEM BUT YOU JUST WEREN'T ABLE TO MEET IT.
LIKE YOU PROVIDE EXTRA DOCUMENTATION SHOWING WE TRIED TO MEET THE GOAL BUT WE DIDN'T HAVE ENOUGH PEOPLE THAT WANTED TO BE ON THIS PROJECT.
AND THEY PROVIDED ALL THAT INFORMATION, THEN YOU CAN STILL PASS AND MOVE FORWARD.
EVEN THOUGH THEY DIDN'T MEET THE GOAL, THEY PROVIDED DOCUMENTATION SHOWING THAT
THEY TRIED TO MEET THE GOAL. >> LET ME TRY TO HELP A LITTLE BIT.
SO IT'S A MULTIPLE-STEP PROCESS SIMILAR TO THE SBEDA PROGRAM.
YOU CAN REQUEST A WAIVER AND IF THAT WAIVER IS SATISFIED YOU CAN MOVE FORWARD AND PARTICIPATE BUT YOU WOULD HAVE MET THE SUBCONTRACTING GOAL.
THIS IS A SIMILAR PROCESS WITH DBE. YOU HAVE THE POINT STRUCTURE AND THEN YOU ALSO HAVE THE SUBCONTRACTING. YOU CAN ACTUALLY -- YOU MEET
[00:20:04]
IT OR YOU DON'T. AND THAT'S THE FIRST STEP. IF YOU DON'T MEET IT, THEN YOU ARE DEEMED NONRESPONSIVE, WHICH IS THE FIVE THAT WE HAD HERE.IF YOU PRESENT THE EQUIVALENT OF A GOOD-FAITH EFFORT AND HER TEAM REVIEWS THAT AND DETERMINES THAT EFFORT WAS MADE, THEY CAN MOVE FORWARD BUT THEY WILL
NOT BE AWARDED THE POINTS. >> SO YOU CAN ACTUALLY GO FORWARD AND PRESENT YOUR GOOD-FAITH EFFORT LIKE I TRIED TO REACH OUT TO ALL THESE PEOPLE TO SATISFY THE PERCENTAGE.
AND IF YOU WERE NOT SUCCESSFUL OR YOU COULD NOT DO THAT, YOU NEED TO PROVE THAT TO THE SMALL BUSINESS TEAM. IF THEY BASICALLY PROVE THAT THEY MADE AN EFFORT BUT WERE UNSUCCESSFUL THEN THEY CAN MOVE TO THE NEXT STEP BUT THEY WOULD NOT BE AWARDED THE POINTS. BECAUSE THEY DID NOT MEET THE PERCENTAGE. THEY MADE A GOOD-FAITH EFFORT AND THEY CAN MOVE ON TO THE SECOND PHASE BUT THEY WOULD NOT BE AWARDED THE POINTS.
IS THAT CORRECT? >> YES. THAT'S CORRECT.
>> IT'S VERY SIMILAR AND PARALLEL TO THE SBEDA PROGRAM.
>> THANK YOU. >> VIAGRAN: OKAY. COUNCILMAN WHYTE.
THANK YOU FOR THAT AND I THINK THAT'S ONE THING TO LOOK OVER IN TERMS OF THE DB IS EVEN IF THEY ALL GOT THE ZERO, WE WOULD STILL BE KIND OF IN THAT SAME ABC STANCE, CORRECT, IF WE TOOK THAT ONE OUT THEY WOULD STILL BE GRADED THE SAME?
>> YEAH. IF YOU REMOVED C FROM THE CALCULATION, THE STAFF
RECOMMENDATION WOULD STILL STAND WITH A AND B. >> VIAGRAN: OKAY.
ALL RIGHT. ALL RIGHT. YEAH, THAT'S WHAT I'M HOPING SUPPLY SA AND OTHERS WILL ADDRESS AS WE MOVE FORWARD IN TERMS OF HOW WE GET OUR SMALL BUSINESSES AND OUR MINORITY-OWNED BUSINESSES AND WOMEN-OWNED BUSINESSES READY TO PARTICIPATE IN THESE OPPORTUNITIES. ALL RIGHT.
IF THERE IS NO OTHER DISCUSSION, CAN I GET -- THIS IS TO MOVE FORWARD TO THE COUNCIL. CAN I GET A MOTION AND A SECOND TO APPROVE MOVING THE
CONTRACT TO FULL CITY COUNCIL? >> GET A LITTLE BIT MORE OF AN UNDERSTANDING OF HOW THIS PROCESS WORKS, MAYBE SEPARATELY AS MEMBERS OF THIS COMMITTEE. AND UNDERSTAND IF THERE ARE WAYS OF ADJUSTING THIS PROCESS THROUGH CITY PROCEDURES OR IF IT'S JUST ALL IN STONE BECAUSE OF FEDERAL REGULATIONS. BUT I MOVE IT FORWARD RIGHT
NOW. >> VIAGRAN: I HAVE A MOTION.
DO I HAVE A SECOND? I HAVE A MOTION AND A SECOND.
ALL IN FAVOR SAY AYE. >> MOTION CARRIES. OKAY. ITEM 8.
MADAME CLERK, PLEASE READ THE CAPTION. >> CLERK: ITEM NO. 8 IS APPROVAL TO PROCEED WITH SCHEDULING NINE CONTRACTS FOR CITY COUNCIL CONSIDERATION TO PROVIDE THE PUBLIC WORKS DEPARTMENT WITH JOB ORDER CONTRACT SERVICES FOR VARIOUS PROJECTS FOR THE CITY OF SAN ANTONIO. SERVICES INCLUDE INCIDENTAL DEMOLITION, CONSTRUCTION, REPAIR, REHABILITATION, ALTERATION, AND DEFERRED MAINTENANCE ON CITY-OWNED AND LEASED BUILDINGS OR OTHER FACILITIES OF INTEREST TO THE CITY IN THE ESTIMATED TOTAL VALUE OF $120 MILLION FOR AN INITIAL TWO-YEAR TERM
WITH THREE ONE-YEAR OPTIONS TO RENEW. >> VIAGRAN: ALL RIGHT.
LUIS, THE FLOOR IS YOURS. >> I'M LUIS, I'M ONE OF THE ASSISTANT DIRECTORS WITH PUBLIC WORKS. I THINK WE GOT THREE PRESENTATIONS FOR YOU THIS MORNING. THEY'RE ALL POST-SOLICITATION BRIEFINGS.
FIRST ONE IS THE JOB ORDER CONTRACTING PROGRAM. VERY SIMILAR TO WHAT YOU JUST HEARD FROM THE AVIATION DEPARTMENT. A LITTLE BIT OF THE OVERVIEW. VERY SIMILAR. THIS IS A COMPETITIVE SEALED PROPOSAL TO DO JOB ORDER CONTRACTING FOR VARIOUS PROJECTS THROUGHOUT THE CITY. THIS INCLUDES REHAB, DEMOLITION, BRAND-NEW CONSTRUCTION, REPAIRS. TYPICALLY USED BY OUR DEFERRED MAINTENANCE PROGRAM ON CITY-OWNED BUILDINGS, LEASED BUILDINGS, ANY OTHER FACILITIES THROUGHOUT THE CITY. AGAIN, IT'S A COMPETITIVE SEALED PROPOSAL.
TWO-YEAR TERM WITH THREE OPTIONS TO RENEW FOR ONE ADDITIONAL YEAR.
IT'S A $24 MILLION ANNUALLY FOR A TOTAL OF $120 MILLION FOR THE NEXT FIVE YEARS.
AND WE ARE LOOKING TO AWARD NINE DIFFERENT CONTRACTS. FUNDING SOURCES, THEY VARY.
AGAIN, THESE CAN BE BOND PROJECTS. THESE CAN BE DEFERRED MAINTENANCE. SO VARIOUS FUNDING SOURCES. OUR CURRENT CONTRACTS EXPIRE
[00:25:03]
IN FEBRUARY OF THIS COMING YEAR. YOU CAN SEE THE VALUATION SCORES WE'RE RECOMMENDING AN AWARD OF NINE OUT OF THE 16 RESPONDENTS.THE COMMITTEE MET ON SEPTEMBER 13 AND WE HAVE COMMITTEE MEMBERS FROM THE CITY MANAGER'S OFFICE, FROM BUILDING AND EQUIPMENT SERVICES, PARKS AND REC, PUBLIC WORKS, OFFICE OF SUSTAINABILITY, AND HUMAN SERVICES.
THOSE ARE TYPICALLY A LOT OF THE DEPARTMENTS THAT UTILIZE THESE CONTRACTS AND ARE PART OF THE SELECTION PROCESS. THESE ARE THE FIRST FOUR OUT OF THE 16 THAT WERE SUBMITTED. SUBCONTRACTING REQUIREMENTS, 24% MINORITY WOMEN BUSINESSES. 3% AFRICAN AMERICAN, AND THE LOCAL PREFERENCE AND THE VETERAN OWNED IS NOT APPLICABLE. HERE YOU SEE VENDORS FIVE THROUGH EIGHT. A LOT OF THE BIGGEST FACTORS FOR MAKING THESE SELECTIONS, OF COURSE EXPERIENCE OF THE RESPONDENTS, THEIR PAST PERFORMANCE, THEIR UNDERSTANDING OF THE JOB PROGRAM, AND THE MANAGEMENT PLAN.
THESE ARE THE NEXT GROUP OF VENDORS. AND THE LAST GROUP OF VENDORS AS WELL. SUBCONTRACTING GOALS ARE THE SAME.
SO THAT'S THE END OF THE PRESENTATION. OH, ONE MORE SLIDE.
434 AVAILABLE MATERIAL FINDINGS ON ANY OF THE DUE DILIGENCE. BE HAPPY TO ANSWER ANY
QUESTIONS. >> VIAGRAN: THANK YOU, LUIS.
I'LL START WITH THE COMMITTEE MEMBERS. ANY QUESTIONS?
>> CHAIR, CAN WE CLARIFY ONE THING REAL QUICK? THE DIFFERENCE BETWEEN SBEDA AND DB, UNDER DB, THE FEDERAL ONE, YOU CAN HAVE A SUBCONTRACTING GOAL AND HAVE POINTS ASSIGNED TO IT. UNDER SBEDA WE DON'T HAVE THAT HERE.
THE SUBCONTRACTING GOALS YOU SEE ON THE BOTTOM OF THE SLIDE, THAT'S SIMPLY PASS OR FAIL CAN COME UP AND GIVE YOU MORE INFORMATION ON THAT, BUT THAT IS ONE OF THE DIFFERENCES AND I THINK THAT'S PROBABLY PART OF WHAT MAY HAVE CAUSED A LITTLE BIT OF CONFUSION ON THE LAST ITEM IS WE DON'T TYPICALLY HAVE POINTS TIED TO A
SUBCONTRACTING GOAL, IS THAT RIGHT? >>
>> THAT'S ONE OF THE DIFFERENCES AND WE WILL FOLLOW-UP, COUNCILMAN COURAGE, AND GIVE YOU MORE INFORMATION ON THAT DBE PROGRAM.
>> VIAGRAN: THANK YOU. COUNCILMAN COURAGE. >> COURAGE: THANK YOU, MADAME CHAIR. HOW MANY OF THESE THAT WE'RE MOVING FORWARD IN THIS RECOMMENDATION HAVE DONE THIS WORK FOR THE CITY IN THE PAST?
HOW MANY OF THE ONES WE'RE RECOMMENDING? >> SIX.
SIX OUT OF THE NINE CURRENTLY HAVE A CONTRACT WITH THE CITY.
THREE OUT OF THE NINE ARE BRAND-NEW CONTRACTS. >> COURAGE: I WOULD IMAGINE ALL SIX OF THOSE HAVE COMPLETED THEIR WORK FOR THE CITY, HAS BEEN ON TIME, ON BUDGET, AND WE HAVEN'T HAD A LOT OF COMPLAINTS.
SO THAT'S WHY WE FEEL COMFORTABLE IN MOVING THEM FORWARD AGAIN.
>> ABSOLUTELY. THAT'S CORRECT. >> COURAGE: AND THE OTHER
THREE ARE NEW. >> ARE NEW BUT BASED ON THEIR PAST EXPERIENCE, THEIR QUALIFICATION, THEIR SUBMITTAL, WE BELIEVE THEY ARE QUALIFIED AS WELL.
>> COURAGE: DO WE LOOK AT PAST EXPERIENCE IF THEY DO SOMETHING FOR A SCHOOL DISTRICT OR ANOTHER FORM OF GOVERNMENT, LIKE A SMALL CITY OR SOMETHING LIKE THAT?
>> PART OF THE REQUIREMENT IS TO SUBMIT A PROJECT SHEET.
SO YOU'RE ABLE TO SEE THEIR PAST EXPERIENCE, WHETHER THOSE PROJECTS ARE ON BUDGET, ON SCHEDULE. WE DO HAVE THE AVAILABILITY TO CALL REFERENCES.
A LOT OF THESE AGENCIES, WE KNOW THEM. THEY ARE SCHOOL DISTRICTS,
OTHER MUNICIPALITIES, SO VERY EASY TO FOLLOW UP. >> COURAGE: OKAY.
I NOTICE WHEN WE GOT PAST NINE, THE OTHERS WERE PRETTY CLOSE, EVEN TO NUMBER NINE.
ARE WE GOING TO HEAR FROM ANY OF THE OTHERS THAT ARE GOING TO SAY, HEY, I WASN'T FAIRLY EVALUATED. HAVE WE HAD ANYBODY MOVE FORWARD AND SAY THAT SO FAR?
>> I DON'T KNOW IF ANYBODY HAS REACHED OUT TO FINANCE ASKING FOR A DEBRIEF BUT THEY DO HAVE THE OPTION TO REQUEST A DEBRIEF. EVERY TIME WE GO THROUGH THE SELECTION PROCESS WE WRITE NOTES, WE TALK ABOUT WHY WE SCORED THEM HIGH, WHY WE SCORED THEM LOW. SO THAT INFORMATION IS THERE.
HOPEFULLY THEY CAN IMPROVE THAT SUBMITTAL THE NEXT TIME AROUND.
>> COURAGE: OKAY. THAT'S GREAT. THANK YOU.
>> YOU'RE WELCOME. >> VIAGRAN: COUNCILMAN WHYTE.
>> WHYTE: YEAH. COUNCILMAN COURAGE REALLY TOUCHED ON MY QUESTIONS.
JUST TO CONFIRM ON THESE THREE NEW FOLKS, WE DID CALL AND CHECK IN THAT THESE
[00:30:08]
OTHER PROJECTS THAT THEY'VE DONE THAT ARE SIMILAR, THEY WERE ON TIME AND WERE ONBUDGET. WE CAN CONFIRM THAT? >> I CANNOT CONFIRM WHETHER THERE WAS A PHONE CALL MADE. EACH SELECTION COMMITTEE MEMBER HAS THE OPTION TO DO SO. THAT INFORMATION IS AVAILABLE.
WHETHER THEY CALLED OR NOT, I CANNOT CONFIRM. >> WHYTE: I DON'T KNOW IF
ANYBODY FROM THE FINANCE -- >> IT'S UP TO THE SELECTION COMMITTEE MEMBERS, CORRECT?
>> I'M SORRY. I MISSED PART OF THE QUESTION.
I WAS TALKING TO SOMEONE IN THE BACK. COULD YOU REPEAT IT,
COUNCILMAN WHYTE? I APOLOGIZE. >> WHYTE: YEAH.
I THOUGHT THAT I HEARD THAT, YOU KNOW, WE LOOKED INTO THESE THREE AND THEY HAVE DONE SIMILAR PROJECTS IN THE PAST AND WE WERE ABLE TO SEE WHETHER OR NOT THESE PAST PROJECTS WERE DONE ON TIME OR ON BUDGET OR THAT THAT INFORMATION WAS AVAILABLE TO US. I JUST WANTED TO KNOW IF WE COULD CONFIRM THAT THAT IS TRUE AND THAT THESE PAST PROJECTS THEY HAD DONE WERE DONE ON TIME AND ON BUDGET.
>> WE DID REFERENCE CHECKS ON THE THREE NEW -- OR ACTUALLY ALL OF THEM TO SEE HOW THEY PERFORM. AS LUIS WAS SAYING WE ALSO HAD A SAMPLE PROJECT THAT WAS SUBMITTED. THAT WAS ALSO EVALUATED BY THE TEAM.
IF I'M NOT MISTAKEN, WE ALSO HAD A THIRD PARTY IN AN ADVISORY COMMITTEE THAT HAD EXPERIENCE WITH JOCS EVALUATION THOSE SO GIVE SOME RECOMMENDATION AND
COMFORT AS WE MOVE FORWARD. >> WHYTE: [INDISCERNIBLE] OKAY.
THANKS. >> VIAGRAN: THANK YOU. I THINK THIS IS VERY INTERESTING AND I LOOK FORWARD TO THE NEXT FEW PRESENTATIONS ON WHO APPLIED AND WHAT THEY PERFORMED. I THINK IT IS VERY INTERESTING THAT THERE ARE SOME VENDORS THAT IN THE A THROUGH C SUBTOTAL ARE VERY HIGH BUT WHEN IT COMES TO SBEDA, THEY REALLY HAVEN'T CAUGHT ON TO WHAT THE CITY IS PRIORITIZING.
SO I'M REALLY LOOKING FORWARD TO SEEING THIS PRESENTED TO FULL COUNCIL WITH THE NAMES OF THE COMPANIES THAT WILL BE GETTING THESE JOB ORDER CONTRACTS. WITH THAT, IF I CAN GET A MOTION AND A SECOND FOR US TO MOVE THIS FORWARD. I HAVE A MOTION. DO I HAVE A SECOND?
>> COURAGE: I'LL SECOND IT. >> VIAGRAN: I HAVE A
MOTION AND A SECOND. ALL IN FAVOR SAY AYE. >>
>> VIAGRAN: THE MOTION CARRIES. ALL RIGHT.
NEXT ITEM IS ITEM 9. MADAME CLERK, PLEASE READ THE CAPTION FOR ITEM 9.
>> CLERK: ITEM NO. IS APPROVAL TO PROCEED WITH SCHEDULING FOUR CONTRACTS FOR CITY COUNCIL CONSIDERATION TO PROVIDE THE PUBLIC WORKS DEPARTMENT WITH ON-CALL CULTURAL RESOURCES CONSULTING SERVICES RELATED TO FEDERAL TRANSPORTATION PROJECTS, CAPITAL IMPROVEMENT BOND PROJECTS, AND OTHER CITY PROJECTS LOCATED CITYWIDE IN THE ESTIMATED TOTAL VALUE OF $15 MILLION FOR THREE YEARS
WITH TWO ONE-YEAR OPTIONS TO RENEW. >> VIAGRAN: ALL RIGHT,
LUIS. YOU'RE UP AGAIN. >> AGAIN, POST-SOLICITATION BRIEFING ON ON-CALL CULTURAL RESOURCES CONSULTING SERVICES.
ON THE SOLICITATION WE PUT OUT A REQUEST FOR QUALIFICATIONS FOR THE SERVICES. THESE ARE FOR TRANSPORTATION, BOND-FUNDED PROJECTS LOCATED CITYWIDE. THIS CAN BE HORIZONTAL LIKE STREETS AND DRAINAGE PROJECTS. THEY CAN ALSO BE VERTICAL, OR BUILDING PROJECTS.
THE SERVICES THEY PROVIDE IS TO MAKE SURE THAT WE ARE IN COMPLIANCE WITH ALL FEDERAL, STATE, AND LOCAL HISTORIC AND CULTURAL RESOURCE LAWS, RULES, AND REGULATIONS.
THESE CONSULTANTS HELP US THROUGH THE DESIGN AND CONSTRUCTION TO MAKE SURE WE'RE MEETING ALL OF THE OHP, OFFICE OF HISTORIC PRESERVATION, AS WELL AS THC, THE TEXAS HISTORIC COMMISSION. ONE OF THE BIGGEST SERVICES THAT THEY PROVIDE IS ARCHAEOLOGICAL SERVICES. IDENTIFYING THOSE POTENTIAL ARCHAEOLOGICAL SITES. AND THEY DO SOMETIMES PRE-CONSTRUCTION AND OBSERVATION DURING CONSTRUCTION. SO A LOT OF THE WORK HAPPENS DOWNTOWN AS A CONTRACTOR IS EXCAVATING. WE HAVE A CONSULTANT MAKING SURE IF SOMETHING IS EXPOSED IT'S PROPERLY DOCUMENTED AND PERMITTED THROUGH THC AS WELL. THAT'S BASICALLY THE SERVICES THEY PROVIDE.
AGAIN, THIS IS AN RFQ, THREE YEARS WITH TWO ONE-YEAR OPTIONS.
IT'S A $15 MILLION TOTAL FOR THOSE YEARS. MOST OF THE FUNDING COMES THROUGH THE 2022 BOND PROGRAM. THOSE ARE OUR LARGER
[00:35:01]
PROJECTS. BUT IT CAN BE ANY OTHER FUNDING SOURCE AS WELL.IN FACT, WE USE THIS QUITE A BIT ON OUR FEDERALLY-FUNDED PROJECTS THAT GO THROUGH THE NPO OR GRANTS. THAT'S WHEN YOU SEE THE DBE GOALS ON THIS CONTRACT.
OUR CONTRACT EXPIRES IN JUNE OF 2025. SO WE GOT EIGHT SUBMITTALS.
EIGHT RESPONDENTS. WE ARE SELECTING THE FIRST FOUR THAT YOU CAN SEE UP IN THE FRONT. SEPTEMBER 6, THAT'S WHEN OUR COMMITTEE MET TO MAKE THE SELECTION. WE HAD FOLKS FROM OUR CITY MANAGER'S OFFICE, FROM PUBLIC WORKS, FROM THE OFFICE OF HISTORIC PRESERVATION, AND THE CONSERVATION SOCIETY IN SAN ANTONIO. AGAIN, THERE WAS A DBE GOAL OF 8.5% AND LOCAL PREFERENCE AND VETERAN-OWNED SMALL BUSINESSES IS NOT APPLICABLE. THESE ARE THE FOUR VENDORS THAT WERE SELECTED.
HERE YOU SEE THE FOUR THAT WERE NOT SELECTED. 445 WERE THE NUMBER OF VENDORS NOTIFIED. 11 CAME TO OUR PRE-SUBMITTAL CONFERENCE.
EIGHT OUT OF THOSE 11 RESPONDED TO THE RFQ AND THERE WERE NO MATERIAL FINDINGS IN THE MINIMUM REVIEW AND THE DUE DILIGENCE EITHER.
THAT IS THE END OF THE PRESENTATION. HAPPY TO ANSWER QUESTIONS.
>> VIAGRAN: THANK YOU, LUIS. I KNOW JEFF STEPPED OUT BUT ALL OF THESE VENDORS, THE FOUR, ARE FAMILIAR WITH THE STATE, FEDERAL, AND THEN LOCAL WHAT WE PRIORITIZE HERE IN TERMS OF CONSERVATION.
>> ABSOLUTELY. THAT WAS THE REASON FOR OUR SELECTION AND ARE VERY, VERY FAMILIAR WITH OUR REQUIREMENTS. ARE CURRENTLY WORKING ON PROJECTS THEMSELVES, SO VERY WELL QUALIFIED. YES.
>> VIAGRAN: WILL WE BE UPDATING IF ANY CHANGES HAPPEN AT THE STATE DURING THIS LEGISLATIVE SESSION, WILL THAT IMPACT ANY OF THESE PROJECTS OR WE'LL JUST
NOTIFY THEM IF ANYTHING COMES DOWN? >> IF ANY CHANGES HAPPEN, THEY'LL MAKE SURE TO NOTIFY US. WE'LL WORK THROUGH OUR PROJECT MANAGER AND GET THAT ESCALATED IF IT DOES HAVE AN IMPACT ON A PROJECT.
>> VIAGRAN: THANK YOU. IN DISTRICT 3 I KNOW THERE'S A CONSTANT SEARCH FOR THE LOCATION OF THE BATTLE OF MEDINA. THAT IS ALWAYS FIRST AND FOREMOST WHEN WE START DOING PROJECTS DOWN THERE. I'M LOOKING FORWARD TO SEEING THIS MOVE FORWARD TO MAKE SURE WE CAN CONTINUE ON OUR PROJECTS.
DO I HAVE ANY DISCUSSION FROM OUR COMMITTEE MEMBERS? ALL RIGHT.
CAN I GET A MOTION AND A SECOND? I HAVE A MOTION AND A
SECOND. ALL IN FAVOR SAY AYE. >>
>> VIAGRAN: ALL OPPOSED SAY NO. MOTION CARRIES.
ITEM 10. >> CLERK: ITEM 10 IS APPROVAL TO PROCEED WITH SCHEDULING ONE CONTRACT FOR CITY COUNCIL CONSIDERATION TO PROVIDE A CONSTRUCTION MANAGER AT RISK CMAR FOR PRE-CONSTRUCTION AND CONSTRUCTION PHASE SERVICES FOR THE ELLA AUSTIN COMMUNITY CENTER, LOCATED IN COUNCIL DISTRICT 2 IN THE
ESTIMATED TOTAL VALUE NOT TO EXCEED $17,200,000. >> THANK YOU, CHAIR.
AGAIN, POST-SOLICITATION BRIEFING FOR ELLA AUSTIN COMMUNITY CENTER.
IT'S ONE OF OUR 2022 BOND PROJECTS. ONE OF THE LARGEST PROJECTS ON THE BUILDING SIDE. WE DID SOLICIT FOR A CONSTRUCTION MANAGEMENT AT RISK TO PROVIDE PRE-CONSTRUCTION AND CONSTRUCTION SERVICES FOR THE ELLA AUSTIN COMMUNITY CENTER LOCATED AT 1023 NORTH PINE IN DISTRICT 2 .
SOME OF THOSE SERVICES INCLUDE DEVELOPMENT OF DESIGN OPTIMIZATION.
BASICALLY THIS CMR WILL BE WORKING CLOSELY WITH OUR DESIGNER TO OPTIMIZE THAT DESIGN, MAKE IT EFFICIENT, MAKE IT AFFORDABLE, MAKE IT CONSTRUCTABLE.
SO HAVING THAT CONTRACTOR ON BOARD IS VERY, VERY HELPFUL. NOT ONLY ARE THEY GOING TO DO THAT, THEY ARE GOING TO DEVELOP AND MANAGE THE CONSTRUCTION SCHEDULE, RISK MITIGATION, AND CONSTRUCTION TO ASSIST THE CITY IN THE PROJECT EXECUTION.
AGAIN, THIS WAS A CMAR. WE ANTICIPATE OCTOBER 26 THE COMPLETION OF THE ELLA AUSTIN RENOVATION AND EXPANSION. ESTIMATED VALUE OF THE CONTRACT, $17.2 MILLION. AGAIN, IT'S A 2022 BOND PROGRAM-FUNDED PROJECT.
I BELIEVE THERE ARE SOME TIRZ FUNDING AS WELL. THAT'S NOT SHOWN BUT WE TO HAVE TIRZ FUNDING ON THIS PROJECT AND IT WILL BE A NEW CONTRACT.
SO THIS IS A CMA, THIS WAS A TWO-STEP PROCESS. FOUR SUBMITTALS WERE
[00:40:02]
RECEIVED. SELECTION PANEL CHOSE THE FIRST THREE FIRMS TO MOVE TO THE SECOND PHASE, WHICH IS THE INTERVIEW PHASE. THIS PROJECT DOES HAVE A 20% SBEDA FOR MINORITY WOMEN-BASED BUSINESS. 3% FOR AABE.LOCAL PREFERENCE NOT APPLICABLE. VETERAN OWNED NOT APPLICABLE. SOME OF THE FOLKS THAT WERE IN THE SELECTION PANEL WERE CITY MANAGER'S OFFICE, PUBLIC WORKS, DHS, MARMA MOCK AS PART OF OUR CONSTRUCTION SERVICES AS WELL . THIS IS THE SECOND PHASE OF THE TWO-PHASE PROCESS. THIS IS THE INTERVIEW PHASE. WE INTERVIEWED THREE CONTRACTORS. SO FINAL SCORE WAS CONDUCTED UPON COMPLETION OF THE INTERVIEWS. AFTER SCORING WAS COMPLETED, AN UPDATED CAMPAIGN FINANCE REPORT REVEALED THAT PROHIBITED CAMPAIGN CONTRIBUTIONS WERE MADE BY ONE OF THE RESPONDENTS. SO DURING THAT BLACKOUT PERIOD.
SO THAT ONE CONTRACTOR WAS DEEMED NONRESPONSIVE. SO AS YOU CAN TELL, WE WENT THROUGH THE NEXT HIGHEST-RANKING CONTRACTOR IN THE INTERVIEW PROCESS.
634 CONTRACTORS WERE NOTIFIED. OUT OF THE 634, FOUR ATTENDED A PRE-SUBMITTAL CONFERENCE. AGAIN, WE EVALUATED ALL FOUR RESPONDENTS. ONE WAS DEEMED DISQUALIFIED FOR PROHIBITED CAMPAIGN CONTRIBUTIONS. AND THEN ON NO MATERIAL FINDINGS WHEN IT CAME TO MINIMUM REQUIREMENTS AND DUE DILIGENCE. THAT'S THE END OF MY PRESENTATION. BE HAPPY TO ANSWER ANY QUESTIONS.
>> VIAGRAN: THANK YOU, LUIS. I THINK WHAT INTERESTS ME THE MOST ABOUT THIS ONE IS THAT BOTH -- ALL THREE HAD PREVIOUS EXPERIENCE BUT, AGAIN, IN THE PASS OR FAIL ALL THREE DID NOT GARNER ANY POINTS FOR SBEDA.
SO I'M LOOKING FORWARD TO SEEING WHO THE VENDORS ARE AND HOW WE CAN BETTER COMMUNICATE OUR PRIORITY FOR SBEDA AS WE MOVE FORWARD. WHEN WE HAVE IT AVAILABLE.
BECAUSE WE DON'T ALWAYS HAVE IT AVAILABLE. >> JUST A QUICK REMINDER THERE'S STILL A 20% REQUIREMENT THAT CONTRACT GOES TO SMALL, MINORITY, WOMEN-OWNED BUSINESSES. IT WAS JUST NOT PART OF THE SCORING CRITERIA.
>> VIAGRAN: YEAH. NO, I MEAN I KNOW WE HAVE THAT BUT IT'S STILL -- IT COULD HAVE MADE A DIFFERENCE BETWEEN VENDOR A AND VENDOR B.
I THINK THIS WILL BE AN INTERESTING ONE AS IT MOVES FORWARD TO COUNCIL AND I'M INTERESTED TO SEE IF ANY OF MY COUNCIL COLLEAGUES OR COMMITTEE MEMBERS HAVE ANY
COMMENTS. COUNCILMAN COURAGE. >> COURAGE: I WANT TO MAKE SURE I UNDERSTAND. IN THIS CASE VENDOR B GETS THE CONTRACT, THEY STILL HAVE TO BRING IN MINORITY, WOMEN-OWNED BUSINESS PARTNERS?
>> THAT'S CORRECT. >> COURAGE: BUT THEY DIDN'T DO THAT EARLY ON AS PART OF THEIR PRESENTATION, RIGHT? THEY'RE SAYING WE'RE GOING
ALONE RECOGNIZING WE NEED TO BRING SOME IN LATER. >> THAT IS CORRECT.
20% FOR MINORITY, WOMEN-OWNED BUSINESS AND 3% FOR AFRICAN AMERICAN.
>> VIAGRAN: ALL RIGHT. WE NEED A MOTION AND A SECOND TO MOVE THIS FORWARD TO COUNCIL. WE HAVE A MOTION. DO WE HAVE A SECOND?
>> COURAGE: I'LL SECOND IT. WE HAVE A MOTION AND A
SECOND. ALL IN FAVOR SAY AYE. >> RIGHT. MARC, TELL US AND TURN ON YOUR VOLUME.
>> WHYTE: YES. AYE. >> VIAGRAN: ALL RIGHT.
[Staff Briefing ]
MOTION CARRIES. NEXT ITEM -- AND THIS I BELIEVE IS FOR STAFF BRIEFING ON THE REQUIRED COMMUNICATION FOR FISCAL YEAR 2024 EXTERNAL INDEPENDENT AUDIT. AND THIS IS FOR BRIEFING ONLY.THANK YOU. >> GOOD MORNING, CHAIRPERSON, COMMITTEE MEMBERS. MY NAME IS MELANIE KEETON. I'M THE ASSISTANT FINANCE DIRECTOR OTHER ACCOUNTING WITH THE CITY. WITH THIS, WE ARE ACTUALLY STARTING WITH A NEW YEAR. IT MEANS WE HAVE COMPLETION OF THE 2024 FISCAL YEAR AND WE'RE GOING TO START THE AUDIT ON THAT SHORTLY. AS A QUICK REMINDER, THERE IS A DIFFERENCE BETWEEN THE EXTERNAL AUDIT, WHICH IS DONE ONCE A YEAR, BY AN INDEPENDENT EXTERNAL ENTITY. IN THIS CASE IT'S FORVIS MAZARS VERSUS THE OFFICE OF
[00:45:03]
THE INTERNAL AUDITOR WHO TENDS TO DO MORE FINANCIAL FISCAL COMPLIANCE, VERY CONTRACTUAL LIMITED SCOPE. THE EXTERNAL IS MORE BROAD BASED LOOKING FOR MATERIAL MISSTATEMENTS IN THE OVERALL ASPECT OF THE CITY. THE EXTERNAL AUDIT IS REQUIRED UNDER THE PROVISIONS OF THE CITY CHARTER AND IT'S ALSO REQUIRED BY STATE STATUTE AND WITH FEDERAL GRANTS, IT'S REQUIRED UNDER THAT RULE AS WELL. SO THIS IS THE THIRD YEAR OF THE EXTERNAL AUDIT CONTRACT WITH FORVIS MAZARS. THE CONTRACT IS A THREE-YEAR TERM WITH TWO ONE-YEAR EXTENSIONS. YOU CAN SEE THE PRICE BREAKOUT BELOW.THE CITY'S RESPONSIBILITIES IS TO DEVELOP, REVIEW, AND REVISE THE INTERNAL CONTROLS AND FISCAL POLICIES THROUGHOUT THE YEAR. WE INTERPRET AND IMPLEMENT NEW GASB STATEMENTS. PREPARE AND CONSOLIDATE THE ANNUAL FINANCIAL STATEMENTS.
DEVELOP THE DISCLOSURE NOTES, TRANSMISTAL LETTER, MD&A AND STATISTICAL SECTIONS. THAT IS ONLINE AND AVAILABLE FOR EVERYBODY TO LOOK AT.
REVIEW, ADJUST, AND CONSOLIDATE COMPONENT UNIT FINANCIALS.
WE HAVE ABOUT 27 COMPONENT UNITS. CREATING VARIOUS SUPPORTING SCHEDULES FOR THE AUDITORS TO TEST AND ANSWER AUDITOR FOLLOW-UP QUESTIONS.
THAT IS LED BY VICTORIA, WHO IS BEHIND ME. SHE IS OUR CITY CONTROLLER AND I WANTED TO ACKNOWLEDGE HER. AND HER AND HER STAFF DO A LOT OF WORK FOR THE NEXT FOUR TO SIX MONTHS. THEY'VE ALREADY STARTED.
WE ALSO PREPARE THE AIRPORT'S PFC REPORT, THE FEDERAL AND STATE GRANT EXPENDITURE REPORTS, WHICH ALLOW US TO GET STATE AND FEDERAL MONIES.
WORK WITH DEPARTMENTS THROUGHOUT THE CITY. SUBMIT TO THE FEDERAL DATA COLLECTION SO THAT ALL THE GRANTING AGENCIES CAN SEE OUR RESULTS.
AND CONTINUE TO WORK WITH THE AUDITOR AS THE POINTS PERSON FOR THE CITY.
WITH THAT, I'M GOING TO HAND IT OVER TO THE PARTNER, AMANDA EAVES WITH FORVIS MAZARS. THEY CHANGED THEIR NAME. I'M GETTING USED TO IT, TO
GO AHEAD AND CONTINUE WITH HER PRESENTATION. >> THANK YOU, MELANIE.
I JUST WANT TO SAY FIRST OF ALL, THANK YOU TO THE CITY AND THE COMMITTEE.
WE APPRECIATE THE OPPORTUNITY TO CONTINUE WORKING WITH THE CITY AND THE STAFF, YOU KNOW, AS ALWAYS HAS BEEN VERY HELPFUL IN PLANNING SO FAR.
THE AUDIT IS GOING WELL. SO I KNOW THAT YOU ALL HAVE HEARD THIS PRESENTATION FROM ME BEFORE SO I WILL GO THROUGH IT AT A HIGH LEVEL. PLEASE STOP ME IF YOU HAVE QUESTIONS. I WOULD LIKE TO SAY IF ANYONE ON THE COMMITTEE HAS ANY INPUT ON THE AUDIT AFTER THE MEETING, IF YOU'LL PLEASE COMMUNICATE THAT THROUGH CHAIRPERSON VIAGRAN AND MY E-MAIL AND CONTACT INFORMATION IS ON THIS SLIDE WE ALSO HAVE A NUMBER OF TEAMING PARTNERS HERE WITH US TODAY THAT I WOULD LIKE TO INTRODUCE. THEY ARE AN INTEGRAL PART OF THE AUDIT TEAM.
WE HAVE CHRIS CARMONA. ALSO ROBERT WILLIAMS, TERRY BRITS AND DEBBIE FRAZIER.
ALSO ERICA BROWN IS THE SENIOR MANAGER ON THE AUDIT AND SHE IS HERE AS WELL .
JUST A LITTLE BIT ABOUT OUR RESPONSIBILITIES. WE ARE AUDITING THE CITY'S FINANCIAL STATEMENTS. WE'RE ALSO AUDITING COMPLIANCE WITH YOUR MAJOR FEDERAL AND STATE PROGRAMS. CONDUCTING OUR AUDITS IN ACCORDANCE WITH GENERALLY-ACCEPTED AUDITING STANDARDS. GOVERNMENTAL AUDITING STANDARDS AND ALSO THE REQUIREMENTS FOR THOSE STATE AND FEDERAL PROGRAMS. AND JUST A REMINDER THAT OUR AUDIT IS CONDUCTED TO OBTAIN REASONABLE ASSURANCE ABOUT THE FINANCIAL STATEMENTS AND COMPLIANCE. SO, IN OTHER WORDS, WE'RE NOT TESTING EVERY TRANSACTION AND EVERY GRAND EXPENDITURE.
THESE ARE THE DELIVERABLES. THESE ARE THE SAME REPORTS THAT YOU HAVE RECEIVED IN THE PAST AND SO YOU'LL RECEIVE THOSE REPORTS NEXT SPRING.
THIS IS OUR TIMELINE. WE'RE HERE IN OCTOBER GETTING READY TO FINISH UP FINAL FIELD WORK. STARTING IN NOVEMBER THROUGH FEBRUARY AND THEN BE BACK OUT IN MARCH TO PRESENT FINAL REPORTS TO YOU. THIS SLIDE JUST GIVES YOU A DEFINITION OF MATERIALITY. WE'RE NOT AUDITING EVERY TRANSACTION, WE DO DETERMINE SET SCOPES AND MATERIALITY LEVELS IN ORDER TO DETERMINE WHAT WE'RE GOING TO TEST.
AND SO THIS GIVES YOU A LITTLE MORE INFORMATION ABOUT THAT.
NEXT, AND THIS SLIDE OVERLAPS A LITTLE WITH SOME OF THE THINGS MELANIE TALKED ABOUT AS FAR AS INTERNAL CONTROLS. THERE ARE UPCOMING C ACCOUNTING PRONOUNCEMENTS. THEY INCLUDE SIGNIFICANT ESTIMATES THAT WE WILL TEST
[00:50:03]
AS A PART OF THE AUDIT AND REPORT BACK TO YOU ON IN MARCH.AND THEN OF COURSE TESTING YOUR MAJOR PROGRAMS IS A SIGNIFICANT AREA AS IT RELATES TO THE AUDIT. AS MELANIE MENTIONED YOU DO HAVE A NUMBER OF MOVING PARTS OR COMPONENTS. AS WE'VE DISCUSSED IN THE PAST, THIS SLIDE WILL SHOW YOU THE NUMBER OF COMPONENT UNITS THAT THE CITY HAS AND THE NUMBER OF THOSE THAT ARE AUDITED BY OTHER AUDITORS, NOT FORVIS. THOSE ARE ON THE BOTTOM LINE HERE. IF YOU LOOK AT THE APPENDIX, YOU'LL SEE A DETAILED SCHEDULE OF ALL THOSE COMPONENT UNITS TO GIVE YOU MORE INFORMATION ON THAT.
THESE ARE OUR SIGNIFICANT RISK AREAS THAT WE DETERMINED IN PLANNING.
AGAIN, THIS IS SIMILAR TO WHAT YOU WOULD HAVE SEEN IN THE PAST.
AGAIN, IF THERE'S ANYTHING ON THIS SLIDE THAT, YOU KNOW, ANY OTHER RISK AREAS THAT THE COMMITTEE SEES, PLEASE COMMUNICATE THAT THROUGH CHAIRPERSON VIAGRAN, IF YOU HAVE ANY THOUGHTS ON THIS THAT YOU WOULD LIKE FOR US TO KNOW AS WE'RE GOING THROUGH AND PLANNING OUR AUDIT. THESE ARE OUR MAJOR FEDERAL PROGRAMS. WE HAVE QUITE A FEW MORE THIS YEAR.
THERE'S TWO SLIDES OF THEM. SO THERE'S NINE OF THEM. THESE ARE THE FEDERAL PROGRAMS. YOU'LL SEE IT SAYS "CURRENT" AT THE TOP.
THESE ARE BASED ON PRELIMINARY NUMBERS. SO ONCE WE GET THE YEAR-END FINAL CLOSE FINANCIAL STATEMENT AMOUNTS, THERE COULD BE ADDITIONAL PROGRAMS THAT ARE ADDED BUT THESE ARE THE PROGRAMS WE HAVE IDENTIFIED SO FAR.
AND THEN THESE ARE YOUR STATE PROGRAMS. SO ONE OF THE QUESTIONS WE DO GET FOR COMMITTEES IS HOW DO WE CONSIDER THE RISK OF ERROR OR FRAUD IN OUR FINANCIAL STATEMENT AUDITS. THIS WILL GIVE YOU A LITTLE BIT OF INSIGHT ON THAT.
WE DO IT THROUGH BRAINSTORMING WITH THE TEAM. WE ALSO DO INTERVIEWS WITH THE CITY, WITH CITY STAFF. LOOKING AT THOSE ESTIMATES AS WE TALKED ABOUT WHERE THERE COULD BE BIAS. ANY UNUSUAL TRANSACTIONS. AND THEN WE'LL DO SOMETHING EACH YEAR DIFFERENT THAN WE'VE DONE IN THE PRIOR YEAR, JUST TO ESTABLISH SOME UNPREDICTABILITY. SO REGARDING THE EARLIER COMMENT I MADE REGARDING THE COMMITTEE, WHAT WE WOULD ASK OF YOU IS IF YOU HAVE ANY CONCERNS IN ANY OF THESE AREAS SHOWN ON THE SLIDE HERE THAT YOU AGAIN COMMUNICATE THEM THROUGH CHAIRPERSON VIAGRAN, WHO WOULD COMMUNICATE THEM TO US.
BUT THESE ARE IMPORTANT AREAS AND WE WOULD WANT ANY INPUT, IF YOU HAVE ANY, ON THESE AREAS. AND THEN THE APPENDIX IS JUST THE SLIDES I TALKED ABOUT PREVIOUSLY. WITH THAT, DOES ANYONE HAVE ANY QUESTIONS?
>> VIAGRAN: I WANT TO TAKE THE TIME, MELANIE AND AMANDA, TO THANK YOU FOR WHAT YOU DO. AUDIT IS NOT THE MOST EXCITING COMMITTEE.
THE MEDIA IS NOT HERE WANTING TO DO INTERVIEWS. BUT WHAT WE DO IS SO IMPORTANT. AND I WANT TO THANK YOU ALL FOR YOUR SERVICE AND THANK YOU FOR COMING AND PRESENTING THIS. IT'S BECAUSE OF THE THESE BALANCES AND THESE CHECKS THAT WE DO IS WE CAN CONTINUE TO GET THE GRANTS THAT WE HAVE. SO WE WILL BE IN TOUCH IF THERE'S ANY CONCERNS.
I KNOW FRAUD WITH THIRD PARTIES, FRAUD WITH OUR PARTICIPANTS IN OUR FEDERAL GRANT PROGRAMS IS THE ONE THING WE ARE CONSTANTLY LOOKING AT THAT.
AND IS THERE AN OPPORTUNITY WHERE WE'RE GETTING VULNERABLE BECAUSE OF THE WAY TECHNOLOGY MOVES AND THE WAY PEOPLE ARE USING INFORMATION.
SO I'M LOOKING FORWARD TO HEARING FROM MY COMMITTEE MEMBERS TO GET SOME INFORMATION. THANK YOU FOR YOUR WORK. THANK YOU FOR BEING SO INTERESTED IN THIS AUDIT TEAM AND KEVIN AND BEN AND TROY.
BECAUSE THIS MAKES OUR JOB SO MUCH EASIER WHEN YOU GUYS HAVE A PASSION FOR THIS AND BRING IT FORWARD. SO, WITH THAT, THIS IS FOR BRIEFING ONLY.
ANY COMMENTS FROM MY COMMITTEE MEMBERS? ALL RIGHT.
WE LOOK FORWARD TO GETTING ALL THE INFORMATION AND HEARING WHERE OUR RISKS ARE AND HOW OUR CITY IS PREVENTING THOSE RISKS. WITH THAT, KEVIN, IS THIS YOUR LAST MEETING? ALL RIGHT. SO, WITH THAT, WE ARE SAYING GOOD -- NO, SEE YOU LATER TO KEVIN. I WANT TO GIVE HIM AN OPPORTUNITY TO SAY A FEW WORDS TO THIS COMMITTEE. I'M SURE WE'RE GOING TO DO A BIGGER SEND OFF LATER IN THE MONTH. BUT THE FLOOR IS YOURS.
>> FIRST OFF, TO GO BACK TO WHAT YOU SAID ABOUT THE EXTERNAL AUDIT NOT BEING EXCITING, IT'S VERY EXCITING. [LAUGHTER] AS IS INTERNAL AUDITING. WE'RE THE COOL KIDS. BUT, NO, TO THE COMMITTEE --
[00:55:01]
AND I'VE BEEN IN THIS POSITION FOR 13.5 YEARS NOW AND SERVED WITH MULTIPLE COMMITTEE MEMBERS, MULTIPLE CHAIRS AND I'VE ALWAYS HAD GREAT SUPPORT FROM THE COMMITTEE. CONTINUE TO HAVE GREAT SUPPORT FROM THE COMMITTEE, SO I CERTAINLY APPRECIATE THAT, AS WELL AS FROM STAFF. I WORK WITH TROY AND BEN QUITE A BIT AS WELL AS MANAGEMENT ACROSS THE ORGANIZATION, STARTING WITH ERIK AND ALL THE WAY DOWN. IT'S MADE MY JOB A WHOLE LOT EASIER OVER THE YEARS.WE HAVEN'T ACTUALLY AGREED ON THINGS, AND THAT'S OKAY, BUT WE HAVE ALWAYS COME TO AN AGREEMENT TO RESOLVE IT AND TO MOVE FORWARD. ONE OF THE THINGS I SAY WAY TOO OFTEN, WE'RE HERE TO MAKE EVERYTHING BETTER. THE SAME PERSON SIGNS ALL OF OUR PAYCHECKS. WE ARE ONE TEAM AND WHILE SOMETIMES I'M THE BEARER OF BAD NEWS, SO BE IT. I DON'T GET MANY CHRISTMAS CARDS.
I'M OKAY WITH THAT. NO, IT'S BEEN A GOOD GIG. THIS HAS BEEN FUN.
REALLY DON'T HAVE ANY DEFINITE PLANS MOVING FORWARD BUT I'M GOING TO BE AROUND AND I'VE OFFERED AND HAD OTHER CONVERSATIONS TO CERTAIN ON OTHER BOARDS AND COMMISSIONS. DON'T PLAN ON GOING VERY FAR.
THANK YOU FOR YOUR SUPPORT AND ALSO TO MANAGEMENT THROUGHOUT THIS GIG.
IT'S BEEN FUN. SO, THANK YOU. APPRECIATE Y'ALL.
>> VIAGRAN: IT HAS AND I'M THANKFUL THAT THIS IS MY FIRST CHAIR AND, KEVIN, THAT YOU WERE A PART OF THIS AUDIT COMMITTEE. DOES ANY OF THE OTHER
MEMBERS LIKE TO SHARE? COUNCILMAN COURAGE. >> COURAGE: THANK YOU.
I HAVE HAD THE PLEASURE WORKING WITH YOU FOR THE EIGHT YEARS I HAVE BEEN ON COUNCIL. KEVIN, YOU ARE ONE OF THE PROFESSIONALS THAT THIS CITY HAS AND YOU HAVE DISPLAYED THAT AND SHOWN YOUR PROFESSIONALISM ON THIS COMMITTEE AND ALL THE WORK YOU DO WITH THIS COMMITTEE. INCLUDING ON OTHERS, ON ETHICS AND THINGS OF THAT NATURE. AND IT WAS JUST A PLEASURE TO WORK WITH YOU. I WISH YOU CONTINUED SUCCESS.
YOU KNOW, ALL OF OUR PROFESSIONALS IN THIS CITY ARE JUST GREAT AT THE JOBS THEY DO. THANK YOU FOR DEDICATING 13 YEARS TO THIS WORK FOR US.
THANK YOU. >> VIAGRAN: THANK YOU. ANYONE ELSE?
COUNCILMAN WHYTE. >> WHYTE: YEAH, KEVIN, I JUST WANT TO SAY THANKS AS WELL. YOU KNOW, THE PAST 15, 16 MONTHS WORKING WITH YOU HAS BEEN GREAT. I'VE ALWAYS FOUND YOU TO BE VERY CANDID AND OPEN IN OUR ONE-ON-ONE CONVERSATIONS ABOUT WHATEVER THE ISSUE WAS.
AND I REALLY APPRECIATE THAT. SO THANKS FOR ALL YOUR
SERVICE TO THE CITY. >> VIAGRAN: JUDY. >> KEVIN, THANK YOU FOR ANSWERING ALL MY QUESTIONS WHEN I DON'T UNDERSTAND CERTAIN THINGS.
FOR THE ONE-ON-ONE MEETINGS WE'VE HAD AND EXPLANATIONS ON THE AUDIT REPORTS, WE REALLY APPRECIATE YOUR WORK. AND I AGREE WITH YOU. IT IS EXCITING.
IT'S VERY EXCITING FOR INTERNAL AND EXTERNAL AUDIT. SO, THANK YOU.
>> VIAGRAN: BEN, TROY? >> MADAME CHAIR, THANK YOU. KEVIN, I AGREE WITH YOU.
IT'S ALL SO EXCITING. IT'S REALLY EXCITING EVERY DAY.
LOOK FORWARD TO THIS. BUT REALLY IN SERIOUSNESS, REALLY APPRECIATE YOUR PROFESSIONALISM. YOU KNOW, I THINK YOU KIND OF SAID IT DURING YOUR WRAP UP HERE THAT YOU'VE ALWAYS FOCUSED ON MOVING THE ORGANIZATION FORWARD.
AND, YOU KNOW, COMING FROM THE SIDE WHERE WE'RE THE SUBJECT OF THE AUDIT MANY TIMES, I CAN TELL YOU THAT KEVIN'S ALWAYS -- AND HIS TEAM HAVE ALWAYS APPROACHED IT FROM IDENTIFYING WHERE WE CAN IMPROVE, HOW WE CAN DO THAT, AND WORKING TOGETHER AT THE END OF THE DAY TO DELIVER BETTER SERVICES, BETTER OUTCOMES FOR OUR RESIDENTS, FOR OUR CITIZENS. AND I THINK KEVIN HAS TAKEN THAT, BUILT A TEAM.
CONGRATULATIONS ON THE TEAM THAT YOU HAVE BUILT THERE. THEY DO GREAT WORK AND IMPORTANT WORK BECAUSE IF WE CAN'T IDENTIFY SOME OF THESE CHALLENGES AND ISSUES, WE CAN'T ADDRESS THEM. SO WE'VE GOT TO BE IN A POSITION WHERE WE CAN IDENTIFY THEM, MOVE FORWARD. AGAIN, KEVIN HAS TAKEN THE APPROACH OF NOT SO MUCH A GOTCHA, I'M GOING TO POUND MY CHEST, I FOUND SOMETHING. IT'S ALWAYS BEEN ABOUT HOW DO WE MOVE THE ORGANIZATION FORWARD. I TRULY APPRECIATE THAT.
I APPRECIATE OUR PARTNERSHIP. I HAVE ENJOYED WORKING WITH YOU. WISH YOU THE BEST IN RETIREMENT.
IF YOU GET BORED, WE HAVE PLENTY OF WORK. GIVE ME A CALL AND WE CAN MAKE IT HAPPEN REAL QUICK. I REALLY WISH YOU WELL AND THANKS AGAIN FOR ALL YOUR
WORK. I APPRECIATE IT. >> I GUESS REAL QUICK, KEVIN. BEN TOOK MOST OF MY COMMENTS BUT JUST SIMPLY WANT TO SAY THANK YOU. I HAVE ENJOYED THE WORKING RELATIONSHIP.
I VALUE THE WORK YOU DO AS AN INTERNAL AUDITOR. IT'S GOOD TO KEEP US ON OUR TOES, MAKE SURE THAT WE'RE DOING THE JOBS THAT WE'RE SUPPOSED TO BE DOING AND WE HAVE THE CONTROLS IN PLACE. I THINK YOUR OFFICE HAS MADE THE CITY OF SAN ANTONIO A BETTER PLACE IN TERMS OF THE FIDUCIARY ROLE THAT THE COUNCIL SERVE OVER THE CUSTODIAN OF THE FUNDS AND MAKING SURE THOSE FUNDS ARE SPENT APPROPRIATELY.
APPRECIATE IT. ENJOY WORKING WITH YOU AND YOUR TEAM AND LOOK FORWARD
[01:00:04]
TO SEEING YOU OUTSIDE THE CITY IN THE FUTURE. >> VIAGRAN: WELL, THANK YOU, KEVIN. ENJOY. KEEP UP WITH OUR HIGHLIGHTS FOR INTERNAL AND EXTERNAL AUDITS. BUT THE NEXT -- THIS WAS
[Consideration of items for future meetings ]
YOUR LAST MEETING BUT, EVERYONE, THE NEXT MEETING IS SCHEDULED FOR NOVEMBER 12, 2024. THE TIME IS 11:30 AND THE MEETING IS NOW ADJOURNED.
