[00:00:09]
>> GAVITO: GOOD AFTERNOON, EVERYBODY. THE TIME IS -- I LIKE THIS CHAIR. I CAN GET USED TO THIS. THE TIME IS 2:14.
WE'RE GOING TO STARTING OUR ZONING MEETING. COULD YOU CALL THE ROLL.
>> GAVITO: GREAT. DO WE MOVE ON TO OUR SPEAKERS? OKAY. WE HAVE A CONSENT AGENDA. DO I HAVE A MOTION TO
APPROVE THE CONSENT AGENDA? >> MOTION MOVED. >> SECOND.
>> GAVITO: WE HAVE A MOTION AND A SECOND. >> MAYOR PRO TEM, IF YOU COULD ILLUSTRATE WHAT'S ON CONSENT SO FOLKS KNOW. JUST READ THE NUMBERS,
PLEASE. >> NUMBER 12, 5 -- 19, 20, 21, 23 AND 24.
>> GAVITO: DO I HAVE AMOTION TO APPROVE THE CONSENT AGENDA? GOT IT. WOULD ANYBODY LIKE TO HIGHLIGHT ANY ITEMS?
COUNCILMEMBER WHYTE. >> WHYTE: THANK YOU, MAYOR PRO TEM.
I NEED TO HIGHLIGHT ITEM 24. I WANT TO THANK THE DEVELOPER, I WANT TO THANK ORTIZ AND MCKNIGHT FOR THEIR WORK ON THIS WITH THE BREYER WORK AND 7 OAKS NEIGHBORHOOD. GREAT JOB COMING TO AN AGREEMENT ON THIS.
I WANT TO NOTE WE HAVE SUBMITTED SOME RESTRICTIVE COVENANTS THAT HAVE PREVIOUSLY BEEN AGREED TO AND WE HAVE SUBMITTED THEM FOR THE RECORD.
THANK YOU, AND THAT'S ALL I'VE GOT. >> GAVITO: THANK YOU, COUNCILMEMBER WHYTE. ANYONE ELSE -- COUNCILMEMBER VIAGRAN.
>> VIAGRAN: THANK YOU FOR ITEM 12. I WOULD LIKE TO SUBMIT THE LETTER OF SUPPORT FROM HARLANDALE MCCOLLUM NEIGHBORHOOD.
>> GAVITO: THANK YOU, COUNCILMEMBER VIAGRAN. ANYONE ELSE? GREAT. DO WE HAVE A -- WE ALREADY HAD A MOTION AND SECOND, RIGHT? OKAY. LET'S VOTE FOR THE CONSENT
AGENDA. >> THERE ARE SOME SPEAKERS SIGNED IN TO SPEAK FOR SOME
MAYOR WALKING IN NOW. >> MAYOR NIRENBERG: WHERE ARE WE?
CONSENT. >> MAYOR NIRENBERG: WE HAD A MOTION AND SECOND FOR THE
CONSENT AGENDA. >> YES. >> MAYOR NIRENBERG: PLEASE VOTE.
SO WE HAVE TWO ITEMS TO CONTINUE TO NOVEMBER 21ST. THAT'S ITEM 17 AND 18.
I'LL ENTERTAIN A MOTION FOR THOSE. >> SO MOVED.
>> MAYOR NIRENBERG: THERE'S A MOTION AND SECOND FOR CONTINUANCE OF ITEMS 17 AND 18 TO NOVEMBER 21. WE HAVE A COUPLE FOLKS SIGNED UP TO SPEAK ON THOSE ITEMS. JACK FINGER. YOU WILL BE FOLLOWED BY
RUSSELL PHELAN. >> MAYOR NIRENBERG, OTHER MEMBERS OF OUR ILLUSTRIOUS SAN ANTONIO CITY COUNCIL. A COUPLE OF THESE ITEMS YOU INTEND TO LATER ON.
THEY -- CONTINUE TO LATER ON. 17 AND 18, IN MISS CASTILLO'S DISTRICT. YES, I WISH YOU WOULDN'T JUST PULL IT FOR CONTINUANCE , ACTUALLY DIB RATE AND SAY NO TO THEM. THE REASON WHY THEY HAVE A NUMBER OF RED FLAGS ON THESE. IT'S ABOUT, OH, CHANGING THE ZONING DESIGNATION FROM RESIDENTIAL TO INFILL DEVELOPMENT, WHICH CARRIES
[00:05:06]
ITS OWN BAG OF TRICKS AT TIMES THERE. YES.BUT MAINLY -- THIS IS OVER ON SOUTH PARK BOULEVARD. AND THE BIG RED FLAGS AGAINST THIS IS THAT THE STAFF AND PLANNING COMMISSION THOUGHT IT WAS A BAD IDEA. THEY RECOMMENDED DENIAL. THE STAFF AND ZONING COMMISSION RECOMMENDED DENIAL. THESE ARE -- WHEN YOU GET ALL FOUR OF THOSE ENTITIES SAYING NO TO THIS, THERE HAS TO BE A GOOD REASON WHY.
APPARENTLY IT'S THE CHANGE IN INTENSITY FROM THE RESIDENTIAL AREA TO THE VARIOUS UNITS YOU WANT TO PERSON -- THE APPLICANT WANTS TO PUT AS MUCH AS EIGHT UNITS, SHOEHORN EIGHT UNITS INTO THIS TINY LOT. THAT'S WHY THEY SAID IT WAS TOO DENSE. IT DOESN'T ALIGN WITH THE SURROUNDING RESIDENCES.
SO I'D APPRECIATE IT IF YOU WOULD JUST SAY NO TO THE WHOLE THING TODAY AND GET IT
OVER WITH. THANK YOU. >> MAYOR NIRENBERG: THANK YOU, MR. FINGER. RUSSELL PHELAN. FOR YOUR INFORMATION, THIS
WILL NOT BE HEARD TODAY, IT WILL BE NOVEMBER 21. >> I WANT TO MAKE AN AMENDMENT TO THE APPLICATION. THERE WAS AN 8-PLEX TO A
4-PLEX AND TO A CONTINUANCE. >> MAYOR NIRENBERG: IT'S ALREADY GOING TO BE CONTINUED SO YOU CAN SEE OUR ZONING STAFF AND WORK THAT OUT WITH THEM.
>> THANK YOU. >> MAYOR NIRENBERG: THANK YOU.
ALL RIGHT. SO THERE IS A MOTION AND SECOND FOR CONTINUANCE OF ITEMS 17 AND 18. ANY DISCUSSION? HEARING NONE, PLEASE VOTE.
MOTION CARRIES. ITEM NUMBER 3. >> CLERK: CASE] 409 AND 503 ROPER REZONED TO IDZ1 WITH USES PERMITTED IN THE NC DISTRICT. 2402 NORTH IH-35 TO C-2 WITH CONDITIONAL USE FOR AUTO AND LIGHT TRUCK REPAIR. 1718 NORTH WALTERS IS TO BE REMOVED FROM THE LARGE AREA REZONING AND 622 SEGUIN STREET TO L. WE MAILED 393 NOTICES, SEVEN WERE RECEIVED IN FAVOR, THREE IN OPPOSITION. WE RECEIVED ONE IN FAVOR OUTSIDE OF THE 200-FOOTNOTE IF I INDICATION BOUNDARY. WE'VE RECEIVED NO RESPONSE FROM THE GOVERNMENT HILL ALLIANCE NEIGHBORHOOD ASSOCIATION.
GOVERNMENT HILL REPORTED THEY WERE NEUTRAL TO THE REQUEST.
>> MAYOR NIRENBERG: WE HAVE A FEW CITIZENS SIGNED UP TO SPEAK ON ITEM NUMBER 3. RUBEN CARDINA. MR. CARDINA?
YOU ARE CEDING YOUR TIME TO ROSE HILL? >> YES.
>> MAYOR NIRENBERG: ROSA SANCHEZ. OKAY.
MS. HILL, YOU WILL FOLLOW ROSA SANCHEZ. >> MY NAME IS ROSA SANCHEZ AND I AM AT 2746 DIGNOWITY AVENUE. SO AS A HOMEOWNER, I MEAN I HAVE MY RIGHTS AND I DO NOT UNDERSTAND MUCH OF WHAT THE REZONING IS ALL ABOUT OR WHATNOT BECAUSE I DON'T HAVE MUCH TIME FOR THAT. I'M A WORKING CITIZEN.
AGAIN, IT HAS CHANGED THREE TIMES OVER THE PERIOD OF TIME THAT THEY'VE BEEN DOING THIS PROJECT SO IT WAS R-2 AND NOW IT'S MF-33 OR WHATNOT.
[00:10:01]
MY REQUEST TODAY IS STAY THE SAME AS A SINGLE-FAMILY HOME, RESIDENTIAL.AND THAT'S MY REQUEST TODAY. WITHOUT ANY, YOU KNOW, CHANGES TO MY HOME OR PROPERTY AS IF, YOU KNOW, THEY DO ANY CHANGES I DON'T KNOW IF THAT'S GOING TO AFFECT MY TAXES OR WHATNOT. I DID SPOKE WITH SOME OF THE GUYS IN CHARGE OF IT, THEY SAID NO, BUT AGAIN, I WOULD JUST LIKE MY HOME TO STAY AS A RESIDENTIAL HOME.
SINGLE-FAMILY. THANK YOU. >> MAYOR NIRENBERG: THANK YOU, MS. SANCHEZ. ROSE HILL. YOU WILL BE FOLLOWED BY
JOSEPHINE DOWELL. >> GOOD AFTERNOON, MAYOR AND COUNCIL MEMBERS.
GOVERNMENT ALLIANCE ASSOCIATION. I SIT ON A TASK TEAM FOR THE LARGE AREA REZONING. TODAY I AM NOT GOING TO SUPPORT THIS LARGE AREA REZONING BECAUSE I FEEL THERE HAS STILL SOME ERRORS AND CONCERNS ON THAT LIST OF PROPERTIES BEING PROPOSED. I ALSO CONCERNED THAT THE TASK TEAM RECOMMENDATIONS WERE NOT TAKEN INTO CONSIDERATION. WE SENT OUT A SURVEY BEFORE THE PROJECT STARTED OUT TO ALL THE NEIGHBORS AND THEY CAME BACK WITH THEY WANTED TO LEAVE THE IH-35 CORRIDOR ALONE BECAUSE OF ECONOMIC DEVELOPMENT.
ALONG THE SEGUIN AREA THERE'S SOME BUSINESSES CHANGED BACK TO RESIDENTIAL.
THEY WERE NOT IN COMPLIANCES. THERE'S TWO BUSINESSES HERE, SAME THING HAPPENED AT ZONING WHERE THEY MADE CHANGES AT ZONING AND TODAY WE'RE MAKING SOME CHANGES HERE TOO SO IT BROUGHT A LOT OF CONFUSION.
THE OTHER CONCERN RESIDENTS HAD IS IS THAT OUR DISTRICT 2 ZONING COMMISSIONER WERE NOT THERE TO LISTEN TO THE VOICES OF OPPOSITION AND THAT WOULD HAVE BEEN HELPFUL BECAUSE THE PERSON WHO MADE THE APPROVAL TO APPROVE IT GOING FORWARD WITH ZONING, IT DOESN'T LIVE IN OUR AREA, HE'S A DIFFERENT COMMISSIONER FROM A DIFFERENT AREA. I THINK THAT WAS ANOTHER THING THAT WAS TAKEN INTO CONSIDERATION. IF YOU CAN PUT THIS UP. ONE OF THE OTHER THINGS THAT CAME UP, WE DIDN'T UNDERSTAND, MAYBE WE RECENTLY FOUND THIS OUT, THE CCR WAS DONE BACK IN 2006. OVER 125 STAKEHOLDERS AND BUSINESSES CAME TOGETHER TO FIX THE MASTER PLAN AND NOW WE'RE FINDING OUT ANOTHER CCR COULD OVERTURN WHAT WAS DONE IN 2006 BY SHEILA MCKNEEL. IT WOULD HAVE BEEN NICE IF YOU HAVE A CCR -- ALL THE WORK WAS DONE FOR NOTHING. WE NEED TIME TO MAKE EVERYBODY FEEL COMFORTABLE BUT TO EDUCATE SOME OF THE PEOPLE THAT STILL DON'T UNDERSTAND SOME OF THE PROCESSES. YOU HAD SOMEBODY HERE THAT WAS MF-33 THAT WANTS TO STAY RESIDENTIAL. SHE DIDN'T UNDERSTAND THERE'S A LOT OF CONFUSION STILL REGARDING THE CODES AND EVEN IN THE THREE MEETINGS THAT WE HAD, WE DIDN'T TALK ABOUT THE CODE, BUT IT WASN'T DEFINED DOWN TO THE NITTY-GRITTY DETAILS AND A LOT OF OUR SPANISH SPEAKING PEOPLE DON'T UNDERSTAND THEIR PROPERTY RIGHTS OR ZONING IS GOING TO BE TAKEN AWAY FROM THEM.
THEY WEREN'T ASKED DONE BY STAFF, NOT BY THE COMMUNITY. SO I JUST WANT TO MAKE SURE THAT OUR COUNCILMAN, THAT YOU TAKE INTO CONSIDERATION NOT THAT WE DON'T WANT TO CHANGE THIS, GIVE THESE PEOPLE AN OPPORTUNITY TO COME BACK IN HERE AND UNDERSTAND IT AND SAY LIKE THIS LADY CAME TODAY, I'M MF-33, I WANT TO STAY RESIDENTIAL. SHE DIDN'T KNOW THAT. WE'RE NOT SAYING -- TELLING PEOPLE HOW TO VOTE, JUST LET EVERYBODY -- LET IT BRING EVERYBODY TO THE TABLE AND THESE NOTICES THAT WENT OUT, YOU HAVE 206 NOTICES THAT WENT OUT AND ONLY THREE CAME BACK IN FAVOR, ONE OR TWO IN OPPOSITION. OUT OF THOSE SEVEN, THERE'S PEOPLE ON -- THEY ARE ON OUR TASK TEAM. THERE'S A CONFLICT OF INTEREST THERE AS WELL. THAT'S A CONCERN SOME OF THE RESIDENTS HAD.
ALL I'M ASKING YOU IS TAKE INTO CONSIDERATION GIVING A LITTLE MORE TIME TO GET ALL THE NOTICES IN, BRING IT BACK, ANALYZE IT AND THEN THE GOVERNMENT HILL WOULD HAVE AN OPPORTUNITY -- THEN WE WON'T HAVE A PROBLEM COMING BACK AND GIVING FULL SUPPORT. BUT BECAUSE WE DON'T HAVE ALL THE DATA, IT'S NOT RIGHT FOR THE -- SOMETHING IS NOT RIGHT. SO THAT'S ALL I HAVE TO SAY.
THANK YOU. >> MAYOR NIRENBERG: THANK YOU, MS. HILL. JOSEPHINE DOWELL. FOLLOWED BY MICHAEL
[00:15:04]
VILLARREAL. >> GOOD AFTERNOON TO OUR MAYOR AND OUR CITY COUNCIL.
MY NAME IS JOSEPHINE DOWELL AND I OWN PROPERTY ON DIGNOWITY STREET.
IF YOU WERE TO DRIVE THROUGH OUR STREETS ON DIGNOWITY, EDGART SEE ONE SINGLE FACTOR.
SINCE 1938, OUR CITY HAS ZONED US HEAVY INDUSTRIAL. IN 2001, THE UNIFIED DEVELOPMENT CODE PLACED OUR PROPERTIES UNDER A NON-CONFORMED USE.
WE'RE NOT ALLOWED AT THIS POINT TO BUILD A HOUSE ON OUR LOT.
AT THIS TIME WE CANNOT ADD A ROOM TO OUR HOUSE. WE'RE NOT ALLOWED TO ENLARGE ANY ROOM ON OUR HOUSE. I KNOW PROPERTY OWNERS WHO CAN'T SELL THEIR VACANT LOT.
BECAUSE WHEN PROSPECTIVE BUYERS COME AROUND, THEY WANT TO BUILD A HOUSE, NOT A FACTORY. THEIR LOTS HAVE NOW BEEN SOLD.
ON OCTOBER 16, 2023, A DISTRICT 2 COUNCIL PERSON JALEN RODRIGUEZ INITIATED THE OFFICIAL CCR. FROM THAT DATE IN THE MONTHS THAT FOLLOWED, WE HAD TASK FORCE MEETINGS. I WAS A MEMBER OF THAT TASK FORCE TEAM.
WE HAD COMMUNITY MEETINGS. HELD IN ENGLISH AND SPANISH TO OUR HOMES.
WE HAD A PLAN THAT BEGAN TO EVOLVE, WE SAW MAPS, WE SAW MORE MAPS AND EVEN MORE MAPS. WE ALSO WERE GIVEN THE OPPORTUNITY ON TWO DIFFERENT DATES FOR THE TODAY I'M ASKING OUR CITY COUNCIL TO RESOLVE THIS CONUNDRUM FOR US.
I HAVE A PARTIAL LETTER FROM MR. LERMO. HE SAYS I PURCHASED MY PROPERTY SEVERAL YEARS AGO NOT KNOWING IT WAS ZONED INDUSTRIAL.
THE PLAN WAS TO BUILD A HOME THERE. NOW WE HAVE BEEN STUCK PAYING TAXES ON A PROPERTY WE CANNOT USE. THIS IS HIM AND HIS WIFE, THEY LIVE AT 315 ROMAN. BY VOTING YES TO THIS LARGE AREA REZONING PROJECT, YOU WILL PUT US IN THE APPROPRIATE ZONING SO THAT WE CAN FINALLY USE OUR PROPERTIES THAT WE'VE BEEN PAYING TAXES ON THE WAY THAT WE WANT TO USE THEM.
I WANT TO THANK DISTRICT 2, MY REPRESENTATIVE DISTRICT 2 COUNCIL PERSON JALEN RODRIGUEZ BECAUSE HE IS A VISIONARY. I ONLY WANTED MY STREET AND THE OTHER STREETS, JALEN SAID NO, LET'S LOOK AT THE LARGE AREA REZONING.
I THANK JALEN FOR THAT AND I'M SO GLAD YOU GOT RE-ELECTED.
PLEASE VOTE YES. >> MAYOR NIRENBERG: THANK YOU.
MICHAEL VILLARREAL. YOU ARE WAIVING YOUR TIME, SIR?
OKAY. VINCENT VILLARREAL. >> I'M HERE TO SPEAK FOR MY FATHER ININSTEAD. I WANTED TO SEAWIVES READY TO TEAR INTO STAFF.
WE SAW ALL THE PAPERWORK THAT EVERYTHING WAS AMENDED, WE'RE HAPPY WITH IT.
THANK YOU TO COUNCIL PERSON JALEN, ZONING COMMISSIONER BUST MANTA, FARES AND CHRISTA AND WE HOPE TO HAVE YOUR SUPPORT. THANK YOU.
>> MAYOR NIRENBERG: THANK YOU, MR. VILLARREAL. THIS IS DISTRICT 2.
COUNCILMEMBER MCKEE-RODRIGUEZ. >> MCKEE-RODRIGUEZ: THANK YOU. THANK YOU TO EVERYONE WHO CAME OUT TO SPEAK TODAY.
THIS WAS A COUNCIL CONSIDERATION REQUEST THAT I FILED SOMETIME LAST YEAR AND IT INVOLVED A LOT OF COMMUNITY ENGAGEMENT AND FEEDBACK.
THERE WERE SEVERAL MEETINGS INCLUDING ONE-ON-ONE MEETINGS.
I WANT TO BE CLEAR, MS. SANCHEZ, YOU ARE CURRENTLY ZONED R-2, YOU ARE GOING TO CONTINUE TO BE ZONED R-2. NOTHING CHANGES FOR YOUR
PROPERTY. DO YOU UNDERSTAND? >>
>> MCKEE-RODRIGUEZ: IT'S EXACTLY WHAT YOU ARE RIGHT NOW.
AND I'LL HAVE A MEMBER OF STAFF COME SPEAK WITH YOU. I JUST WANT TO BE CLEAR THAT --O
APPROVE. THANK YOU. >> MAYOR NIRENBERG: IS THERE IS A -- THERE IS A MOTION FOR APPROVAL OF ITEM 3.
COULD I GET A SECOND? COUNCILMEMBER MCKEE-RODRIGUEZ.
>> MCKEE-RODRIGUEZ: THANK YOU. I JUST WANT TO -- MS. DO YOU, THANK YOU FOR COMING TO OPEN OFFICE HOURS. IT'S NOT OFTEN THAT WE GET TO PUT A FACE TO POLICY AND TO OUR COUNCIL CONSIDERATION REQUEST, BUT THE REASON I FILED THIS COUNCIL CONSIDERATION REQUEST IS LARGELY IN PART OF RESIDENTS LIKE MISS DOW WHO SAY HEY, I NOTICED THAT MY PROPERTY AND THE PROPERTY OF MY NEIGHBORS
[00:20:03]
ARE ZONED INDUSTRIAL AND WE WOULD HAVE TO PAY THOUSANDS OF DOLLARS OR HUNDREDS OF DOLLARS TO DO THE ZONING APPLICATIONS AND ALL OF THE THINGS NECESSARY TO ENSURE THAT WE HAVE A FULL RIGHT AND OWNERSHIP OF OUR PROPERTY.THIS IS ANOTHER EXAMPLE OF ENCROACHMENT IN MY DISTRICT. THANK YOU TO MS. DOW AND EVERYONE WHO CAME OUT TO SPEAK. I KNOW THERE WAS SOME INTEREST IN CONTINUING THE PROCESS A LITTLE FURTHER. I DO WANT TO REST ASSURE MY COUNCIL COLLEAGUES THAT DUE PROCESS WAS FOLLOWED AND I'M CONFIDENT IN THIS AND SO ARE
MANY OF OUR NEIGHBORS. THANK YOU. >> MAYOR NIRENBERG: THANK YOU, COUNCILMEMBER MCKEE-RODRIGUEZ. THERE IS A MOTION AND A SECOND FOR APPROVAL OF ITEM NUMBER 3. ANY FURTHER DISCUSSION?
>> ANY FURTHER DISCUSSION? HEARING NONE, PLEASE VOTE. MOTION CARRIES.
ITEMS NUMBER 9 AND 10. >> CLERK: STAFF MAILED SEVEN NOTICES. ONE WAS RETURN IN FAVOR, ZERO OPPOSED AND THERE IS NO REGISTERED NEIGHBORHOOD ASSOCIATION. THANK YOU.
>> MAYOR NIRENBERG: OKAY, WE HAVE A COUPLE CITIZENS SIGNED UP TO SPEAK ON ITEMS
9 AND 10. JACK FINGER. >> MAYOR NIRENBERG, OTHER MEMBERS OF THE COUNCIL. MY NAME IS JACK FINGER AND THIS PARTICULAR ITEM FALLS IN MS. VIAGRAN'S DISTRICT. IT'S ABOUT CHANGING ZONING FROM -- WELL, FROM -- LET'S SEE, I THINK IT'S AGRICULTURAL. AGRICULTURAL AND RESIDENTIAL ESTATE. NO, FROM AGRICULTURAL AND NATURAL RESOURCE TO RESIDENTIAL ESTATE. THE PROBLEM HERE IS THAT THE STAFF HAS RECOMMENDED DENIAL FOR THIS. THE REASON IT DOES SO IS BECAUSE IT WOULD NEGATIVELY IMPACT THE FARMLAND. THE FARMLAND AND THE -- YES, IN THEIR WORDS, VALUABLE NATURAL RESOURCES SURROUNDING THE AREA. YES.
WE ALL BELIEVE IN SOME -- IN CONSERVATION AND WHEN THIS THING GOES AGAINST THOSE IDEALS, I THINK YOU MAY WANT TO SLOW DOWN AND SAY NO TO THIS.
SO YES, MS. VIAGRAN, I WOULD ENCOURAGE YOU TO SAY NO TO THIS AS WELL.
THANK YOU. >> MAYOR NIRENBERG: THANK YOU, MR. FINGER.
JOSHUA GARCIA. >> ALL RIGHT. MY NAME IS JOSHUA GARCIA.
I LIVE ON THE PROPERTY THAT'S IN QUESTION, 225 NEAL ROAD.
I BUILT MY HOUSE THERE IN 2017 AND HAVE SINCE LIVED THERE AND THAT WAS PRIOR TO ANNEXATION FROM THE CITY. SO THIS IS A RESIDENTIAL LOT THAT'S BEEN USED AS A RESIDENTIAL LOT AND SO I'M JUST HERE TO THANK YOU FOR YOUR CONSIDERATION AND SINCERELY JUST ASK THAT YOU SUPPORT THIS. AND I'M HERE TO ANSWER ANY
QUESTIONS THAT YOU HAVE. >> MAYOR NIRENBERG: THANK YOU, MR. GARCIA.
COUNCILMEMBER VIAGRAN. >> VIAGRAN: THANK YOU. THIS PROPERTY WAS RECENTLY ANNEXED BY THE CITY AS PART OF THE NEAL ROAD ANNEXATION THAT TOOK PLACE ONLY SEVEN YEARS AGO. FOR MY COLLEAGUES IT'S IMPORTANT TO NOTE THAT THE ADDITIONAL RESIDENTIAL STRUCTURE IS ALREADY BUILT SO THIS CHANGE IS FOR THE APPLICANT TO MOVE FORWARD WITH REPLATTING THE PROPERTY.
ALSO BOTH THE CITY PLANNING AND ZONING COMMISSION HEARD THIS CASE AND ARE RECOMMENDING APPROVAL FOR THIS CHANGE. WITH THAT BEING SAID, I WILL
MAKE THE FOLLOWING MOTION, MOTION TO APPROVE. >> SECOND.
>> MAYOR NIRENBERG: THERE'S A MOTION AND SECOND FOR APPROVAL OF ITEMS NUMBER 9 AND 10. IS THERE ANY FURTHER DISCUSSION? HEARING NONE, PLEASE VOTE. MOTION CARRIES. ITEMS -- ITEM NUMBER 11,
[00:25:08]
EXCUSE ME. >> CLERK: THE APPLICANT IS AMENDING THIS REQUEST TO ADD IN NA, NON-ALCOHOLIC SALES.
STAFF MAILED 16 NOTICES, ZERO IN FAVOR, ZERO OPPOSED AND THERE IS NO REGISTERED NEIGHBORHOOD ASSOCIATION WITHIN 200 FEET. THANK YOU.
>> MAYOR NIRENBERG: THERE IS NO ONE SIGNED UP TO SPEAK ON ITEM NUMBER 11.
COUNCILMEMBER VIAGRAN. >> VIAGRAN: THANK YOU TO THE APPLICANT FOR INCLUDING THIS FRIENDLY NON-ALCOHOL AMENDMENT. MOTION TO APPROVE.
>> MAYOR NIRENBERG: THERE'S A MOTION AND SECOND FOR APPROVAL OF ITEM 11 AS AMENDED. ANY DISCUSSION? HEARING NONE, PLEASE VOTE.
MOTION CARRIES. ITEM NUMBER 12. >> CLERK: CASE] THE PROPERTY OWNER HAS AMENDED THEIR REQUEST TO REMOVE LOTS 4 THROUGH 8 OUT OF NCB 1114. NOW THE REQUEST IS ONLY TO REZONE FROM C-3 NA TO C-2. STAFF MAILED 35 NOTICES, SEVEN RECEIVED IN FAVOR, ZERO OPPOSED. IN NEIGHBORHOOD ASSOCIATION IS IN FAVOR AND WE RECEIVED TWO IN FAVOR OUTSIDE OF THE 200-FOOT NOTIFICATION BOUNDARY.
>> MAYOR NIRENBERG: NO ONE IS SIGNED UP TO SPEAK ON ITEM 12.
>> VIAGRAN: I WANT TO THANK THE HARLANDALE AND THE APPLICANT SO I MAKE MOTION
TO APPROVE AS AMENDED. >> MAYOR NIRENBERG: THERE'S A MOTION AND SECOND FOR APPROVAL OF ITEM 12 AS AMENDED. ANY FURTHER DISCUSSION? HEARING NONE, PLEASE VOTE. MOTION CARRIES. AT 2:42 ON OCTOBER 17, 2024, WE ARE ADJOURNED. THANKS, EVERYBODY.
