WE HAVE A QUORUM. >> GAVITO: I SEE THERE'S A LOT OF AGENDA ITEMS FOR CONTINUANCE. THEY WILL CONTINUE TO JANUARY 16.

CAN I GET A MOTION TO CONTINUE ITEMS 1 AND 14 TO THE JANUARY 16TH MEETING.

>> MOTION. >> SECOND. >> GAVITO: OKAY.

WE HAVE A MOTION AND A SECOND. IS THERE ANY COUNCIL DISCUSSION ON THE ITEMS TO BE CONTINUED? IS THERE PUBLIC COMMENT ON

IT? >> YES, MA'AM, THERE'S ONE MEMBER FOR SURE SIGNED UP.

>> GAVITO: WE WILL TAKE PUBLIC COMMENT SPEAKERS NOW. I'LL CALL JACK FINGER UP TO

THE PODIUM. >> MADAM MAYOR PRO TEM, OTHER MEMBERS OF OUR SAN ANTONIO CITY COUNCIL, FOR THE RECORD MY NAME IS JACK M. FINGER.

THIS PORTION OF THE AGENDA, A COUPLE ITEMS YOU'RE PLANNING TO CONTINUE TO LATER ON IN JANUARY. ONE OF THEM I WISH TO ADDRESS TO YOU IS ITEM NUMBER 1. YES, THAT'S MS. KAUR, THAT'S --N YOUR DISTRICT.

IN FACT, I THINK IT'S IN MS. HA. LET'S SEE, WHAT IS IT HERE? THE ALCOHOL VARIANCE.

YES, MA'AM. THE -- OVER ON SOUTHWEST LOOP 410 THERE'S A SCHOOL CALLED THE IDEA MAYS ELEMENTARY SCHOOL. AND YOU ARE THE PERSON REPRESENTING THAT DISTRICT. THE IDEA IS THAT YOU ARE GOING TO PUT OFF A DECISION REGARDING THE ALCOHOL VARIANCE, THE SALES OF ALCOHOL WITHIN 300 FEET OF WHERE THE SCHOOL KIDS PLAY. QUITE FRANKLY, I MEAN I GUESS IT'S ONE THING TO DELAY THE DECISION, BUT I QUITE FRANKLY THINK YOU SHOULD -- I THINK YOU SHOULD SAY NO TO IT TODAY. JUST BASED ON THE FACT THAT YOU DON'T WANT ALCOHOL SALES ANYWHERE

RIGHT HERE AND NOW. THANK YOU. >> GAVITO: THANK YOU, MR. FINGER. THERE IS A MOTION AND SECOND TO CONTINUE ITEMS 1 AND 14 TO JANUARY 16. PLEASE VOTE. MOTION CARRIES.

ALL RIGHT. MOVING ON TO THE NEXT FEW ITEMS TO CONTINUE.

CAN I GET A MOTION TO CONTINUE ITEMS 3 AND 4 TO THE FEBRUARY 6 MEETING?

>> VIAGRAN: I MAKE A MOTION TO MOVE. >> SECOND.

>> GAVITO: IS THERE ANY COUNCIL DISCUSSION ON THESE ITEMS TO BE CONTINUED? ALL RIGHT, SO THERE'S A MOTION AND A SECOND TO CONTINUE ITEMS 3 AND 4 TO THE FEBRUARY 6 MEETING. PLEASE VOTE. MOTION CARRIES.

MOVING ON TO THE NEXT ITEM, CAN I GET A MOTION TO CONTINUE ITEM NUMBER 8 TO

THE FEBRUARY 20TH MEETING? >> VIAGRAN: I MAKE A MOTION TO APPROVE.

>> SECOND. >> GAVITO: IS THERE ANY COUNCIL DISCUSSION ON THE ITEM TO BE CONTINUED? THERE IS NO PUBLIC COMMENT ON THIS ONE EITHER.

[00:05:02]

THERE'S A MOTION AND A SECOND TO CONTINUE ITEM NUMBER 8 TO THE FEBRUARY 20TH MEETING. PLEASE VOTE. MOTION CARRIES.

SO NOW WE'RE GOING TO MOVE ON TO OUR CONSENT AGENDA ITEMS. WE HAVE A NUMBER OF ITEMS ON THE CONSENT AGENDA. THEY ARE ITEMS NUMBER 2, 5, 6, 7, 11, 12, 13 AND 15. ARE THERE ANY ITEMS MY COUNCIL COLLEAGUES WISH TO PULL FROM CONSENT TO BE HEARD INDIVIDUALLY? ALL RIGHT.

SO YES, THANK YOU. WE DO HAVE A FEW FOLKS SIGNED UP TO SPEAK ON THIS SO I'LL CALL UP THE FIRST ONE. CHRISTOPHER TERAN FOLLOWED

BY JACK FINGER. >> GOOD EVENING. MY NAME IS CHRISTOPHER TRAN.

I LIVE IN THE LAUREL SUBDIVISION. ELECTED DIRECTOR OF THE HOA AND SPEAKING AGAINST THIS MEASURE. I AM ALSO REPRESENTING THE HOA. IN OUR OPINION THE COMMUNITY IS INSUFFICIENTLY -- TO SUPPORT HIGHER DEVELOPS. THERE ARE INSUFFICIENT ROADS TO SUPPORT APARTMENT COMPLEXES. THE FIRST SECTION IS A 50-YARD PROPERTY ON MARBACH ROAD. MARBACH ROAD HAS BEEN COMPLETED EXCEPT FOR THIS 50-YARD EXCEPTION WHICH IS CAUGHT IN A LAND DISPUTE. THIS NEEDS TO BE FINISHED UP. AS A RESULT OF THIS PIECE OF PROPERTY NOT BEING COMPLETED, ALL THE TRAFFIC IN THE SURROUNDING COMMUNITIES PROCEEDS THROUGH EMORY PEAK, WHICH IS A SMALL SUBDIVISION ROAD. THIS ROAD IS WELL BEYOND ITS TRAFFIC CAPACITY AT THIS TIME. EVERY MORNING THERE'S A MILE-LONG TRAFFIC JAM. IT TAKES ABOUT 20 MINUTES TO TRAVERSE THIS SEX AND THIS IS A SMALL -- SECTION AND THIS IS A SMALL SUBDIVISION ROAD.

THIS ROAD WOULD BE ONE OF THE THOROUGHFARES THAT WOULD BE SUPPORTING THIS APARTMENT COMPLEX. IN MY OPINION AND THE OPINION OF THE HOA IT IS WELL BEYOND ITS CAPACITY LIMITS. THIS NEEDS TO BE ADDRESSED BEFORE THIS APARTMENT COMPLEX IS COMPLETED OR PROPOSED.

FOR THIS REASON I URGE THE BOARD TO NOT SUPPORT THIS MEASURE AND I'M AGAINST IT.

THANK YOU. >> GAVITO: THANK YOU, MR. TRAN.

JACK FINGER. >> MADAM MAYOR PRO TEM, MY NAME IS JACK FINGER AND A COUPLE ITEMS I WISH TO BRING TO YOUR ATTENTION. I'M GOING TO SKIP AROUND.

ITEM NUMBER 12. MR. PELÁEZ, THIS IS IN YOUR DISTRICT.

IT'S BEEN ESTABLISHING AN INTENT ON TOP OF A GIGANTIC MONSTROSITY TOWER, A CELL PHONE TOWER. THIS WAS ESTABLISHED LONG AFTER THE HOMES WERE ESTABLISHED OVER THERE. THIS IS OVER ON WESTERN -- WESTERN OAK DRIVE THERE.

YES. 'IN FACT, I WENT TO THE LIBERTY OF ESTABLISHING A PHOTOGRAPH OF THAT THERE. BETTER TURN THAT AROUND, MR. --. YEAH, THERE WE GO.

IF YOU LOOK AT THAT ILLUSTRATION, THE TOWER IS RIGHT IN THE CENTER.

WITHIN 300 FEET OF THIS 120-FOOT TOWER, SIR, ARE THE RESIDENCES SHOWN IN THE YELLOW COLOR THERE. 300 FEET IS WHERE THEY START AND WITHIN 1,000 FEET YOU LOOK AT ALL THOSE OTHER DOZENS UPON DOZENS OF PERSONS WHO HAVE TO LIVE WITH THAT MONSTROSITY EVERY DAY AS THEY GO BACK AND FORTH FROM THEIR HOMES.

SIR, LET'S NOT ADD TO THIS THING ANY MORE THAN IT ALREADY IS.

JUST SAY NO TO IT, WOULD YOU, SIR? THEY ARE THE YOU ONES THAT HAVE TO LIVE WITH IT, YOU KNOW. I DON'T THINK YOU DO.

ONCE AGAIN, ALSO ON THIS PORTION OF THE AGENDA, ITEM NUMBER 11, I THINK, YEAH, THIS WAS A PRETTY CONTROVERSIAL ONE. SIR, THE -- IT'S ABOUT THE

[00:10:02]

PROPOSAL FOR AN AMOUNT COMPLEX I THINK IT IS. THE THING IS BACK IN OCTOBER AS MANY AS ONE OUT OF FOUR PERSONS SURROUNDING THAT AREA SAID THEY DID NOT WANT IT. 25%. YOU ARE DOING GOOD IF YOU GET ANYWHERE FROM 5 TO 10% SAYING ANYTHING ABOUT IT, BUT THIS IS ONE OUT OF FOUR.

YOU HAD SIX PEOPLE SPOKE AGAINST IT AT THE MEETINGS AND THAT'S SAYING SOMETHING TOO. ANYTHING BEYOND ONE OR TWO PERSONS.

AS MANY AS NINE PEOPLE OUTSIDE OF THAT 200-FOOT AREA SAID THEY DID NOT WANT THE APARTMENT COMPLEX. MAYBE BECAUSE IT'S PRETTY CLOSE TO THE SING RESIDENCES THERE. I THINK YOU MAY WANT TO RECONSIDER THAT ONE AND SAY NO TO IT. AND FINALLY, I KNOW MR. JOHN COURAGE IS NOT HERE TODAY, I DON'T KNOW WHO IS CARRYING THE WATER FOR HIM FOR ITEM 13, BUT IT IS A TATTOO PARLOR, LIKE WE NEED ANOTHER TATTOO PARLOR ON LOOP 1604 THERE.

WHY NOT SAY NO TO IT. THANK YOU. >> GAVITO: THANK YOU, MR. FINGER. IS THERE ANY COUNCIL DISCUSSION ON THE ITEMS ON THE CONSENT AGENDA? THERE IS A MOTION AND SECOND TO --

>>

CONSENT. >> GAVITO: THANK YOU, COUNCILMEMBER VIAGRAN AND COUNCILMEMBER PELÁEZ. NOW THERE IS A MOTION AND SECOND TO APPROVE THE FOLLOWING ITEMS ON CONSENT AGENDA. PLEASE VOTE.

MOTION CARRIES. SO NOW WE'LL MOVE ON TO THE REMAINING AGENDA ITEMS. 9 AND 10. WE HAVE SOME ITEMS TO HEAR INDIVIDUALLY STARTING WITH

ITEMS 9 AND 10. >> PLAN AMENDMENT AND REZONING AMENDING THE WEST, SOUTHWEST SECTOR FROM GENERAL URBAN TIER TO REGIONAL CENTER AND REZONING FROM C-2 TO C-3 GENERALLY LOCATED IN THE 1600 BLOCK OF MEADOWWAY DRIVE.

PLANNING COMMISSION RECOMMENDS APPROVAL. THE APPLICANT IS AMENDING THE REQUEST TO ADD THE NA, NON-ALCOHOLIC SALES DESIGNATION, TO THE REQUEST TOD C-3 DISTRICT. STAFF MAILED 20 NOTICES, TEN RECEIVED IN FAVOR, ZERO OPPOSED. THE LACKLAND TERRACE NEIGHBORHOOD ASSOCIATION IS IN FAVOR AND OUTSIDE THE BOUNDARY STAFF RECEIVED TWO NOTICES IN FAVOR.

THANK YOU. >> GAVITO: THANK YOU. I SEE WE HAVE ONE PERSON SIGNED UP TO SPEAK. I'LL CALL TO THE PODIUM JACK FINGER.

YOU HAVE THREE MINUTES. >> MADAM MAYOR PRO TEM, ONCE AGAIN, MY NAME IS JACK FINGER, AND ON THIS PARTICULAR CASE OVER ON THE FAR WEST SIDE IS THE -- OVER IN I BELIEVE IT'S MS. HAVRDA'S DISTRICT, ONCE AGAIN YOURS, THERE, MADAM.

LOOK AT ALL THE RED FLAGS ON THIS ONE, IF YOU WOULD. THE PLANNING STAFF THOUGHT IT WAS A -- I TAKE THAT BACK. YEAH, THAT'S RIGHT, THE PLANNING STAFF THOUGHT IT WAS A BAD IDEA. NOT JUST THE ZONING STAFF, BUT THE ZONING COMMISSION NOT IT WAS A BAD IDEA. WHAT IS SUCH A BAD IDEA HERE? A BIG USED CAR LOT. ANOTHER BIG USED CAR LOT, LIKE YOU REALLY NEED ANOTHER USED CAR LOT OVER IN THAT AREA.

YEAH. ONE OF THE BIG REASONS THEY CITED IS BECAUSE THE HIGH INTENSE, QUOTING HERE, HIGH INTENSE COMMERCIAL USE NEGATIVELY IMPACTS THE ABUTTING RESIDENCES. YEAH. BIG USED CAR LOT.

HOW WOULD YOU LIKE TO HAVE A BIG USED CAR LOT SITTING RIGHT NEXT TO YOUR RESIDENTS, RIGHT NEXT TO YOUR BACKYARD? MS. HAVRDA, WHY NOT SIDE WITH THOSE WHO HAVE TO LIVE NEXT TO THIS THING AND JUST SAY NO TO IT.

THANK YOU. >> GAVITO: THANK YOU, JACK.

CAN I GET A MOTION ON ITEMS 9 AND 10? >> HAVRDA: ALTHOUGH CITY STAMP AND ZONING COMMISSION ARE RECOMMENDING DENIAL, THE LACKLAND TERRACE NEIGHBORHOOD ASSOCIATION IS IN FAVOR AND THE APPLICANT HAS RECEIVED SUPPORT FROM

[00:15:07]

THE NEARBY COMMUNITY SO I MOVE TO APPROVE. >> SECOND.

>> GAVITO: ALL RIGHT. IS THERE ANY COUNCIL DISCUSSION ON THE ITEM?

>> CAN I GET A QUICK CLARIFICATION. YOU MEAN APPROVED AS

AMENDED? >> HAVRDA: YES, APPROVED -- MOVE TO APPROVE

AS AMENDED. >> GAVITO: ALL RIGHT. SO WE HAVE A MOTION AND A SECOND. PLEASE VOTE. MOTION CARRIES.

THAT IS ALL OF THE ITEMS FOR TODAY'S ZONING AND LAND USE SESSION.

THE TIME IS 2:22 AND THE MEETING IS NOW ADJOURNED. THANK YOU.
