OKAY, ITEM NUMBER 5 ON THE ZONING SESSION TODAY IS ABOUT PLACING AN AUTO BODY SHOP -- OR GIVING PERMISSION FOR IT -- OVER IN, UH, MS. VIAGRAN, YOUR DISTRICT TH THERE, AND IT'S OVEN ROOSEVELT AVENUE. THE REASON THAT I THINK THAT YOD JUST SAY NO TO THIS OUTRIGHT, INSTEAD OF CONTINUING IT IS BECAUSE AT THE ZONING COMMISSION'S MEETING RECENTLY, YOU HAD AS MANY AS FOUR PEOPLE SPEAK ON THIS ITEM, SAYING THEY OCCASION POSED IT.

WHEN ONE IS DOING GOOD TO JUST GET ONE OR TWO PEOPLE TO SPEAK IN OPPOSITION.

NOW THE QUESTION IS, WHY DID THEY OPPOSE IT? WELL, IT TURNS OUT THAT THE AUTO BODY SHOP HAD BEEN COMMITTING SOME VIOLATIONS ON ITS PREVIOUS ZONING STATUS.

AND IT WAS ASKING THE -- UM, THE ZONING COMMISSION TO GIVE THEM FORGIVENESS ON THIS SITUATION.

YEAH. WELL, THE CITIZENS -- THE RESIDENTS WHO LIVE AROUND THERE, THEY DON'T LIKE THAT. THEY DON'T LIKE SOMEBODY TAKING LIBERTIES -- LIBERTIES LIKE THAT. AND SO, UM, I -- I WOULDN'T BLAME THEM EITHER, YOU KNOW? I WOULD JUST URGE YOU TO JUST SIMPLY SAY NO TO THIS OUTRIGHT. THANK YOU.

THREE DWELLING UNITS. THIS IS LOCATED AT 111 BELFAST DRIVE.

STAFF RECOMMENDS DENIAL, PLANNING COMMISSION RECOMMENDS APPROVAL.

26 NOTICES WERE MAILED, ZERO IN FAVOR, TWO OPPOSED, AND THERE WAS NO RESPONSE FROM THE SAN ANTONIO DISTRICT 1 RESIDENTS' ASSOCIATION. OUTSIDE OF 200 FEET, TWO NOTICES

WERE RECEIVED IN OPPOSITION. THANK YOU. >> MAYOR JONES: GREAT, THANK YOU. WE HAVE ONE INDIVIDUAL SIGNED UP TO SPEAK ON THIS ITEM.

JACK FINGER. >> MAYOR JONES AND OTHER MEMBERS OF THE COUNCIL, I AM JACK FINGER. AND ON THIS PARTICULAR ZONING CASE, IT HAPPENS TO BE IN DISTRICT 1, COUNCILWOMAN KAUR, YOUR DISTRICT HERE. AND IT'S ABOUT -- WELL -- ADDING THREE DWELLING UNITS AND ADDING SOME MORE INTENSITY TO THIS -- THIS AREA OVER ON BELFAST DRIVE.

LOOKING AT THE BACKUP DOCUMENTS I FOUND OUT THAT THE PLANNING COMMISSION, UM, THE PLANNING -- THE PLANNING DEPARTMENT STAFF -- THOUGHT THAT IT WAS A BAD IDEA. AND SO DID THE ZONING STAFF.

AND WHY DID THEY SAY IT WAS A BAD IDEA? WELL, THEY SAY IT, QUOTE, THROWS OUT THE MINIMUM LOT SIZES. YEAH. JUST THROWS IT OUT -- IT REDUCES THE SETBACKS, MEANING THAT THE RESIDENTS ARE GOING TO BE CLOSER AND CLOSER TO THE STREETS RIGHT NEXT TO THE TRAFFIC. AND IT ALSO WAIVES THE PARKING STANDARDS.

THROWS OUT THE STANDARDS FOR MINIMUM PARKING SLOTS FOR PEOPLE WHO MAY HAVE TO LIVE THERE.

AND SO, YEAH, A LOT OF THINGS, UM, NOT GOING FOR THIS THING. AND SO CONSEQUENTLY, I, FOR ONE, WHO LIVE IN DISTRICT 1 -- I WOULD APPRECIATE IT IF YOU WOULD SIMPLY SAY NO TO THIS CASE HERE.

MS. VIAGRAN'S DISTRICT. IT'S ABOUT, OH, GIVING SOME, UM, UH -- HELP TO SOME PEOPLE WHO WANT TO PUT A WAREHOUSE, AND A USED CAR LOTS OVER ON RIGSBY AVENUE.

AND BOTH OF THE PLANNING STAFF, AND THE ZONING STAFF ALSO THOUGHT THAT THIS WAS A BAD IDEA. WHY? BECAUSE BASICALLY SAID THAT THE RESIDENTS AND THE STAKEHOLDERS -- I'M JUST QUOTING FROM THE BACKUP DOCUMENTS -- RESIDENTS AND STAKEHOLDER DOES NOT WANT THE INTENSE COMMERCIAL USES THAT THE WAREHOUSE AND THE USED CAR LOT BRING. SEE, THEY HAVE TO LIVE AROUND THESE -- THIS APPLICATION.

STAFF RECOMMENDS DENIAL AND THE PLANNING COMMISSION HAS APPROVE WITH THE INSULATION OF DOWNWARD FACING LIGHTING. THE STAFF MAILED 24 NOTICES AND ONE RETURNED IN FAVOR AND ONE WAS RETURNED IN OPPOSITION. AND THE NORTHERN HILLS NEIGHBORHOOD ASSOCIATION IS IN

I SAID ITEM NUMBER 4, THE STAFF RECOMMENDED DENIAL, AND I'M JUST GOING BY WHAT THE -- THE WORDING SAYS OVER HERE. SO JUST TO LOOK TO KNOW WHERE I'M COMING FROM THERE. SO, NOW ON THIS PARTICULAR ITEM -- ITEM 8 AND -- ITEMS 8 AND 9. IT'S ABOUT OH, PLACING, UM -- WELL, EXACTLY WHAT IS IT HERE? EVERYTHING IS ON DIFFERENT PAGES. YEAH.

FROM, UM, MULTIFAMILY TO COMMERCIAL. MULTIFAMILY, MEANING AN APARTMENT COMPLEX ON THIS AREA ON STAHL ROAD. AND THIS IS IN MR. WHYTE, YOUR DISTRICT THERE, YEAH. WELL, HERE, SIR, THE PLANNING STAFF SAID THEY SAY DENY THIS AND THE ZONING STAFF SUGGESTS THAT YOU DENY IT AS WELL. OTHER PEOPLE HAVE DIFFERENT OPINIONS ON THIS, BUT THE REASONS THAT THE -- THESE GUYS SAY DON'T DO THIS IS BECAUSE THE WAREHOUSE ALLOWS FOR COMMERCIAL ENCROACHMENT. COMMERCIAL ENCROACHMENT.

WE HAVE SEEN THAT ALL THROUGHOUT THE CITY FOR MANY, MANY YEARS HERE, COMMERCIAL ENCROACHMENT INTO AREAS WHERE RESIDENTS LIVE AND EVENTUALLY THEY GET DISCOURAGED AND THEY TEND TO MOVE OUT AND THE NEIGHBORHOOD JUST GOES DOWNHILL FROM THERE. COMMERCIAL ENCROACHMENT.

AND -- AND IT ALSO SITS -- WELL, IT'S OBVIOUS THAT IT SITS AMID THE EXISTING NEIGHBORHOOD RESIDENCES. IT'S VERY, UM, INAPPROPRIATE. A LOT OF -- WHAT IS THE WORD? BAD CIRCUMSTANCES, IS THE BEST WAY THAT I CAN SAY IT. SO, ANYWAY, YEAH, UM, ON STAHL ROAD. JUST MAYBE WE SHOULD SAY NO TO WHAT IS GOING TO BE A FUTURE LONG-TERM PROBLEM FOR THE PEOPLE WHO LIVE OVER THERE.
