TEM, OTHER MEMBERS OF THE SAN ANTONIO CITY COUNCIL. MY NAME IS JACK FINGER AND ONE OR TWO ITEMS I WISH TO BRING TO YOUR ATTENTION. ITEM NO. 5, I BELIEVE MR. MUNGIA, THIS IS IN YOUR DISTRICT. IT'S ABOUT PLACING A -- WELL, THEY CALL A MANUFACTURED HOME/OVERSIZED VEHICLE SALES ARRANGEMENT THERE. MANUFACTURED HOMES WHAT USED TO BE CALLED A TRAILER PARK HOME SALES. YEAH. THE PROBLEM WITH THIS, MR. MUNGIA, IS THAT THE ZONING STAFF THOUGHT THIS WAS A VERY BAD IDEA.

THEY ARE THE ONES WE HIRE TO FIND OUT ALL THE DETAILS OF THESE THINGS.

AND WHAT THEY FOUND OUT WAS BASICALLY, QUOTE, IT WOULD ISOLATE A SINGLE-FAMILY DWELLING WITHIN COMMERCIAL AND INDUSTRIAL ZONING DISTRICTS.

YEAH. IT WOULD ISOLATE THIS LITTLE RESIDENCE THAT HAD A RIGHT TO BE THERE. DETRIMENTAL TO THE HEALTH, SAFETY, AND WELFARE OF THE CURRENT AND FUTURE OCCUPANTS OF THAT RESIDENCE. SO, YES.

THIS IS OVER ON OLD PEARSALL ROAD AND THAT'S WHY THE ZONING STAFF THOUGHT YOU REALLY SHOULD NOT GO BEYOND THIS ONE HERE. I WOULD ENCOURAGE YOU, SIR, TO SIMPLY SAY NO TO THIS ONE. THANK YOU.

THE TRACT IS CURRENTLY ZONED RM-4 AND THE OWNER HAS LIVED ON AND OPERATED THIS PROPERTY FOR OVER 30 YEARS. HIS RESIDENCE IS IN THE BACK OF THE TRACT.

IN THE FRONT, HE RUNS HIS TRUCK SERVICE OUT OF IT. LIKE, A CONSTRUCTION MATERIALS, STORES TRUCKS THERE. NO OTHER SITE. HE'S REQUESTING THE ZONING CHANGE FOR THE FRONT PORTION OF THE PROPERTY TO C-2 CD TO CONTINUE OPERATING HIS BUSINESS DUE TO CODE COMPLIANCE VIOLATIONS THAT HE HAD RECEIVED RECENTLY. SO WHEN HE PURCHASED THE PROPERTY, HE HAD NO IDEA THAT THE WHOLE THING WAS RM-4 AND HE WASN'T ABLE TO OPERATE HIS BUSINESS THERE. AS I MENTIONED, HE CURRENTLY LIVES IN THE BACK.

THERE ARE SIMILAR CIRCUMSTANCES ON THE ADJACENT PROPERTIES AROUND THE SITE TO THE NORTH AND EAST. THOSE ARE ZONED AS MANUFACTURED HOUSING BUT ARE ALSO USED AS INDUSTRIAL PURPOSES.

HE'S UNABLE TO CONTINUE HIS DAILY BUSINESS OPERATIONS FOR FEAR OF ANY ADDITIONAL VIOLATIONS OR ANY OTHER MEASURES TAKEN BY THE CITY. THE PROPOSED ZONING IS -- OR THE SITE IS WITHIN THE PORT SAN ANTONIO PLAN AND IT'S WITHIN THE URBAN MIXED-USE AREA, WHICH INTEGRATES BOTH RESIDENTIAL AND COMMERCIAL USES.

THE PROPOSED ZONING DOES COMPLY WITH THE PORT SAN ANTONIO PLAN AND LIVE/WORK OPTIONS ARE PERMISSIBLE. THE ADJACENT C-3 AND I-1 ZONING AREAS DO NOT COMPLY WITH THE CURRENT LAND USE PLAN. THANK YOU FOR YOUR TIME.

I GUESS THAT'S ONE OF THE REASONS WHY THE ZONING STAFF THOUGHT YOU MIGHT WANT TO SAY NO TO THIS ONE. SOMETHING THAT TALL, YOU REALLY NEED A MUCH BIGGER SETBACK THAN WHAT YOU HAVE BEEN PROPOSED HERE. JUST IN THEIR OWN WORDS, IT WOULD ALLOW COMMERCIAL ENCROACHMENT. AND THAT MAKES SENSE.

YOU PUT A COMMERCIAL ITEM IN THERE RIGHT NEXT TO SOME OF THE HOMES THERE.

COMMERCIAL ENCROACHMENT IN THIS RESIDENTIAL NEIGHBORHOOD.

THAT'S THEIR WORDS, NOT MINE. I WISH YOU WOULD NOT ALLOW THE START OF COMMERCIAL ENCROACHMENT, ESPECIALLY WITH -- SOME OF US HAVE TO CALL A MONSTROSITY BECAUSE THEY ARE THE ONES WHO HAVE TO LIVE AROUND THAT AREA.

GO HOME, LEAVE, COME BACK HOME EVERY DAY AND LIVE RIGHT NEXT TO THIS THING THAT -- I MEAN, IMAGINE IF YOU HAD TO ENTERTAIN NEIGHBORS AT A PARTY OR SOMETHING. MAYBE THEY HADN'T BEEN TO YOUR HOUSE BEFORE AND THEY SAY, ARE YOU LIVING NEXT TO THIS BIG THING? YEAH.

WITH THIS ITEM, I WOULD LIKE TO THANK THE APPLICANT AND THE REPRESENTATION.

WHEN THIS FIRST CAME TO COUNCIL IT INVOLVED THE DEMOLITION OF AN EXISTING HOME AND DISPLACEMENT OF RENTERS. THIS IS AN IDEAL NEIGHBORHOOD WITHIN THE COLLINS GARDEN NEIGHBORHOOD ASSOCIATION.

IT'S A COUPLE OF BLOCKS AWAY FROM THE NEIGHBORHOOD H-E-B, COLLINS GARDEN LIBRARY ALONG WITH A WALK TO THE HIGH SCHOOL AND IT'S IN CLOSE PROXIMITY TO SO MANY COMMUNITY AMENITIES. I'M GRATEFUL THAT IN COLLABORATION AND WITH THE ASSISTANCE OF VINCENT AND KEN THEY BOTH WORKED TO HELP PRESERVE THE EXISTING STRUCTURE AND INCLUDING A LEASE PROVISION ADDRESSING ROUGHLY $30,000 IN IMPROVEMENT TO THE PROPERTY. AS A CONDITION TO THE OPTION, THEY SHOULD PAY $30,000 [INDISCERNIBLE]. SO I HIGHLIGHT THAT PIECE BECAUSE NOT ONLY ARE WE PRESERVING AFFORDABLE HOUSING WITHIN THE URBAN CORE, WE'RE ALSO STICKING TO OUR SA TOMORROW PLAN THAT THIS FALLS WITHIN. SO GRATEFUL THAT WE CAN CONTINUE TO MOVE FORWARD WITH MOVING THE STRATEGIC HOUSING IMPLEMENTATION PLAN FORWARD WHILE SUPPORTING THE APPLICANT WITH THEIR WORK AND VISION IN THIS PARCEL.
